UK Getty Images Letter Forum / Re: atradius now involved
« on: November 02, 2015, 02:30:29 PM »
I got the impression that Getty sell on the 'debt' to Attradius as when they phoned me up, the lady had no idea of any previous correspondance that had taken place.
My situation was different to yours in that I had a correspondance trail with Getty in that I had always replied promptly, including making a fair offer, all of which got ignored. So I told her that I was happy with my position and not be making any payment unless requested info etc was produced. That was 4 years agoand I haven't heard anything since.

I know that and you know that, but you can't sell a 'claim' on :D

I have a sneaking suspicion that Getty have sold the 'debt' onto Atradius as when I got my phonecall, they hadn't a clue what was written in previous correspondence with Getty and was interested either.

Keep everything in written format for starters. Write to them, explaining your position and state that no verbal communication will be entered into.

Ignore the 5 days anyway as taken from the dat eat the top of the letter, that was probably last week and wouldn't be deemed as a reasonable allowance of time to settle. What have you done thus far?

I'm in a similar position, although my case has been rumbling on for 2 1/2 years. I too, couldn't find the image in question, even when I typed in the image title quoted in correspondance from them in their search engine.

I have prints outs of the screen prints of the searches as it demonstrates that 'reasonable' steps have been taken to ensure the situation arising in the 1st place. Getty must surely have an obligation to ensure there is a accessible means of buying the licence before pursueing someone for unlawful breach of copyright.

Fot what it's worth, I have always responded promptly as it shows cooperation and willing to reach a settlement. They, on the other hand generally take between 3 & 18 months to reply and never repsond to any points raised or supply any information requested. If it did ever go 'legal', I know who would be seen in the better light by the Judge.

I would also ask for a breakdown as to how they arrived at such a figure - that will keep them occupied for a while :)

Is this from Atradius or Getty direct?

@MillyMollyMandy

Excellent work!
I'm surprised they said the 'debt' could not be disputed. They usually deny that its a debt and instead say it's a claim.
