Pay then sue them? Has anyone tried this.

I just received a letter this week from GI asking for $1750 for two images on our webpage (the web designer made the page 9 years ago and denies any knowledge).  I am planning to offer a settlement amount.  If they do not take that, and they probably won't, I am inclined to pay in full rather than have a collection agency after me.  Then file a small claims suit asking for the $1750.  Small claims is a court of equity and a favorable judgement is a possibility.  They also have to show up or forfeit.  Has anyone sued them back or threatened to do so?

collections isn't really an issue, but just another tactic they like to use...Legally they cannot collect on a "claim" nor can a collection agency hassle you for a "claim"... see the following post and be enlightened..

Most questions have already been addressed in the forums, get yourself educated before making decisions.

Any advice is strictly that, and anything I may state is based on my opinions, and observations.

Dude - when you pay them they will have you sign a document generally releasing them from any claims. Even if you didn't sign a release voluntarily paying them will be a killer to any claim against them even in small claims.
