Please be advised that NCS has been retained with regard to the settlement of an image infringement claim in the above referenced matter. In that regard, we have been assigned this file, and have attached hereto copies of the letter previously sent by our client together with copies of the unauthorized images and the capture of said images on your website. Our client has attempted to resolve this claim by communicating with your company directly, but has been unable to do so. Our goal is to resolve this claim on an amicable basis, without having to resort to further action in this regard. We do have some flexibility with the amount claimed if this is resolved immediately. Alternatively, if we cannot settle this imminently, we would be obligated to refer the file back to our client for further action including the potential initiation of suit. It would be preferable to settle this matter upon terms agreeable to both parties, and to avoid the time and expense of potential protracted litigation. We trust that we can resolve this amicably, and we look forward to hearing from in this regard upon receipt of this email.

This was received this past week. I called the listed number at midnight Saturday using a internet phone company. The message gave the business hours for a Florida lawyer.
I deleted my website as its deletion was already on my TO DO list. The only thing that was Published on this website was a Template provided by the web hosting company, the company name, an email contact address and the address for the company. In searching the website prior to deletion, I did not see any images other than the template.
Of course, there was no attachment as listed in the email nor have I had any prior communication from the image company. What I have had however in the past month are several Silent/hangup calls of the type that precede the receipt of the threatening letter from a collections company.
SO, I am drafting in my head, what I need to do, any recommendations?

It sounds as if you have totally ignored the letter sent by Getty up to this point, while some in the form advocate that I personally do not in think at least one letter should be sent stating your position and demanding proof of claim.
At this point you can write NCS a letter telling them that this is a claim and not a debt and you are not aware of any judgment against you and you do not agree with Getty's claim so do not contact me again.
I would recommend reading the thread on my experiment against Getty as well as the forums in general as there is a lot of good information contained in them in which you can use. In my thread you can also see correspondence between Getty and myself as well as complaint letters that I filed against Getty with various agencies.

Your options at this point are to continue to ignore it, to respond and handle it yourself which is what I have chose to do or retain counsel at which point Getty, NCS or Gettys lawyer Timothy McCormack would no longer be able to contact you directly.
If you choose to fight it yourself you may wish to consider Matthews support call where he can bring you up to speed very quickly and give you advice tailored to your situation. If you choose the last option I strongly recommend Oscar's defense letter program.

I did not ignore any correspondence from Masterfile. However, I realize that until this past July the email contact address was invalid. Any email sent to that address would have bounced. What concerns me is that though this website was published it was always in the "Under Construction" state and had only text and template.

Sorry, it looked like from NCSs letter the letters from MF had been ignored. I also was not aware that MF was using NCS, I thought that Getty was the only one of the trolls using them.
You options are still the same though.

I'm actually one of the people that usually thinks it is best to deal with these issues directly. But....
Let me ask you this: That letter you got was through a form on your web site?
You have never received a letter in the mail?
If the answer to both of these is "yes" and it were me, I would file this email in the same place I put "Nigerian Lottery Winner" and "Free Viagra" emails. I see a lot of spam come through my online forms, and it would be easy to believe that this is just another hustle.

Actually, I didn't know Masterfail was using NCS now. That is news to me.
NCS has no power. They are just a collection agency easily dismissed.
