Again to much time on my hands, I should be registering my works so I can make some fast cash!! ;D just kidding...

So I have a site and saw this really cool image of the Nebraska skyline, I truly love this image but am to cheap to purchase it, so instead I just link directly to the image from the photographers blog, cause the one he has there doesn't have the ugly watermark... So now the image "appears" on my site, but is not on my servers, I'm guessing I could still be on the hook??

I think i saw a similair thread somewhere, where someone had an ad banner being dynamically served to his site and the banner had a portion of one of getty's images on it..They didn't seem to care that the actual file was hosted elsewhere, and proceeded to go after him anyway..

You'd think if picscout was scanning the server for images in question, it would not "see" this image as it's only a link, and doesn't it have to read the code...last i knew bots/crawlers didn't have eyes in which to actually view an image online..

okay back to your regular scheduled programming unless you feel the need to discuss this which would be nice

So the last couple of days I've been looking to see who's online...Most times they are "guest" and the majority of these guests are not looking at threads, but looking at profiles...I wish a little bird could give me some IP's for these "guests".. I think I have a feeling of hwere they are coming from...just sayn : )

I just came across this lilttle tidbit, which naturally, jump starts my brain with questions...

I see people state " The image did not have copyright or the symbol on it anywhere", now I know that this is not required, what I just learned ( unless I'm getting bad info) is that before 1989 it was required..So my questions are...

1. What is the likelyhood that GI has any images in their library from before 1989?

I'd venture to guess there are some..if not many GI has been around for quite a while

2. What is the likelyhood that GI took the proper steps to keep these images out of the public domain when the law changed??

Knowing that "supposedly" Getty does not register most of their images, I would think, they probably didn't take these steps either..

3. Could some of these images in their Letters actually be in the public domain??

What I just read from Public Domain Sherpa ~ http://www.publicdomainsherpa.com/index.html
...."Although copyright notices are no longer required in the United States (as I mentioned above), they used to be. If the photograph was published before 1989, it needed a copyright notice. If it was published without one, it went into the public domain unless the copyright owner fixed the problem within a certain time.""

Although I don't believe it's image related, it fairly recent and the judge is not happy, perhaps this can help us eventually as more judges become aware of these tactics and discover that it truly is a business model..

Getty Images Letter Forum / PicScout is possibly flawed

A client brought to my attention that she recieved the GI letter, after her sending me copies to review the info I noticed the following.

1. the letter is claiming 4 infringements (875.00 for each image)
2. as usuaul they show images of the images from thier library with corresponding catalog numbers
3. they also provide the side by side screenshots of the images being used..

however..the image they are claiming is a single image from a single page, yet they claim their are 4 images!
yes all 4 images in GI catalog are similar, but the screenshots they provide are clearly all from the same page within the site containing only 1 image.

So is Getty stating that someone may have used 4 of thier images and merged them together to make 1 image, or could this possibly be a flaw within picscout?
My thinking is the latter which could prove to be something significant in terms of GI proving to a court that these are their images..

Just some food for thought, for all involved, be sure to review your letters very carefully!

In the meantime my client will be contacting Oscars office to draft a letter.

Greetings,
I'm not looking for advise, as unfortunately I'm already well versed with the GI situation. However I just wanted to share about a client of mine who finds herself in a pickle...

A suit was filed against my client for the unlawful use of a good majority of content on her site. Apparently she went and grabbed a bunch of articles and proceeded to use them. These articles presumably came from a source that sells said articles. Anyway they are suing her for 6k, and she fired off an email to them explaining "she was using the text as a placeholder" thus admitting guilt right out of the gate..So heres the real kicker..

When I developed her site we had a very long and detailed discussion on the proper use of images, she was made aware of ramifications if she so chose to use any images without a license agreement. She has well over 100 images on her site all of which came from google searches.. With this many images some if not all are sure to be GI, corbis or MF images. I have just had another long discussion with her stating that she should take the site offline immediately, or she may have a HUGE problem on her hands, she has flat out refused to do so, stating "I'll take my chances."

I have since fired of an email to her for her to sign and return absolving my company from any responsability. ( a bit overkill and not needed, but at least my side of the street is clean)...

Just goes to show that sometimes some people just can't see the forest thru the trees..so now I wait for the pickle to become a barrel of pickles..

Can the recent development with Righthaven ( being tossed ) have any effect on What Getty is pulling??
Does Getty own the "exclusive Rights" of these images, I was under the impression they only manage most images on behalf of the photog/artist, whom I would think still owns the exclusive rights??..something else that just popped into my head..

say for example I contact a photog and request permission to use an image, he grants me permission I have an email staing such, whilst at the same time this image is also in getty's library.. so I use the images and along comes Getty with their "claim to fame"..yes I have no invoice, but I do have the email.. I'd be willing to bet getty would not stand down and would probably reply with something along the lines of "this is not good enough"..l That was my situation I had the license for an image but no invoice going back 12 years or so.. the answer in regards to the licence.." anybody could create that"..

As the owner of a small web design / development company that has been innocently caught up in this mess, I would like to post some helpful information to anyone interested. I currently host and maintain over 200 sites and am fearful that some of the images purchased thru a template/image pack may be used on some of my clientrs sites. ( tho I have only found 2 possibilities thus far)
Taking the following steps is by no means a cure all, but are instead geared to several issues.


1. Not only remove the images from your pages immediately , but also be sure to delete the images from the server altogether!
2. Stopping Getty’s & Picscouts crawler from accessing your pages, and downloading all images.
 ( which I consider theft and hacking  in and of itself not to mention using my bandwidth and server resources without permission).
3. removing any cached images and pages elsewhere on the web, as Getty can simply refer to these cached pages even after the image in question has been removed from your servers.

Add this code to your meta tags before the head section to prevent any spiders/crawlers from archiving your pages:
 
I would recommend re-submitting your site after adding this tag, so google and other engines/index pick-up the new tag.

Block these IP's and IP ranges as they are associated with Getty and Picscout: ( this can be easily done if you are running cpanel from your osting provider)  or you can accomplish this by utilizing .htaccess code. The link below will help you generate this code.

Remove your site from The Internet Archive ( wayback machine)
To remove your site from the Wayback Machine, place a robots.txt file at the top level of your site (e.g. www.yourdomain.com/robots.txt) and then submit your site.

 The robots.txt file will do two things:
It will remove all documents from your domain from the Wayback Machine.
It will tell us not to crawl your site in the future.
To exclude the Internet Archive’s crawler (and remove documents from the Wayback Machine) while allowing all other robots to crawl your site, your robots.txt file should say:
User-agent: ia_archiver
Disallow: /
Robots.txt is the most widely used method for controlling the behavior of automated robots on your site (all major robots, including those of Google, Alta Vista, etc. respect these exclusions). It can be used to block access to the whole domain, or any file or directory within. There are a large number of resources for webmasters and site owners describing this method and how to use it. Once you have put a robots.txt file up, submit your site (www.yourdomain.com) on the form on http://pages.alexa.com/help/webmasters/index.html#crawl_site.

As of this post there is currently no way to ban picscouts crawler using the robots.txt method, it appears to be ignoring this file altogether, hence the blocking of the IP's above.

Greetings,

I got the letter today and need some directions, I had purchased a template pack in 2004, which also include a "license" to use the templates, images ect...naturally I have no "sales order" as it was purchased online and downloaded, the company where I purchased the templates have apparently vanished, leaving me with the mess.. So my question is twofold..
1. how do i go about retaining your services?
2. more of a problem with the 2 images I had on my site, is that I own/operate  a web design company and may have used more of these images included with the templates for client sites..I can see this turning very ugly and possibly putting me out of business..any suggestions would be greatly appreciated..
