Las Vegas copyright infringement lawsuit filer Righthaven LLC’s financial problems grew Tuesday when the federal court in Las Vegas commanded the U.S. Marshals Service to seize more than $63,000 in Righthaven assets to satisfy a creditor’s judgment and costs.

The first scheduled trial in a Righthaven LLC copyright infringement lawsuit was called off Tuesday so a judge could consider whether Righthaven had standing to file the suit.

Righthaven, which already has a history of late filings with the court, using questionable excuses, seems to be working extra hard to make any story about the company appear to be a farce. The latest is that Righthaven's lawyer, Shawn Mangano, just discovered on Monday (October 31st) that the deadline for filing the opening briefs in the Hoehn case, one of its many appeals of cases it has lost, was October 27th. He claims that the court misled him on the phone concerning the timing, though that seems questionable:
Righthaven’s counsel originally requested a telephonic 14-day extension of time to file its opening brief in this matter on October 27, but was advised that its opening brief was not due under November 28, 2011. Upon further inquiry, it appears that the opening brief deadline provided was for an associated appeal in this action concerning an award of attorneys’ fees and costs (Case No. 11-16995). Righthaven discovered this apparent misunderstanding today, October 31, 2011, which is one business day following the October 28, 2011 filing deadline for its opening brief.

The Righthaven situation keeps getting more amusing. Apparently one of the cases is actually scheduled to go to trial next week... but Righthaven doesn't want it to go forward because it can't afford to actually go to trial. However, the company seems perturbed that the defendant has filed a motion to dismiss on the same standing issue that's resulted in multiple dismissals in nearly every Righthaven case since it was discovered that the copyright transfer from newspapers to Righthaven was a sham transfer. So, Righthaven has now asked the court (involving a judge who has already ruled against Righthaven) to speed things up and avoid the trial by ordering Righthaven to show cause over the standing issue. Yes, Righthaven appears to be asking the court to speed up the process of dismissing the case, without it dismissing the case directly itself. The defendant, Kevin Kelleher and his lawyers, note the irony here:

Righthaven appears to be inviting the court to commit what Righthaven would contend is legal error by dismissing this action,’’

The financial woes of Las Vegas-based copyright trolling firm Righthaven worsened Saturday when one of the defendants it unsuccessfully sued for infringement asked a judge to allow seizure of the firm’s assets — with the help of the U.S. Marshals, if necessary.

Here's some reading regarding legal ramifications of ignoring robots.txt... basically what I'm getting at is stopping picscount from "trespassing"...and abiding by rules set forth by webmasters. my heads all a jumble at this point..

Keep in mind some/most of this is fairly old, but I wondering if any progress has been made from a legal standpoint..

A federal judge suggested Friday he’ll dismiss another Righthaven LLC copyright infringement lawsuit because of the company’s lack of standing to sue over Las Vegas Review-Journal material.

Robert C. Jones, chief United States judge for Nevada, didn’t appear to be persuaded by a Righthaven attorney’s arguments during a hearing that its lawsuit against website operator NewsBlaze LLC should be allowed to proceed. NewsBlaze.com, based in Folsom, Calif., is a news aggregation site.

Ah, the hits just keep on coming for Righthaven. Having already had judges in Nevada and Colorado dismiss Righthaven cases for lack of standing, the one remaining state where Righthaven had tried its questionable legal tactics was South Carolina, which had prompted a somewhat epic countersuit. Not surprisingly, it's looking like it's a trifecta of losses for Righthaven, as magistrate judge Jacquelyn Austin has made it clear that she's not buying whatever it is that Righthaven is selling. She's given the company until October 28th to explain why the case shouldn't be dismissed for lack of standing.

An appeals court Wednesday refused to block a creditor’s collection actions against Righthaven LLC, the Las Vegas newspaper copyright infringement lawsuit filer.

In the latest in a series of legal setbacks for Righthaven, the 9th U.S. Circuit Court of Appeals rejected Righthaven’s “urgent motion” of Sept. 27 that the court stop attorneys for prevailing lawsuit defendant Wayne Hoehn from executing their judgment against Righthaven for $34,045 in legal fees.

Despite its backing by billionaire Arkansas investment banker Warren Stephens, copyright lawsuit filer Righthaven LLC of Las Vegas said Sunday it has been unable to secure a $34,045 bond to guarantee payment of a defendant’s attorney’s fees.....

"To date, Righthaven has been unable to secure a bond. The terms required by the bonding companies that Righthaven’s counsel has investigated and/or contacted are an impediment to meeting the district court’s stay requirement," said Righthaven’s filing by Las Vegas attorney Shawn Mangano. "The bonding companies are requiring what amounts to a full cash bond. In sum, the bonding companies ask for full cash payment, certain forms of collateral held by the company or irrevocable letters of credit be posted to obtain a bond in the amount requested.

Imagine that the bonding outfits, want the full amount, a little salt in the wound i would say!
