Since moving the ELI site to new servers and working on bugs, glitches and other items, I had the opportunity to have a look at the log files and made a couple of discoveries of interest..

Something somewhere was triggering mod-security to block IP's, the last issue I looked into led to the discovery of 46 alerts triggered! yes 46 different alert strings! I immediately suspected some sort of bot, crawler or scraper. As it turns out a crawler named "magpie crawler" was hammering the server relentlessly.

some quick research told me that magpie crawler is owned and operated by a company named "Brandwatch" and there are plenty of google entries slamming them for being "bad bots" and sucking away bandwidth like crazy..

Who are Brandwatch?

"We are a social media monitoring company, helping our customers find useful and relevant comments and discussion on the web. We crawl blogs, forums, news sites, and all kinds of social media content. The content is indexed, much like a search engine, allowing our users to find the pages that mention the words they are interested in."

Brandwatch is apparantly involved in "Online Reputation Management and Brand Tracking in Social Media". They have a crawler that will just swamp a reasonably small site. No pacing, no maximum number of requests per second, just blast away at the fastest possible rate they can.

They perform no useful function for ELI or our users / readers. They sell information to their clients on who is talking about them. That's right, they are trawling ELI in order to sell information to someone who is worried we might be saying something negative.

Don't be surprised is someone from Brandwatch appears in this thread, apologizing and justifying their bots behavior, it is their typical MO. At this time they "claim" they adhere to robots.txt, I have my doubts, they will be monitored closely, and worst case they will get their IP range blocked from ELI.

Quick update...

1. The issue with chrome timing out on replies to posts, has been resolved.
2. The issue with chrome not keeping users logged in has been resolved

at this point, it looks like we are in good shape, am now going to see if these issues are resolved in firefox as well as IE., I need to know if anyone is having and issues with safari, opera or any other browsers please. If so please report the browser and the version you are running. All of these issues have mainly been revolving around cookies and sessions.

Thanx for your patience and assistance it's greatly appreciated.

As I'm sure most of you have seen ELI has been down since midday yesterday, there have been some issues that needed to be addressed, one of which was migrating the site and entire forum to a new web hosting environment. Matthew worked diligently through-out the night to get everything moved. I've been doing some testing on the integrity of the forums and it looks like we are in good shape.

With that being said, I'd like to welcome you back as well as ask you all to please let me know if you see anything that appears to be "broken" or not functioning properly.

There will be further announcements in the coming days as to why we made this switch... You'll want to stay tuned to say the least!

on behalf of ELI I'd like to apologize for the downtime we have experienced, I'm sure it sent a few of our regulars into withdrawal..but have no fear Matthew has worked diligently to get everything back to normal...There will be further announcements, as we iron out any last issues and complete testing and verifying..stay tuned..it will be worth the wait!

Got an email from this Texas attorney yesterday via copyright-trolls.com, I responded by directing him to ELI, which apparently he just heard of thru fightcopyrighttrolls.com. He did not waste any time writing an article..

ur firm has been working in a bubble for over two years now, focusing exclusively on copyright infringement lawsuits as they relate to accusations of piracy through the use of bittorrent (“torrent”) peer-to-peer programs over the internet.

However, it has been brought to my attention that our “copyright troll” problem is bigger than just bittorrent.  People even today are receiving DMCA threat letters for the so-called infringement of other things, such as the unauthorized use of pictures, articles, poems, you name it — even works that are not copyrighted at all.

Looks like Randy Taylor (who likes to issue bogus takedown notices) has made some changes...his site

http://senddmca.com is the site he is using / marketing, and we've commented on this before on ELI.

Once you have an account here you are prompted with the "getting started" page, which states the following:

Getting started with SendDMCA is easy: Simply tell us the URL of use and confirm that you own the creative work. (But note, this is serious business. The Digital Millennium Copyright Act – DMCA – is a Federal Law that can hold you financially responsible for damages if you issue this notice in error.) To proceed:

You must be the owner of the creative work, such as an image
You must know for sure that the unauthorized web site does not have the right to use your creative work
You must authorize us to act on your behalf for this particular Takedown order


Looks like copyright troll Randy Taylor is to lazy to even read his own crap before submitting a bogus takedown notice...where the hell is his partner /attorney Dan Levine to advice him properly?

The first award of the year goes to Copyright Troll and Attorney Steven Mustoe!

Steven Mustoe is deserving of this award for several reasons.
  • We've only known about "Camel Toe Mustoe" for a little more than 1 month, yet we already have 3 or 4 letters from him... a true asshat
  • His letters just have that "personal" touch.....NOT
  • Obviously law school does not administer grammar tests...granted my grammar blows, but i'm not an attorney!

I have comments for almost every paragraph of this article, I also want to use this article as an experiment of sorts in terms of SEO, therefore I will only be commenting on a small portion of the article here, but I will reply to my own thread multiple times with different sections of the article, in each reply I will be changing the subject of the post, but rest assured all of my replies will be in regards to the PDN article, and I will also quote the section of the article I am commenting on, so it should be fairly weasy to follow, and I'm hoping to get some extra google entires as well..any whoozle...

Before I dig in here, let it be known, that these are my opinions and thoughts, I am entitled to them, they may make some folks cringe, while others might get their panties in a knot.   They may not all reflect the views of the ELI community as a whole...but perhaps they will. With that being said...onward to my commentary...my inline comments will appear bolded..

I also spoke with the author of this article at length, but I can’t help but notice nothing is mentioned in regards to my Getty letter in which case I have a license...this letter to me is clearly slanted to the stock agencies as well as the photographers, which comes as no surprise...it is a photography site..from here on oput my inline comments will appear in bold text..

This past July 4, Toronto-based stock photo agency Masterfile sent a $57,030 invoice to an unidentified company for the unauthorized Web use of five images. Pay up within ten days, the invoice said, or “Masterfile will be obliged to continue its legal process without further notice to you.”

The recipient handed the letter over to ExtortionLetterInfo (ELI), an advocacy group that is taking a bare-knuckles approach to fighting demands for what it considers unreasonable amounts of money for unauthorized use of images. It is making copyright enforcement more difficult and expensive for stock agencies and the attorneys representing them.

While this statement may appear to be factual, it’s worth mentioning that several key points as to WHY we take a bare-knuckle approach, which have been omitted. Yes we consider the amounts unreasonable in most cases..but there is also the fact that when asked to supply a method to which these amounts are arrived at, the stock agencies always balk, same goes for questioning who owns the copyright, proof of registration, etc..., If I get a bill in the mail and something doesn’t look right, I question it, whether it’s for a nickel or 500.00 dollars.. Try sending Jonathan Klein an invoice or claim for $1000.00 because his company sent you a letter, I bet he would question the validity of the invoice/claim, and rightfully so...

"Just got back from my UPS box and lo and behold, I got hit w/ a Getty Images extortion package ($1,175 for an image used by my web designer) on a site of mine.

Seeing how this company and its project was a MAJOR failure ($80K loss) and I'm most likely to collapse it (plus the fact that the letter wasn't sent certified) I'd rather take a razor blade to my balls before dipping them in alcohol then write those pricks a check for $1,175.

Somehow I have a feeling he never paid them.  ;D

    I've reached out to Glen Carner owner of Hawaiian Art network and Copyright Services International via email, below are excerpts of my initial email as well as an excerpt of his reply.

From Me
"First and foremost, we have received reports/documentation of new letters from Copyright Services International, which we know is your company, let me be the first to commend you on what appears to be a much more civil approach with your letters in terms of the content as well as the amount. In my opinion this is a step in the right direction."

the above statement is in regards to the last letter we saw, demanding 250.00 per image, which I personally hope will become the norm, as it is much more reasonable in my eyes..thos there is some improvements that can be made to his newest program.

"....there has been some recent discussion within the forums and in the absence of anything factual, we are pretty much stating our opinions as what we believe to be true...with that being said, we have documentation concerning I believe 2 instances of letters concerning Vincent Tylor, strangely (perhaps) there is no mention of HAN , yourself or Copyright Services International. Has HAN and VK Tylor gone their separate ways following the settlement of the Aloha Plastic Surgery Case? I am of the opinion that perhaps CSI has indeed changed it's ways in asking for reasonable amounts, but that perhaps Tylor does not agree to this?..

Also, Mr. Tylor is not affiliated with or a client of Copyright Services International which is incorrectly stated at http://www.extortionletterinfo.com/forum/getty-images-letter-forum/ongoing-list-of-copyright-trolling-firms-and-those-associated-with-them/  I am happy to hear you appreciate our changes, and would appreciate it in return if you removed his name under CSI from that list.  Thank you.

I have edited the post Glen Carner references, and have given Vincent K Tylor his very own entry as copyright troll and removed his name from being associated with CSI..

I'm interested to hear others thoughts on this, I certainly have my own theories as to why Tylor is not associated with CSI and why he now uses attorney Street to send his letters.

My company received a letter from J. Stephen Street in regards to the law suit with Vincent K. Tylor and Vincent Scott Tylor images. We have been accused of using their images with their consent and have been sued for an ungodly amount of money. The images that were used were from "free" wall paper sites. A majority of the images we have been accused of using are found through our Pinterest account. All the images that they are accusing of us using have been "repined" through another user. Are they going after that person too? All of the images that are associated with my company have no watermark, have no copyright information, have nothing to indicate that this photo has been registered to a photographer. Upon receiving the papers, we have removed all of the images that we are being accused of using. What we would like to know is, is there a class action law suit against this photographer?

I've invited the poster of this to the forums..this is all I have, and I'm curious if a suit has been filed, guess i'll be going into PACER afterall!
