Sometimes I think that our “Friends” behave like terrorists: They attack everybody regardless of their situation to reach their goal. If somebody fights back they try to hide behind innocent people or they use innocent people not to get caught. If they get caught they complain all day that they are not treated fair.

As I understand Jot, the breach of security is that you are not allowed to look at the files (like you are not allowed to hack the FBI and look at their files and download them) you are only allowed to look at the product of the file which would be the website. But not all files are “active”. Pic. Scout only chance to view a picture is to download your files and compare the data, because Pic Scout can not see the product (website) Since Jot had a security installed they had to go through it to get the files like somebody who has to hack the FBI server to get some files.

Like: You watch a movie on a public server but you are not allowed to download it to your computer. Therefore they blocked it for downloading. But Pic Scout has to download it to watch it and they "hack" it to get it.

(I am not an expert too)  :(

In laymans words: Since picscout is a crawler and not a human beeing it can not see the pictures so they have to "intrude" to see the pictures by going into your files and taking a copy of your files.

Is my understanding correct ?

I think that they want you to give information about the time to get a case. Otherwise they are just guessing and will have problems if they go to court. If you want  to write something just ask for poof of ownership (contracts etc) .

If the police stops you in your brand new car  and ask for your paperwork and you tell them : "It is somewhere and I am not sure if I have signed contract with my car dealer"

I do not think that they will let you go any further either  ;D

OK.

Lets go a little bit further : If Getty, Corbis and Masterfile have a non-exclusive license (for the same picture) and all three send a demand letter because they represent the photographer ? Would this be possible ? Do we have a "triple dip"  ;D ?

It is my understanding:

If Getty has a non-exclusive license and the infringer settles with GI, the photographer (=copyright holder and the one who granted the non-exclusive license to GI) would still have the right to go after the infringer and sue him for the same infringement.

So it is my understanding that GI has no right to sue for the infringement (having a non-exclusive license)
