I just came across this article and thought I would share it.  Here is an excerpt from the article.

Quote
Liberty Media Holdings (LMH) is suing two roommates in New York, alleging the illegal downloading of a pornographic film, even though LMH argues that only one made the infringing copy. Remarkably, LMH claims that the non-downloading roommate is also responsible for copyright infringement, simply because the Internet subscription is in his name and he might have known his roommate sometimes made illegal downloads.

I don’t think that this has much of a chance as it will be very had to prove that he knew what his roommate was doing.  Is it me or do the trolls seem to be getting more desperate and really starting to grab at straws lately?  You would think after all the recent smack downs from the judicial system the trolls would be a little more leery about filing this kind of suit.  I will keep an eye on this and see what happens.

They also won't be able to prove that the other roommate downloaded the file, this will be a lost cause...who's to say I did not live above them and used there wifi to download it?..

That is very true and would be akin to the recent case over the IP addresses where they could not prove who was actually connected to the router, I hadn’t thought about it that way. Surely the attorneys know that there is next to no chance at all of winning this.  Unless they are just hoping they will just settle rather than fight because it would be cheaper.   I wish we could get a law like they have over in the U.K. where if you file a suit like this and lose you have to pay the other parties legal fees.  It will be interesting to watch.

EFF Slams 'Negligence' Claim in Corbin Fisher Copyright Suit

But CF in-house counsel Marc Randazza says EFF is 'lying' when it says holding a Wi-Fi subscriber liable for allowing his roommate's infringement will result in no more free Wi-Fi networks at airports, etc.

Good article BuddhaPi, I think that the limitation or removal of free an open Wi-Fi in airports, libraries, cafĂ©s etc. would be a bit extreme and imagine the outcry over it would be tremendous.   If you keep following their logic where would it end? Would you be able to buy a new router for your home without being able to prove you could set it up securely? Would companies that make routers be required to disable them being set up openly, I realize that I am really stretching it here but I am just trying to make a point the we need to use some common sense here or there will be no end to it, but then again common sense and trolls are oxymoron’s .
