This post is just an update to document the general knowledge we have about Sanders. One person I have been speaking with recently sent Sanders a response letter. In it, she requested the actual URL of the image files instead of just a general URL that does not indicate the source. To my surprise, they did respond with direct URLs to the images in question.

To those who are receiving letters from Sanders, it is important to note that they may be stepping up their game a little bit. This information alone is not damning evidence. You should still press them and make them provide the necessary proof before discussing money. I believe they are responsible to provide considerably more evidence than this. Keep in mind that if they play ball and provide all that you ask for, it may be time to consider trying to work out an honest settlement.

Many things we think fall into fair use often do not. I wouldn't count on it. It's hard to say without actually seeing the article.

This doesn't mean they still cannot seek damages for copyright violation. Registration only allows for statutory damages, which can be significantly higher than normal damages.

Personally, I would not ignore a paper letter. I would ignore an email, but not something sent in the mail, no matter how unprofessional it looks. Some will disagree, especially if it was not sent via registered/certified mail.

Spend some time reading around the forums and educating yourself a little more. This may only be the beginning.

I wouldn't worry at all if the images were hotlinked from other sources. It just goes to prove a theory most of us have had all along...they have no idea where the images come from.

By "signing out permanently" at the first sign of questioning, you have only shown me that you are not a person who possesses these qualities and is not fit to lead the type of movement you have described.

The JavaScript has been minified, likely to increase page speed. If you feel at all inclined to look at the JavaScript, you can visit http://www.bing.com/widget/bootstrap.js and copy all that shows on the page. Then paste it in the big text box at http://jsbeautifier.org/ and hit the "Beautify JavaScript or HTML" button. This will make the code readable in a very similar way to how you would edit it with your editor of choice.

It looks like Bing is hosting the thumbnails at least.



I inspected the bottom middle image that has the blue border. You can see in the HTML below it, where it is also highlighted in blue, that the source (src) points to http://ts1.mm.bing.net/th?id=HN.608017367656300980&w=186&h=116&c=7&rs=1&pid=ImgWidget

I don't know if it is at all significant, but the title seems to point back to the origin where the image was found (http://drinknectar.com/2010/12/09/rankings-linkbacks-and-google-seo/seo-search-engine-marketing/).

If you click any of the thumbs, it takes you to a search result.

This is probably irrelevant to the case, but you can modify the image by playing with some of the parameters in the source link. For example, you can set the height (h) from 186 to 1024 and the width (w) from 116 to 639. This doesn't seem to increase the quality, but it will give you a larger image. I suppose that someone who was really motivated could use the bing results to in turn load single images on his/her site.

I don't mind sharing the contents of my letter. I sort of have a process for my own sanity though. Since my SOL isn't up yet and I haven't outed myself personally, I don't want to cause any extra trouble for myself if Sanders happens to follow what I do here. I like to learn a little about the situation before sharing the text. Feel free to email or PM me for further discussion.

Hello All,

Sorry for bumping such an old topic but it's relevant to my situation.

On the side I'm a film critic and run my own website. Last June I received a demand letter from Sanders in the mail claiming I used an image on my site that was copyrighted. I spoke with a co-worker who was a criminal defense attorney who told me it was a demand letter and not a lawsuit.

Initially when I received this, I reached out to a few colleagues who run very big and famous film websites and they were contacted by the same law firm claiming the same thing, but chalked it up to being a possible hoax and trying to extort money. 

I didn't hear from them again.

On August 5th, 2014 I got an email from the same company claiming the same thing. Again I made sure it was just a demand letter and not a lawsuit, it's even signed by a paralegal and not an attorney, which I was told is a bit fishy as well.

What's the best course of action here? I've reached out to a handful of attorney's to seek advice.

In my experience, a very strongly worded reply turned them away.  I based my reply on what others here have used against Getty and other trolls.  The request for additional proof, as well as a show of self-defense, seems to effectively turn them away most of the time.

stop the truck!! You got the first letter in 2010??? This is 2014! the statute of limitations for copyright infringement is 3 yrs.. am I missing something here?? are is there cause for a motion to dismiss right in front of us?

I noticed that on my read through this earlier this morning.  I just came back to comment now that I have time. I'm glad I wasn't the only one.

From what I have read, it still seems like Hawaii is the wrong place to file.  Others here know better than I do.  I think it needs to be filed in your state though.

I'm sorry to hear that you feel you were taken.  I sent them a forceful reply in response to the scammy looking letter I received.  I advised them not to continue contact with me unless they were willing to provide certain pieces of evidence.  I have not heard from them since.

I have advised many others to do the same.  However, if paying $500 gives you better peace of mind than waiting for the 3 year statute of limitations to pass, then that is well worth the price.

I would love to take a look at what the settlement looks like.  However, make sure you don't violate any terms of non-disclosure in sharing the information.

Can you tell us some more details about your case?  What are the circumstances surrounding the image and the site it appeared on?  What have you told them?  What methods of communication have you used?  What have they told you?

BWP had slowed down significantly in filing lawsuits compared to last year.  It got to the point that I wasn't seeing new ones for weeks so I stopped checking.  I hope this puts a stop to their trickery.

Kevin Sutherland has been a great example of how these guys talk a huge game, use extreme scare tactics, and even try to "reason" with people.  I hope people find the thread here and there as a future reference and learn not to be scared of all the hot air these types blow around.  He has absolutely nothing to say now that Peggy has reported the case dropped.
