Does I-Stock photo also send out letters? I know they are owned by Getty, I also realize that alot of the images on i-stock are available at Getty as well.. Just curious, as I'm way beyond using any stock image companies at this point.

Righthaven Lawsuits Forum / Righthaven catches a break in court

Copyright lawsuit filer Righthaven LLC of Las Vegas finally received a break on Wednesday when a judge rejected requests that it be found in contempt of court, be placed in receivership and that U.S. Marshals seize its assets.

All these requests were made by attorneys for Righthaven defendant Wayne Hoehn after Righthaven failed to pay his $34,045 in legal fees by a Sept. 14 deadline.

The fees were ordered to be paid after Hoehn prevailed against Righthaven in one of its copyright infringement lawsuits.

Righthaven is appealing the rulings dismissing its lawsuit and awarding the fees to Hoehn.

U.S. District Judge Philip Pro on Wednesday wrote in an order that "plaintiff does not enjoy a reasonable probability of success on the merits of its appeal."

Righthaven LLC of Las Vegas lacked standing to file copyright infringement lawsuits in Colorado under its lawsuit contract with the Denver Post and abused the Copyright Act in doing so, a federal judge ruled Tuesday.

Defense attorneys on Friday stepped up the pressure on Las Vegas copyright lawsuit filer Righthaven LLC, asking a judge to appoint a receiver to run the company after it failed to pay their legal fees by the deadline.

Sent out my first DCMA notice today and will follow-up with a cease and desist if need be. Someone downloaded and copied a site I developed, and have it being hosted under another domain. It clearly states in my contract the I retain the copyright unless it is in writing transferring the copyright to my code and my images....at least they were nice enough to leave my copyright notice on the bottom of the page, which is clearly visable in the screen capture...

The difference between me and them is I'm not looking for any money, just removal of my hijacked work, and I have solid evidence that it belongs to me in a signed contract..

There has been a question of whether GI & MF, among other ever have the same images in their library.. I stumbled upon this today...exact same images in both catalogs.. are royalty free images different?? I would guess not, If I purchased said image from getty, whats to stop MF from coming after me with a threatening letter??

i'd post screen shots, but don't want my hand slapped today, if your curios visit both sites and search chakra.

When I was approached by GI I promptly removed the images in question, and also quickly supplied GI with the license, which I have had for 12 years or so.. the response from them in regards to the license was something to the effect of " well anybody could have created this"...yeah ok, whatever.. so I just saw this on someones blog and wish I had seen this earlier..

::EDIT:: Who's to say GI aren't mocking up screenshots??? Look they are using my image on their site!!  >:(

this has been going thru my head since I read the original post, what are your opinions could this actually be plausable and legal? I know most of us aren't lawyers, and I may just run this by one..

Send Getty a letter stating that you DO want their bot to crawl your site as long as it conforms to certain conditions such as not indexing image directories or crawling directories that are listed as exclude in the robots.txt file of the site. However, you wish to be paid $100.00 per non-compliant visit and you will be logging the activity. This is a legal “offer” to allow them to spider your site. Their spider, upon entering your site after the offer notice may constitute acceptance of the offer. Bill them and sue them for non-payment. Let’s get EVERYONE to send this letter so that they need to manually deal with this situation and hire tens of millions of dollars in labor to comply. Do not accept any web forms to opt-out, but make them do this all by hand and bill them until they comply, but sue them anyway for not complying.


and while we're here, what are your thoughts on this. If I have specific instructions in nmy robots.txt file to block certain spiders/bots/scrapers, and picscout ignores this, doesn't this equate to essentially hacking?? as well theft of my bandwidth??.. I've already so far as to block the whole range of IP's associated with  Israel, this isn't enough for me, I'd really like to come up with a way to turn the tables, and get them where it hurts..
