which started to get off-topic at the end.

I just wanted to mention that I did hear back from Dr. Fewer, and he was quite helpful to me and quite a nice guy.  I agreed to keep our correspondence confidential, and I feel that his reasons for wanting me to do so are well justified.  I will however be happy to give the details to anyone who personally messages or emails me about the Canadian specifics.  I just don't want to post it publicly, since he has asked me not to.  I am very sorry about being so tight-lipped, but I don't want to step on anyone's toes, as I'm sure you all know why.

But in a nutshell, he didn't tell me much of anything that cannot already be found in these forums.  The virtue of what he told me is just that he gave it to me all in one place and well-summarized.  Basically, he reinforced the soundness of the advice given here in these forums (as if we didn't know), and we're doing the right thing.

Hi Matthew.  Thank you.  Crystal clear.  And yes, I have found this forum infinitely more helpful than Howard's post (because, as you say, it is not really helpful at all).

This forum has given me the confidence to deal with this like a self-respecting human that will not tolerate others taking advantage of them, no matter how "powerful" they may seem.  I can't thank you enough.

I think you're right SG.  It's been almost two days and I haven't received a response from Fewer.  I'm guessing it's as you said, that he doesn't give advice, which is precisely what I asked him for.

As a man of science myself, I'm a strong supporter of all ethical research.  I would be inclined to use my experience to help Fewer if it would be of any use to him (i.e. if he is indeed "researching" the subject).  Or do you suggest I just avoid him?  The reason I ask is that Matthew Chan doesn't seem to have a positive view on the site that supports the idea of contacting Fewer, yet it seems he would be interested in the outcome of any such interactions.

Thank you all so much for your advice.  I'll be sending my initial response tomorrow.  It got shorter and shorter the more I revised it.  It actually doesn't say a whole lot.  Just a few sentences.  I will be sure to keep you posted on any interesting developments.

Is it wrong or a bad idea to post correspondence between me and GI verbatim on this site?

Based on what you said to do, I would guess that GI does have exclusive rights.  At least they're the only ones selling it.

Thank you again for replying.  The amount they are asking is $850.  What I find crazy is that GI is charging $366 for three months of usage.  Who in their right mind would pay over $100/month just to have a second-rate image on their site?  I did find that other stock image sites sell images for, like you say, more like $50 per year.

I did try to find the image on other sites, but I can't find it anymore.  Not even the site I originally got it from.  Is there a way to more effectively find the image on other sites?  What changes if I do find it elsewhere?

Well, I guess that if my friend simply ignores all correspondence, they would have no choice but to deal with me.  I don't know much about law, but I'm guessing that they can't really touch him if the domain is registered to me.

I'm very reluctant to actually send my letter to GI.  I just read over Matthew Chan's documentation of his case, and I noticed that he never once agrees to or offers any amount of money.  My plan was to try to settle on something a little more reasonable, say, something close to the actual cost of the license.  Am I making a mistake?

Also, should I use registered mail, or is email good enough.

I never heard back from Dr. Fewer yet anyway.

Getting ready to send my first response to GI.  Wish me luck...for what it's worth.

"David Fewer, Counsel at the wonderful CIPPIC clinic"  at the university of Ottawa.  CIPPIC is the Canadian Internet Policy and Public Interests Clinic.  I assumed him to be an ethically sound type of person, being that he is affiliated with a Canadian University.  This may sound naive, but in my experience at university, most professor are very ethical people, at least as it pertains to the integrity of their research.

Hi.  I'm in a similar situation.  The letter is addressed to my friend for whom I built the site, but the domain is registered in MY name.  I would like to take responsibility for this matter, so that my friend never has to hear from Getty again.  So I'm going ask the same question, should I ask Getty to address further correspondence to me? Will they listen, considering I do, in fact, own the domain?

That's unfortunate for me. I guess I'll have to go it alone then.

My original plan, before discovering this site, was to essentially duplicate their settlement demand letter, but change my name to theirs, and vice versa, and also change the "screenshot" to a screenshot of the GI website superimposed with an image of my hairy butt crack alongside my middle finger.  Then I was going to demand a wad of cash for the unauthorized use of my image on their website.

But now I'm thinking about modelling my approach after the advice given in this thread

Hi.  I got my letter today.  I've been reading the threads for hours, but there's just too much to read it all. I'm thinking that my best course of action is to enroll in Oscar's Letter Program.  I really don't feel like dealing with three years of harassment.  I was just wondering if Oscar can handle Canadian cases.

Any additional advice/emotional venting is most welcome too. I'm definitely buying Matthew and Oscar a few beers for this one.  Thanks a bunch guys.
