Oscar emailed his draft of his testimonial letter to me late Friday. I didn't have a chance to read it over the weekend. I spent most of my time focused on the Memorandum of Law. Anyhow, I finally got a chance to read Oscar's draft of his testimonial letter for me. I can honestly say I was really stunned by what I read. Very high praise indeed and greatly appreciated from my lead partner-in-crime from the very beginning.  This is the guy who was crazy enough to take a chance and follow my lead when ELI was only 5-ugly text web pages and NO FORUM EXISTED back in 2008!

All I can say is that Oscar's testimonial letter speaks for itself. I will be getting a signed copy on Letterhead which will be sitting on the very top of my stack of testimonial letters.

Dear Judge Jordan:

   I am writing to you regarding Matthew Chan, who will be appearing before Your Honor on February 28, 2013, to answer the petition of Linda Ellis which request an Order of Protection. 

   The Memorandum of Law submitted by Mr. Chan fully explains his legal position, so I am writing not to act as his advocate but to provide a testimonial to the kind of person he is and to tell you a little bit about my personal experience with him. I have been a co-operator and the legal consultant and advisor on Mr. Chan’s website www.extortionletterinfo.com since we started the website in June 2008. The site provides valuable information for visitors and users of the site in a variety of areas – copyright law, internet law, best business practices for website operators, and more. While it was started initially to combat a rampant copyright infringement program begun by Getty Images, the site has grown to cover many other topics as these infringement programs have exploded as a big income provider to many companies, including Linda’s Lyrics, Ms. Ellis’ company.

   Through the nearly five years that I have worked with Mr. Chan, communicating with him if not every day, certainly no less than two or three times per week, I have had the opportunity to get to know him and to learn the kind of person he is. Our site, like many other Internet forums, can get a little rambunctious, but Mr. Chan has always made sure that the dialogue remains civil; open to all; and that the information we provide is accurate and informative. He has always operated the site with professionalism even if some of his own posts are strong-worded and argumentative. As a practicing New York litigator for over 25 years, who has handled many high-profile matters and clients over that time period, and as an adjunct professor of law at New York Law School, my professional reputation is of utmost importance to me and my practice. I simply would not associate myself in any way or put my name (and my firm’s name) on a highly visible project like this site with someone who would engage in criminal behavior; I would not be involved with Mr. Chan if I didn’t fully believe him to be an honest, dedicated and trustworthy person. He is all of those things and more.

   Your Honor should be aware that the site gets thousands of visitors per month and that every single day many people are engaged in dialogue and discussion over the topics covered by the site. Mr. Chan has created a space where a high level of discussion can be found on a daily basis, along with some humor certainly, but which also has become one of  the best resources in the entire country (and perhaps the world) on the issues of copyright infringement schemes. I know that Mr. Chan is providing a number of these testimonial letters for Your Honor to review, but the Court should also know that not a day goes by that either he or I get an email or a message on the forums thanking us for our efforts through the site.  I am talking about small business owners, Mom–and-Pops, not-for-profits, new start-up companies, hobbyists, and individuals who thought they were facing lawsuits and possible bankruptcy until they got onto  the site and got educated by reading the forums; looking at the many videos Mr. Chan and I have posted on the site; and reading the many documents Mr. Chan has made available through the site.

   When we began getting contacted by so many people about outrageous and exorbitant demand letters sent by Linda’s Lyrics and Ms. Ellis, we decided to add a forum on the topic. The sheer activity on that forum made us realize how many people were being frightened and intimidated by Ms. Ellis’ overbearing and overly aggressive copyright enforcement methods.  After Getty Images, it remains the next most discussed topic on the site. Mr. Chan’s only connection to Ms. Ellis was through the site. In my many discussions with him, he only talked about what could be done – always within the bounds of the law- to help others combat Ms. Ellis’ program. That is why I find these allegations against him so disturbing and misplaced.

   In conclusion, Mr. Chan is a person of high moral character; trustworthiness and honest. He is that way in his real estate business, he is that way in his operation of the site, and he is that way in his personal life. I thank the Court for taking the time to read this letter and I hope that Your Honor will keep my comments in mind when considering the petition of Linda Ellis and Mr. Chan’s defense.  Of course, if he Court would like me to provide any further information, I am ready and willing to do so.

Yes, Ms Ellis.....methinks your goose is cooked.

Any normal person would be wondering what they have done, Linda on the other hand is not exactly normal ( in my opinion) she really has this ego bigger than life and thinks she is untouchable....for someone her age, she certainly has a small world view...but thats okay, ELI is a great educational resource, and I suspect she'll be learning some hard lesson in the immediate future..
Most questions have already been addressed in the forums, get yourself educated before making decisions.

Any advice is strictly that, and anything I may state is based on my opinions, and observations.
