Prenda Law Firm attempts to silence critics DieTrollDie and FightCopyrightTrolls
San Francisco - The Electronic Frontier Foundation (EFF) is joining with attorney Charles Lee Mudd Jr. to represent two blogs caught up in a bizarre lawsuit filed by Paul Duffy and Prenda Law LLC, Duffy's copyright troll law firm.

Copyright trolls try to make money by suing Internet users under various copyright laws. Their tactics include targeting large groups of anonymous "John Doe" defendants for downloading files on BitTorrent, seeking their identities, and exploiting the massive damages in copyright law in order to pressure defendants into settling quickly.

We'll have a more complete report soon from Ken "Popehat" White, who was in the courtroom for the Prenda hearing today and will be writing about it for us (and for his own site), but for the quick version of what happened, with a huge assist from both Adam Steinbaugh and White, is that the judge has not made a ruling yet, but he is not at all pleased, saying "the client has been running everything. I know who the client is." There was no direct admission of who owns AF Holdings (other than that it had been transferred to another holding company, LiveWire -- as Pietz pointed out in his chart), but nothing else directly came out in court, apparently, other than Judge Wright's claim that he knows what's going on. In fact, he noted that the shell companies are "not even shells." This does not bode well for Prenda.

While making my rounds, visiting some of our least favorite copyright trolls, I came across a new hire on photoattorney.com .... How long before we start seeing letters from this one??

Negin Yazdani, a graduate of UC Davis School of Law, is passionate about helping clients protect their intellectual property rights in the most efficient manner possible. While in law school, Negin concentrated her studies in alternative dispute resolution, negotiation, mediation advocacy, and pre-trial skills and litigation techniques, earning academic awards for excellence in those courses. She also was elected Managing Editor of the UC Davis Law Review, won the Witkin Award for Negotiation Skills, earned pro bono and public interest certificates, and was a member of the King Hall Negotiations Team.

Is it just me or does anyway else find it "odd" that since the Aloha Plastic Surgery v. Hawaiian Art Network and Vincent K. Tylor, we have seen ZERO letters from this douchebag Vincent K Tylor?
I know Glen Carner and Hawaiian Art Network are no longer involved in the copyright "enforcement"  and it appears that Glens other company Copyright Services International has taken a different approach ( which is good)and is not associated with Vincent K Tylor, but you'd think Hawaiian Photographer and copyright troll V.K. Tylor would have found another nobody lawyer to send his letters... I find this so strange..hell for a while there we were getting letters submitted and new users almost daily from HAN/Picscout lawyers in regards to V.K. Tylor images..so
 
Did the Aloha case break him down??
Make him bankrupt?? (financially, as we can already assume he's morally bankrupt)
or maybe there was something in the settlement from Alohas' side that states he can't pursue infringements for any of these "screensaver / wallpaper images?
...or maybe the judge called him out on it??? so many questions, and I have a need to know...

Feel free to chime in with your theories, thoughts or ideas...sure would be nice to get a glimpse of that settlement agreement..

There are second chances in life, though; and Righthaven got one yesterday. The company's new lawyer, Erik Syverson, argued that the US Court of Appeals for the 9th Circuit should overturn Righthaven's losses in two cases: the DiBiase case, defended by the Electronic Frontier Foundation, and the Hoehn case, defended by Las Vegas attorney Marc Randazza. Yesterday's case is the first Righthaven case to be argued at the appellate level.

Prince George’s considers copyright policy that takes ownership of students’ work.

Sorry, Jimmy. Your charming homework tale of holiday hi-jinx is no longer your property. This is the strange scenario concerning folks after Prince George's County Board of Education in Maryland proposed a copyright policy that would result in the board owning the work created by both staff and students at schools in the region. The Board Chair Verjeana M. Jacobs has said it's not the board's "intention to declare ownership" of work done by students. But some are wondering why a policy ostensibly meant to guard against teachers selling on lesson plans created for Prince George's County schools also covers what the students create.

Covers don't get their own copyright protection as far as the underlying musical composition, Parks said. But Coulton might have legal footing if the show used Coulton's audio track.

This will likely piss of some artists and photogs...or at the very least make it a topic of discussion once again..

Artists and photographers tend to have mixed feelings about Google Image Search. Though Google’s use of thumbnails of images was ruled to be a fair use in 2007, many feel that Google doesn’t do enough to prevent misuse of their images and that the service caters to individuals who are looking to infringe (knowingly or unknowingly) on copyright.
As such, every time that Google announces an update to Google Image Search, there’s bound to be some controversy and concern and Google announced one such update yesterday.

Since the changes haven’t rolled out yet, it’s impossible to know for certain how they will impact artists but it’s clear looking at the screenshots and changes that there’s going to be some good and some bad with them.
