One of the most damning accusations against copyright-trolling operation Prenda Law is that the attorneys who manage it engaged in identity theft. Corporate papers on Prenda shell companies were signed by Alan Cooper, the former housekeeper of John Steele. Cooper has said someone else signed his name; Prenda-linked lawyers have said Cooper is basically crazy.

"You're not going to get damages out of me," she told Godfread. "I don't give damages when everyone is a fraud."

A federal district court has awarded $1.3 million to a Texas design firm in an architectural copyright case, according to Houston law firm Osha Liang.

In the lawsuit, Hewlett Custom Home Designs of Houston claimed that Frontier Custom Builders, Inc. infringed Hewlett's copyrighted designs in violation of federal law. Hewlett's clients include Fortune 500 executives as well as celebrities such as retired NBA star Charles Barkley, now an analyst with TNT's Inside the NBA.

A jury in U.S. District Judge Ewing Werlein Jr.'s courtroom on May 9 found that Frontier committed copyright infringement by constructing and marketing 19 houses that infringed Hewlett's copyrighted designs. Frontier's owner, Ronald Wayne Bopp, was also held personally liable for Frontier's activities.

The New York Times’ legal response to a startup whose software allows publishers to replicate the look of the NYT’s Snow Fall feature goes so far above and beyond a simple cease-and-desist it becomes ridiculous.

The four lawyers linked to the Prenda Law copyright-trolling organization were slapped with an $81,000 sanctions order, which as of today, they have missed the deadline to pay. They did make time to file a last-minute motion to delay the sanctions, which only got referred back to the judge who's angry at them in the first place: US District Judge Otis Wright.

Today Wright issued an order, predictably, denying the request by the Prenda crew for more time. The order https://cdn.arstechnica.net/wp-content/uploads/2013/05/Prenda.order_.164.pdf asks them to explain "why they have contravened the Court's order to pay the attorney's-fee award," which, to be precise, is $81,319.72. It also orders them to pay $1,000 "per day, per person or entity, until this attorney's-fee award is paid or a bond for the same amount is posted... Failure to comply will result in additional sanctions."

The U.S. Court of Appeals for the Ninth Circuit sealed the fate of copyright enforcer Righthaven LLC today by ruling that the minima; "right to sue" copyright assignments that Righthaven acquired from newspaper publishers did not confer standing to sue third parties for copyright infringement.

Good article pertaining to the asshats at Prenda Law, which directly relates to the court decision concerning Matthew Chan.

Yesterday, we filed a motion to quash a subpoena seeking the identity of the blogger behind Die Troll Die, a website dedicated to “News and Views Involving Copyright Trolls & John/Jane Does.”

For years, Die Troll Die has been covering news about Prenda Law and its predecessor Steele Hansmeier PLLC, amoung many others. Prenda Law is a porn troll.  This means that it looks for IP addresses that allegedly downloaded adult films via BitTorrent, seeks to subpoena the ISP for the contact information of the account holder associated with that IP address, and then threatens to name the alleged infringer in a copyright lawsuit, right next to the embarrassing title of a pornographic film. Or just settle, for thousands of dollars.

On April 5, 2013, RE/MAX, LLC (“RE/MAX”) filed a trademark lawsuit in the Northern District of Georgia against Cumming, Georgia-based McFarland Realty Enterprises, Inc. and two of its principals (collectively, “McFarland”).  The complaint lists federal counts of trademark infringement and unfair competition, and state law counts of dilution, violation of the Georgia Uniform Deceptive Trade Practices Act, common law trademark infringement and unfair competition, and violation of the Georgia Fair Business Practices Act, O.C.G.A. § 10-1-390 et seq.

Photographer Remi Thornton recently terminated his contract with Getty after finding out that the agency was allowing online retailer CafePress to use his images on potential merchandise without paying an up-front licensing fee.

In fact, according to Thornton, CafePress has an exclusive agreement with Getty, which allows them use any of the agency’s Royalty Free stock to populate their store, while only paying the photographer if the merchandise featuring their image actually sells.

Charles Carreon Claims A First Amendment Right To Make Vexatious Legal Threats Without Consequence
from the that's-an-interesting-one dept

If you haven't had your dose of nutty legal claims of late, Adam Steinbaugh alerts us to the latest in the long and ongoing saga of our buddy Charles Carreon. When we last checked in on Carreon, he had more or less admitted that his legal threats against a satirical blogger making fun of him were baseless, and had voluntarily agreed to "settle" the case. In that effort, Carreon ignored the issue of legal fees, so the lawyers for the blogger -- Paul Levy and Cathy Gellis (disclosure: I know both of them and consider them friends, and Levy has acted as our legal representative on multiple occasions, so take any analysis with however many grains of salt you'd like) -- sought legal fees. Carreon went on a bizarre rant against Levy in his filing for an extension, trying to build up some conspiracy theory involving Levy somehow trolling the internet for people like himself to go after.
