We negotiated a settlement previously on an image, unfortunately I thought it was for a different one, we evidently had 2 "cases" open and I was unaware of this. So now we get a second demand letter from McCormack for the "extra" 2 images they said were on a different web site, although it was a dns forward to the original site. On the settlement check I only referenced the one case, not knowing they had 2 case numbers.
Using the standard legal response letter, paid for through ELI, has anyone had any real luck or is it only a delaying tactic?
I'm just afraid of more requests from them, even if we negotiate on this case!

Well you ca bet your bottom dollar they have you pegged as low hanging fruit, and likely to pay, thats for sure. The letter program is not by any means a delaying tactic., However being as you already paid once, which is a s good as admitting guilt, you will have a greater chance of them filing suit, although still doubtful they would.. I'm sure you can still use the letter program to get Asshat Seattle attorney Timothy B. Mccormack to leave you alone..

It is not a delaying tactic. We have been engaged in this process since June 2008. If it was just a delaying tactic and not successful don't you think you would see forum posts on here saying that? Wouldn't Getty be advising you of that? We are rapidly approaching our 1,000th satisfied client in this arena. Our legal position and strategy has been vindicated online and in court. We are the only site dealing with this issue head on and the regular contributors to these forums are willing to put our names and reputations on the line over this abuse of the copyright system.
