I was contacted by Getty at the start of 2013. I replied asking for proof they owned copyright, I think they replied, but can't remember for sure. But by that time, after reading posts on here, I was pretty confident they were playing the numbers game, if they contact enough people some will pay. Anyway I didn't do anything and haven't heard from them in over 3 years now.

I didn't reply to the e-mail mentioned previously and today (May 10th) I recieved a letter from a collection agency, Simons Muirhead & Burton. It says they are instructed by Getty in respect of a "possible" claim for copyright infringement. It says Getty has written previously and made me aware that I "may" be in breach of copyright by using pics they have exclusive rights to. It says there is a seperate form which details their offer for settlement, the amount is specific to the "apparent" infringement. Then goes on to say if I agree to their terms I should complete the form within 21 days confirming my acceptance.

Yes, thanks for that chaps. As I said the e-mail was a month ago, I've just seen it and it dosent mention the money which surprises me.

I've recieved a reply from Getty by e-mail, although I've never e-mailed them, I've only sent them letters. It was on my business e-mail address which I rarely use, it was sent a month ago but I've just seen it.

"Thank you for your letter.
Copyright exists upon the moment of creation. The mere existence of the imagery protects it under copyright law. Getty Images represents the photographer who owns the copyright in these images. Getty Images is bound by contract with its contributing photographers to obtain and share the royalties payable for the use of their images and to uphold and defend their copyright in their works. Rights Managed images, such as the ones at issue, are exclusive to Getty Images and available for license only through our website. Therefore, when copyright infringement occurs, Getty Images is entitled to legal redress.
 
Please find below the link to our watermarked copy of the imagery as evidence of our rights in the same.

Problem is even after the translation I still don't really understand it! Can anybody translate without the legal terminology? The way I understand it the company that represent Getty can't sue in Israel, is that it in a nutshell?

I found this on another site, its in response to somebody who recieved a letter:

"I hate to say this - but whoever said Getty images don;t go to court was talknig nonsense. They are the most litigious company I know, and as there is no issue you used their image (even a part of) with no payment or prior use agreement that remains theft. Their software is coded to prove ownership, and this waterark allows their search proceedures to show up imges that are used but not paid for and licenced. Should it go to court, you will lose, as their demand for payment will be higher than what the licence cost would have been, but that is allowable because of the manner in which their image was stolen. There is an argument (possible) that you may have used part of their image to create another (like audio 'sampling') this would create a fresh work of art with its own copyright, but in the absence of this, I'd ask for time to pay up - copyright infringement is treated harshly by the courts".

Any thoughts?

Just a reminder that my first letter arrived on Jan 24th although it was dated Jan 8th and said I had 14 days from that date to reply. I thought it only fair that I have 14 days from the date I actually recieved it to reply, so I replied yesterday 7th Feb.My reply simply asked for proof of copyright ownership. Todays letter dated 7th Feb says that they did not recieve a reply, however they are willing to offer one last chance to resolve the claim.Failure to make immediate payment will result in escalation to their legal department etc etc.

Yesterday my situation (I havent replied to my original letter yet but I probably will), was told to a friend of a friend who is a judge in Italy. He said it might be best to ignore the letter(s), wait until I get one from their legal department and then ask for proof of copyright. He also asked if all Getty's photos were of the same subject matter(food & drink in my case) and when told they were not, they were on a wide range of subjects, he said in that case it would be doubtful that they would own copyright.Just his opinion though, he dosent have all the facts.

Just noticed my letter is dated Jan 8th and says I have 14 days from that date to act, although I recieved the letter on 24th Jan, 16 days after the date!

Thanks for that, I'll sign the petition. My letter is from Getty images, 101 Bayham St, London NW1 OAG. Although they want a cheque sent to:  c/o Bank of America, PO Box 148, Sheffield. Nobody has signed the letter, just a space where you'd expect a signature to be.
