I notified Matthew of a WordPress plugin error on Saturday.   It prevented the home page from being accessed by anyone.   I could get to the forums through a bookmark and everything worked fine except the home page.   Matthew appeared to fix plug in problem and now the home page loads correctly.   I was able to login and everything works.  I do agree that the system appears slow today.

Suing for "actual damages" against a law firm?
Actual damages wouldn't amount to much money.

We've been beating Getty over the head with the fact that they've never sued sued over a single infringement.
I guess that Getty's strategy is to be able to say that they actually "sued over one image AND won".

I agree and how would they prove "actual damages".  I just see this as a way of being able to claim that they do sue over a single image, the will try to claim they picked a tough opponent -- because after all a law firm doesn't have to worry about legal costs (I don't know why they would seek outside counsel for something this small), and because they will eventually settle with the law firm for a tiny amount of money they won't piss off the brotherhood of lawyers too much.   This case, while Getty will certainly win, doesn't pass the sniff test.

That is a great blog post and clearly relies heavily on Matthew's material.  It is like a "How to deal with Getty 101" post.

I would guess that the part at the end where they try to deal with the emails under CAN-SPAM will simply end in it being referred from the collection agency back to the law firm.

I still think the best way to deal with the whole thing is Oscar's letter program.   Evidently he has a record of 800-0.

I am part of the Tinfoil Hat party after reading these lawsuits.   I think Getty is picking their victims very carefully.

I think that Getty found their Aronson at the veterinary clinic.  The clinic seems to be doing some weird things including having someone impersonate a lawyer (just my opinion).   That case looks like an easy win.   

In the single-image case, I don't think it is a coincidence that a law firm was picked (though I have absolutely zero evidence to make this claim) and they are asking for actual damages.   This way they don't get too hostile of a response from the other law firm.  I would expect a settlement fairly quickly and they can claim that they have sued single image infringers and move on with their usual scam.

The podcast network TWiT (This Week in Tech -  www.twit.tv) did a lot of coverage on this issue since Coulton is a friend of TWiT's.

One of TWiT's podcasts, This Week in Law - covered the issue and the discussion was a good one.   The show can be found at:  http://twit.tv/show/this-week-in-law/195.  The discussion begins at the 16 minute mark.

This guy did an extensive wave form analysis that leads one to think that Glee took the mp3 Karaoke version that Coulton released, made some minor changes and inserted their vocals:  http://geeklikemetoo.blogspot.com/2013/01/about-that-quack.html.  On a side note, if you do read this article, read the follow-on article that the author provides a link for.  This work spawned an even more detailed analysis of the version Glee used totally crowd sourced by the internet.   Some people went to amazing levels of detail in their analysis.  Why?  Because someone who gets the internet was potentially abused by Glee.

Coulton went Oatmeal on Glee and responded by putting his version for sale on iTunes "Baby Got Back (In The Style of Glee), where the Internet responded by buying tens of thousands of copies and the proceeds were donated to charity

Glee took a major internet hit and is clearly a show that has jumped the shark.   Meanwhile, JohnnyC's career is thriving and he no doubt increased his internet profile a couple of more notches which will turn into more money for him in the future.

Another example of someone who understands the internet.
