ImageRights proof of representation
« on: July 02, 2018, 05:24:22 PM »
Hello-On June 22, 2018, I received two separate emails from an individual calling herself a License Compliance Specialist for ImageRights International.  It is not much different from other's that have been described in this forum, demanding over $5800 for the use of three photos that appear on my interior design blog.  I ignored it until this person called and left a voice mail about the receipt of those emails.  I then felt the need to respond, after reading posts on this forum, asking for proof that they were legal representatives of both Loupe Images and Great Bowery, Inc. dba Trunk Archive.  I was directed to a link for the Case Access Code page that had been embedded in the email where there are downloads to a Letter of Authorization.  This is a one page document on the respective companies letterhead with a short statement saying that ImageRights is authorized to represent them on copyright matters and is signed by an individual.  I don't feel this to be sufficient proof.  Am I incorrect?

I could not find much about other ImageRights claims in the forum and any help is appreciated.

This is where is pays to screen /ignore incoming calls.. Now they know that you know, that you got the email, and the phone call, and whatever else you may have told them..expect more letters and calls coming, you've nibbled the bait and they are going to try to set the hook.. They might be authorized to enforce copyright, but a lawyer would need to be involved to file suit, it may or may not get to that point. But rest assured they will continue to contact you.
Most questions have already been addressed in the forums, get yourself educated before making decisions.

Any advice is strictly that, and anything I may state is based on my opinions, and observations.

So, what are you saying?  If you get the proof you want, then you will just pay up? You may want to think a few steps ahead.

This is a one page document on the respective companies letterhead with a short statement saying that ImageRights is authorized to represent them on copyright matters and is signed by an individual.  I don't feel this to be sufficient proof.  Am I incorrect?

I'm a non-lawyer but not legally ignorant either. Under the 1st Amendment, I have the right to post facts & opinions using rhetorical hyperbole, colloquialisms, metaphors, parody, snark, or epithets. Under Section 230 of CDA, I'm only responsible for posts I write, not what others write.
