I found this and thought it was an interesting article. Another case, even though this person was wrongly accused, of someone who is not afraid to fight back and filed a class-action lawsuit.

In this article from the website FightCopyrightTrolls.Com Judge Wright actually calls copyright troll Leemore Kushner and her P2P Malibu Media lawsuits an extortion scheme. ;D ;D ;D  Hopefully the more the courts call out these trolls on what they are doing the fewer cases will actually be brought and extortion letter victims will be able to tells these trolls to pound sand and drop dead without fear of legal action.

I realize that the percentage of actual cases are very few but people like Judge Wright calling the trolls out on what they are doing will reduse the number even more.

Well it appears that all of the pressure, Internet coverage, bad publicity, his wife's mental meltdown rant and the fact that the EFF joined in the fight proved to be too much for Carreon. It was announced yesterday in this article on the EFF website that Carreon has dropped his lawsuit against the oatmeal creator Matthew Inman. Here is the link to the article

Good news in one of the Prenda the cases, the judge has reconsidered his decision and granted a motion for a protective order preventing Prenda from obtaining personal information of does in the case.

I found this link to an article about a Senate hearing that took place yesterday, June 28 in which it was argued that user privacy needs to be disregarded to safeguard our" cyber security". The call for the disregard of our online privacy is being headed up by an advertising company saying that it needs to track our online browsing claiming that there is a ”purported connection between online behavioral tracking for advertising industry purposes and online sexual predators or ID theft." They also asked that the Senate hearing to allow ISPs to collect data on Internet users not accused of any crime and to let company share sensitive data with the government without a warrant. Fortunately, Sen. Rockefeller was not convinced that this needed to be done, the EFF is watching this and we should be keeping an eye on it as well.

It looks like we have a new trolling tactic; at least it is the first time I have seen it.  CLG Group troll Mike Meier (good name for a troll) sent a package in the mail to a potential Doe.  The package arrived addressed to the Does real name with a cover sheet saying we are getting ready to file the attached suit but if you want to settle before it goes to court pass it to your attorney or contact us and we’ll discuss it with you.  Along with the cover sheet there is an infringement suit with the Does name on it but no district court listed or case number. Another issue is how Meier got the Does name as it is assumed this is an IP address case and the Doe has received no notification from his ISP of any request for his information.

I have decided to reveal my identity here in the forums and online community.  I am doing this not because I am special in any way, I am not.  I feel that the more we can put a face to our stories and situations the more we can show Getty that we are not afraid to fight their extortionist practices.  I am not out of my three year statute of limitations waiting period before I can breathe easy, in fact it has only been a few months since I received my letter but I am here to say that I am not afraid of Getty and I will be fighting them with every means at my disposal and am prepared to do whatever it takes.  I also had a conversation with Mathew today and let him know that it is my intention to continue to support ELI financially, as it would be a terrible loss if it were no longer here, as well as with my time here in the forums helping out any way I am able until ELI is no longer necessary.

I am not advising anyone to do what I am doing, there are risks involved but I feel as with any bully you stand up look them in the eye, pop them in the nose and they will go look for easier prey. 

So in the immortal words of Inigo Montoya I say to Getty:

I don’t think that this has much of a chance as it will be very had to prove that he knew what his roommate was doing.  Is it me or do the trolls seem to be getting more desperate and really starting to grab at straws lately?  You would think after all the recent smack downs from the judicial system the trolls would be a little more leery about filing this kind of suit.  I will keep an eye on this and see what happens.

Legal Controversies Forum / Wi-Fi use effecting Copyright Trolls

Here’s an interesting article I found talking about how the growing use of Wi-Fi will make it tougher for the trolls.  I believe I remember reading something like this over in the P2P/Bit Torrent forums where a judge throughout or dismissed  some of the claims as the defendants said they were on open and unsecured Wi-Fi networks and anyone could have accessed there IP address.  I am getting ready to head out to work so I don’t have time to find the link to the thread on the P2P forum but will look for it tonight when I get home.

Matt, I wasn’t quite sure where to place this thread, if you think it would be better in another forum feel free to move it.

I just found this on line.  It appears Getty may go up for sale or go public.

A quote from the article:

“Getty Images could soon be put up for sale or head out for an IPO, with a $4 billion valuation just four years after being sold for $2.4 billion, The Financial Times reports.”

I wonder how much of this increase is due to their demand letter campaign?  Also if they were to go public I wonder how the stock holders would react to their business practices of extorting money out of individuals and small businesses.  I’ll keep an eye on this and post any updates I come across.

I wish we could get this out on one of the major investigative network news shows like 20/20 or 60 minutes or something like that.

How about a new show based on the old "To catch a predator" and call it "To catch a copyright troll".

Unfortunately until yesterday I had never heard of the Getty Extortion Letters.  I can only say that this site and forum are a blessing to all of us who have received these letters, likewise with the wealth of information I am finding here in the forums says that far too many of us have been targeted. 

I have spent the last day and a half reading, researching and documenting.  I wanted to briefly share my story and what I have done to see if anyone sees anything I may have missed or knows of another forum topic I should read that has more information I need.

I am a sole proprietor business offering remodeling and handyman services, I have a website which I run and maintain.  All images on my site are mine and of work I have done with the exception of a few photos in a “How-To” blog I have on the site offering free tips to homeowners to maintain their homes.  I would try to find a public domain image to place in the blog.  At this point I want to say that I am a firm believer in copyright law and make a genuine effort to ensure any image used that is not mine is free or public domain.  Whenever I used an image that was not mine I did make a note as to where I got it, not thinking to protect myself but in case something happened to my website and I had to rebuild a page.  I found this image though a Google search which I follow back to the site to look for any copyright notices.  By all appearances it looked as if this image belonged to the person running this site as it had the site owners name a hyphen and the tile they had given the picture.  The site had many image galleries and the picture in question was found was in a gallery called “Public Gallery” I also gave credit to this person for the picture if you rolled over it on my site.    Since it is in a blog it is dated so there is no question as to how long the image has been up which is just less than 11 months, Getty is asking for 875.00 for this.  The image in question is from Getty Images infamous Stone collection with 96,448 images at the time of this posting. 

What I have done:
1 I immediately removed the image from my website, computer and backup drives
2 Started my research, documentation and response plan.
3 Donate to this site for all the information I have found….. Thank you very much Mr. Chan, Mr. Michelen and all those who have contributed.
What I plan to do:
1 Call Getty tomorrow and talk to them explaining my situation, that the image was used unintentionally and that it has been removed (which I expect will go nowhere)
2 Send a certified letter to Getty with all of my information about the image in question
3 If they respond saying I still owe the money and wish to pursue the claim I will request information of how they arrive at the figure for the image, proof of damages incurred, sales history of the image and at what price sales were made at, ask for proof of the images registration to them exclusively as well as if the image is registered individually or in bulk.
4 if I receive a third response, depending on the tone and what is says consider using the defense letter program.
