Getty Images Letter Forum / Passed My SOL Date
« on: November 28, 2016, 12:10:20 PM »
When this all began I never thought this date would arrive. I officially passed my SOL on November 23. Thank you all for the great advice and wisdom you shared when I first came here. I learned a lot from all of you and I'm glad this place exists.

It seems Sanders Law, PLLC and BWP Media USA have slowed down quite a bit over the last three years. Over the next few days and weeks I will try to share more about my story now that things are done. I have always enjoyed candor of some of the other members who revealed their stories, sometimes in great detail. I would like to do the same now.

I also saw Sandra Rose's impending lawsuit has made a bit of a splash in the new year.  Anybody have any helpful new info?

Thanks for asking. :)

BWP Media took too long to serve me after filing this case in Dec. 2013. So, after the deadline to serve me had already passed, the lawyer asked the court for an extension to serve me in August 2013. Unbelievably, the judge approved the extension. All this time I had no idea I was even being sued. BWP's attorney, Sanders Law, hired a local process server who didn't even attempt to find me even though he had my home address. He went straight to the secretary of state and served the desk clerk. Apparently, if you own a LLC in Georgia, it is legal to serve the secretary of state instead of serving me at my residence or place of business. Of course, the secretary of state didn't notify me that they received a summons for my company. So a year later, in January 2015, the judge ruled a default judgment against me for $57,000 and some change. I found out about the judgment from a California lawyer. The court didn't bother to mail me the judgment even though my address is listed on the secretary of state's website. Now my lawyer is listed on my LLC as my registered agent to received service of summons. My lawyer is preparing to file a motion to vacate on the grounds that I was not properly served and the deadline to serve me had already passed.

By the way, thank you to Matthew and Oscar Michelen for their EXCELLENT advice!

I'm happy to see that you found your way here, Sandra. I had attempted to contact you through your site about your case about a year ago I think. Thanks for providing some new details about your case.

Robert, thanks for the link to that case. I hadn't seen that yet. After reading through it, I'm more convinced than ever that they only take screenshots and have no real proof. I couldn't believe that they refused to provide their evidence and then tried to show up at trial with different evidence. I'm glad I chose to wait it out.

Nice work uncovering their photos. I'm somewhat happy we didn't have this info a year ago when they first contacted me. Seeing all of their douchey faces would have made it all worse. Knowing a dude who looks like Robert Baker was trying to extort me of my hard earned money would have been the final nail in the coffin.

Congratulations! I've appreciated all the help and discussion you provided me in my time here. It's great to see you reach this milestone.

As others have said, if it's hotlinked, I wouldn't worry about it.

I initially followed the post on your site last year but haven't looked at it in some time since nobody else jumped in for a few months. It's sad to see that some have paid rather large sums to feel peace again. The post at the bottom caught my interest as well. What do you make of the guy who is attempting to have them disbarred?

I didn't think you meant me.  It just prompted me to think about the date!

Same here.

I share news when I have it. I'm in a holding pattern right now. It's been about a full year since I received my letter. There is an observation date in the letter that shows the infringement 6 months before the letter was sent so I like to go by that date. At best, I'm a year and a half into this. At worst, it's one year. I think my case is basically over since I haven't heard from them since sending my response letter. Many I have talked with do not like playing the waiting game and they pay up. I feel bad for those people, but I certainly understand the peace that it buys them. I stressed and worried for weeks on end before I finally began to feel relief.

In what way are celebrity images different than stock images? I imagine they have a higher demand and value for a period of time. After every major celebrity source has posted them around it seems that drops off significantly.

11
What does a document on a docket search generally say if a case was settled out of court? If a case is dropped by the plaintiff and it is dismissed with prejudice is that generally considered a sign of a settlement?

12
I assumed that. I guess I was hoping at least one or two would just confirm, "yes, we did settle"

13
It seems that those who settle are forced into silence. I have reached out to between 10 and 20 others who had Sanders lawsuits. Not a single one has ever responded.

Sanders Law, PLLC represents a lot of these paparazzi type photo groups. Dig around and find some of the information here about BWP Media USA and National Photo Group. Read through this thread to get a little more familiar and then educate yourself using other parts of the forum.

JLorimer, thanks for your reply. After looking into the source for the page in question, it looks like all the pictures were linked to the original site, and not uploaded to my relative's site. From what has been said recently, it appears that linking to an image is more favorable for my relative than uploading the image.

In this case, I would totally ignore them.
