Title: I emailed letter on Jun 6th but have not received any answer yet

Hello,

Boy am I glad to have found this forum. I received a letter from McCormack giving me 21 days to respond etc...

I emailed it together with the required information to the email address of Attorney Oscar Michelen as per instructions found in this site.  I sent this last Friday (Jun 14th).  I still haven't heard from them.  I know there is at least the need for two business days, and it's barely passed but I am antsy with this ridiculous case hanging over my head.

I am also worried that my email go sent to a junk folder. 

:(

Hopefully the attorney or someone in contact with him can give me some info as to what I should do next?

"Please allow the staff two (2) business days for someone to respond to your request. If you do not receive a response or need to follow-up on a case, call Oscar’s assistants (Susan, Jeffery, or Jonathan) at 516-741-3222."

have you called to follow up?

Good deal, don't fret to much about Seattle Attorney and copyright troll Timothy B.McCormacks "deadline" it is largely a scare tactic designed to make you act blindly...

Thank you Robert.  I am not overly worried.  But at the end of the day, this individual, through legal shenanigans is forcing me to hire an attorney to represent me (albeit for a reduced price through this website).  It's an expense I really didn't need.

Most everyone on this site agrees with you there, Jacques.  That's why it is incumbent upon us to make the world, including our legal representatives, aware of their shenanigans.  I hope you will partake in this effort whenever the opportunity arises.

I will gladly partake in this community's efforts to stop this type of harassment.  In my case, I don't even own the website that had the offending thumb image, although I was the owner when the printout of the page was made.  The image (a thumbnail sized scale) was part of a template I bought in good faith.  How (if it is possible) can I protect myself from such action in the future?  I don't go about "borrowing" images I don't have copyrights licensing for but I have hired designers who have created templates with images and I am worried they have used images that might be similarly considered to be a copyright infringement by companies such as McCormack who are in this to make a quick buck!

Be that as it may, I have talked to someone at the Attorney Oscar Michelen office and my correspondence has now been found.  I am to fill an application form and pay.  grrr...

I am getting concerned that as of yet I have not heard back from the the CUOMO's office.  I sent them all the relevant information plus payment a week ago, and have left many messages to inquire as to whether they had indeed received said information but so far have not been contacted back.  Whenever I call them, all I get is a recorded message asking me to give the extension number I wish to leave a message for. Since I don't have that information, I am then taken to a general voice mail and it's there I leave the message.  But no one has called me back yet.

Can anyone offer an advice?  I have sent the document and payment required by CUOMO a week ago.  I have made several attempts to contact the office but every time got a voice mail.  I left numerous messages but have not heard from them at all.  The 21 days period in the original letter from mccormak is about to expire and I don't know what I should do next.

don't worry about timmy's deadline, it's a scare tactic, call the office again on monday, and maybe send another email..Oscar has probably been in trial all week...you have to realize this is not his business, and that "real cases" come first...you need not worry..

Sorry, I just saw your question.  Two weeks ago I was able to speak with someone.  Apparently they had not received the documents they had asked I fax them so I did that again, and this time someone from their office called me back saying that they had now received the two documents and they would take care of things and contact me again that very day.

As of today, I haven't heard a single peep from them. Nor have they debited my cc by the way!  What I have received though is a follow up email from mccormack sent by an Ann Hicks, para-legal giving me until august 19th to pay or else....

So this is where I am at now.  I have no idea what the attorney is doing, if anything.  They are not easy to get a hold off and don't show a lot of urgency in their dealings with me.  I have no idea as to whether I am actually wasting my time, waiting for them to do something or not.  I must admit it is disheartening.

I realize they are busy and all that, but I have dealt with lawyers before and have never been in a situation where I couldn't reach them.  I know they are known to a lot of folks on this site and I have no reason to doubt their efficacy but so far, I haven't seen it.

I really don't know what to think any more.  I don't want to alienate them by writing something that might be wrongly perceived and I do think they are my best and cheapest way forward in dealing with this ridiculous case.  At least I hope they are...

If I ever hear a complaint about Oscar's letter program it has to be the lag in communication. I honestly think that is one area that could be marked as "needs improvement." That said, however, you have to realize there is a huge gap in the level of urgency. People like Oscar and Robert and S.G. and Greg and Matthew have seen how this has played out for hundreds of people over many years. The wheels of injustice turn very slow and the "deadlines" they present are a joke.

But I also understand that as a new letter recipient people want to get to some sense of "closure" as soon as possible. People don't like the feeling of this hanging over their head.

Personally I think Oscar needs to hire Ving Rhames for his office:

Maybe I shouldn't been overly concerned after reading this poster's experience in waiting for a reply from Oscar's defense team. I, too, am anxiously awaiting a reply. I sent my documents July 25, assuming that I would get a response as advertised: "Please allow the staff two (2) business days for someone to respond to your request. I know they are busy, but maybe they need to change the website to a more realistic time frame so we can relax a bit. If it really does take 2 months or more for a response, at least we'd not be checking our email messages so often. Has anyone else had a delay in getting a response? I'm afraid Getty will be calling again and I want to truthfully say I have hired a lawyer. I also want to get Oscar paid, but I'm not sure how to do that.

If it has been more than two days I would call the number to make sure they have seen the info and are aware of it.

Hey guys, I have definitely been swamped with litigation this summer -more so than usual for this season- and have even had to delay or postponed planned vacations. That is why we are delayed in getting back to everyone from the digitalimagelitigation email.  As Greg suggests please remember that you can always call our office at 516 741 3222 If I am not in speak with Jeff or Susan who help on the Getty Images issue and can usually address your concerns. Also remember that the deadlines set in the letters are fictitious and don't actually effect the claim whatsoever. Finally, please also recall that I am a NY litigator with a very active practice and that while this is a very  important issue to me, it sometimes has to  take a back burner to other concerns I am dealing with  in my practice.  That being said we always try to response as promptly and efficiently as possible to your emails and inquiries.

True to his word, I got an email from Oscar's office with an application and credit card form and a request to send my documents. I had already sent them with my initial email but just to be safe I printed them and re-sent them. Thank so much for responding and all the help this forum has offered.

I have a similar issue in that I emailed payment and info about a month ago, but haven't received anything back.  I left a voicemail and sent a couple of emails, but haven't gotten a reply.  I'm not upset by any means, but I'd like to get a status update in case I'm contacted again.

How long does it usually take from the time payment is processed until you receive your defense letter?

Oscar - I forwarded the emails to you when I saw your post.  I then sent a follow up email to you as well as sent an email to Jeffrey.  I also called your office and nothing.

Being as Oscar has been bogged down lately, and none of us work in his office, and we don't know when he'll pop in, you might want to simply contact his office directly.

Hey one and all - please be patient. We are having some tech issues at the office and I have been absolutely swamped of late. However, we always do get to everyone's letters and we do our very best to get to them as soon as we can. Mike - the website has been up for over five years. That should tell you something.  Thanks again all for your patience
