besides the wayback machine ( archive.org) there is also domain tools which also archive sites and is more difficult to get removed.. They could also have a copy of the code of your site from when the infringement occurred, but this is highly unlikely, because if they had the code and looked at the code, they would actually realize that many of the letters they send out, have zero merit, as many of them are hot linked images.. Usually they only have a screen capture, which would most likely not stand up in court. They have to prove their case, and yes screen captures are easily eidtted/  changed, and screen shots also don't tell us if the image actually resided on the servers in question.

well if you feel compelled to respond ( I wouldn't) you could state that your business does not own this domain name, but you'd be throwing your nephew under the bus, and they make chase him down.. Not having a contract or paying anything really doesn't matter one way or the the other. Is this a US case? I ask because you say "he's in university" which is more of a UK term..if you are in the UK or Canada everything changes as the laws there while similar are still different.

depends on the letter, usually removing the image is not enough, as they will still want your money. If the domain is registered in your company name, they will continue to hound you, how the image go ton your site doesn't matter, nor does it matter who put it there..it's all irrelevant in the grand scheme of things. You may elect to ignore the letter, just be advised that the statute of limitations is 3 yrs, so expect to get follow up letters, and threats of a lawsuit. A lawsuit is unlikely but it's not off the table.

They have you on the hook and they now know it..you freely admitted using the image, you freely admitted you grabbed it from google, you freely admitted that you do not really know much about copyright law.easist to just pay the hundred bucks and move on..

100.00 is actually a reasonable number compared to what we've seen in the past..this is really a no brainer..pay it and be done, at the end of the day you infringed.

istock is owned by getty, whom also owns picscout, what a bunch of incestuous fucktards they are.. If it were me, and I had a receipt I would tell them to pound sand..if they sue you, they will loose as you can show you purchased the image in good faith..hell I'd go so far as to file a counter-suit if they sued, turns the wheels on those douche bags.

If one looks at the Sanders law firm site, they will notice a nice long list of "attorneys" all without bios or headshots, so I'm doing my public service for the day and giving everyone a look at the many faces of Sanders Law P.L.L.C, which is headed up by copyright troll Craig B. Sanders. Oddly enough I still have not been able to locate an image of him....yeah he's that elusive..or cowardly you decide.

If I were in your shoes and the image was indeed hotlinked, I would not so politely tell Craig Sanders to go fuck off, unless he can prove that the image was hosted on your servers ( which he can't) I would follow that up with something along these lines: "For every subsequent letter that is sent your way, you will invoice Sanders Law for any time needed to respond. send it certified mail with reciept, so you can then invoice them,once you confirm they got the message.. I would also consider setting up a registered agent, if you allow others to upload anything to your site. Sanders law is quickly becoming the new douche-bag copyright troll, right up there with that dick-head Timothy McCormack from Seattle.

NOTE: "dickhead, doucebag, and other names are simply my opinion of them"

I initially followed the post on your site last year but haven't looked at it in some time since nobody else jumped in for a few months. It's sad to see that some have paid rather large sums to feel peace again. The post at the bottom caught my interest as well. What do you make of the guy who is attempting to have them disbarred?

I highly doubt anyone will be disbarred, after all what they are doing is within the law for the most part, but as we have seen here with Getty Images and the likes of Timothy b McCormack, filing complaints with the state Ag and Bar Associations, does become a time suck for them.

simply turn it around and put it back on the original owners shoulders..If you insist on contacting Sanders, tell them, if they continue to pursue you , you will file complaints with the state Attorney general, the bar associations they are afiiliated with AND you will invoice them for every second of time you need to waste on this.. That MIGHT make them go after the original owner..

yeah "nothing is free" applies here..anyone dumb and naive enough to use these images, best read AND understand the terms of use. as we have seen even "hobby blogs" not associated with a business can become a victim simply by serving affiliate ads, as the trolls see this as "commercial"..

PRO TIP of the day..steer clear of "free" images.

also don't get confused by "royalty free" and "rights managed" images..royalty free images often appear on multiple sites, and are much cheaper, thus they can "give them away"..they aren't worth anything to begin with..most of their rights managed images aren't worth anything either IMHO
