I have some general comments now that there has been some feedback by some of our best ELI thinkers.

I won't be commenting on too many specifics from now until after the hearing is over. I have to focus on preparing, organizing, and laying out my case presentation. Believe it or not, the challenge is to make it simple but effective given how much "stuff" I now have.

A battle is never over until it's over. My opinion matches the general consensus so far on these items.

1. Linda will show up and she will show up with one or two people from her "inner circle".
2. Linda will fight hard to plead her case.
3. The hearing could be shorter than I would prefer.
4. Regarding the outcome, the "right" thing would be for me to win. The facts are on my side regarding the stalking issue in that there has been ZERO contact on my end!  How can you stalk someone with NO DIRECT CONTACT?

Having said that, I am very cautious how the judge will rule. There is ALWAYS the element of surprise.

I am gratified everyone seems to think I will prevail. I hope I live up to everyone's high expectations. (No pressure on my performance here...)
I'm a non-lawyer but not legally ignorant either. Under the 1st Amendment, I have the right to post facts & opinions using rhetorical hyperbole, colloquialisms, metaphors, parody, snark, epithets, & profanity. Under Section 230 of CDA, I'm only responsible for posts I write, not what others write.

Basically linda ellis attributed my post "we're coming after you" to Thew. So does that mean my name will show up in the transcript at least once? Just saying.

Peeved, send me the vs. graphic.

7.  Do you think Linda can pull a surprise upset against me? If so, how and why?
She likely has a card up her sleeve, but it's a deuce. Likely it will be figures of how much income she has lost; And maybe how much sleep she has lost in fear of her life.

8.  How do you think Linda will conduct herself? Professionally or emotionally? Knowledgeable or play dumb?  Calm or angry?
If she has acting skills they will come out for the judge to see. Sweetness, Innocence, feeling extremely violated and financially drained.

Matthew should internally jump for joy she brings up any discussion of the effect of ELI posts on her income!

Lucia, Oh, let's hope she opens up that door. I'm not sure how she can speak without giving him a reason to tell the rest of the rest of the story.

April--
I really don't know how she can avoid making the judge perceive a business motive even before Matthew speaks. After all, she has to present something as being evidence of her claim.  Based on the initial complaint, she's quoting your post.  That post wasn't written by Matthew so it's not really going to support her claim against Matthew regardless. But still, she has to present something. If she presents that, it's very clear you are discussing closing down her business.  That should make give the judge a strong sense that this complaint is about protecting her business.

But the judge will know stalking laws aren't designed to protect the competitive edge of business models. They are to protect people from physical violence.

I wish the court case could be shown on YouTube.  It's likely to be more interesting than "Judge Judy".
