Legal Controversies Forum / HR3523

HR3523, the Cyber Intelligence Sharing and Protection Act of 2011, by Rep. Mike J. Rogers, R-Mich

It seems that this bill will allow companies to spy on users and share private information with the government and other companies and be completely exempt from all laws.

What is wrong with our Congress?  Will they never learn?  Time to send all the incumbents home!

On occasion, I might see an advertisement worth watching, but I am sick and tired of the legal drug pushing that seems to dominate every TV ad in America today.  So until they can advertise something of real value or a funny "gotcha" ad, I will continue to skip them and use them as bathroom and refreshment breaks.

I know this respose may be a tad bit late, since you have already had a verbal conversation with them.  In my opinion, it is best to correspond in writing only.  This way you have an audit trail if is does go to court.  Also, when you are writing words, it is easier to edit out the emotional parts before you send it.  It gives you time to calm down and rethink how you sound.  So unless, they recorded your conversation and the state laws allow recordings without your knowledge, I wouldn't worry too much about what was said, however, if it were me, I would sit down and write a letter responding to their claims without admitting any wrong doing.  Go through these posts and you will get a good idea of what to ask for as far as evidence.  By the time they respond, you will have become much more knowledgeable and will better know which course of action you wish to persue.

Awwwhhhh!  Did someone quit and leave a vacancy?  Or better yet, so many letters, too little time.....  Look at the jobs being created by these flawed copyright laws!

Too funny!  You know what they say, "nice guys finish last."  Actually that should be the new logo for the US Senate.  Look at all the years they have been doing "insider trading."  They sent Martha Stewart to prison for doing the same thing.  If voting to stop insider trading within the senate is not an admission of guilt, I don't know what is?  They should all be serving prison sentences!  No wonder these crooks support the new business model of the stock photo industry.

Thanks for sharing.

I agree.  The only images in my opinion that someone would "lease" for a specific time would be "once in a lifetime shots," such as 9-11, moon landing, etc.  The photo that was on my site put there by a third party was a girl on the phone.  It is as generic as they come.  MF has it as rights managed and leases it for around $700 to $1100 depending on time and size.  I would love to see how many people have actually paid for that one!

I found it most interesting that when I received my letter back in July 2011, we did a search and the image in question did not show up on Masterfile's site.  However, since correspondence back and forth, it now does.  It seems to me that some stock photo companies may block these image finders from their own sites, thus creating a more lucrative pool of potential "letter receivers."  These images should show up on the respective sites that sell or license them, but a lot do not.

This is for all my friends here on ELI.  If a few 4 letter words offend you, then do not click the link below.  I couldn't help but think of Soylent Green when I was watching this, so I am dedicating this to him/her.  Oh and they the group asks us to share it, so there should not be any infringement issues...

What do you want to bet that MF's "organic" growth is not from selling photos?

I received a letter from them on behalf of Masterfile after they turned down my very generous offer to settle.  I assume they are a collection agency, so I told them I would not pay them and only deal with Masterfile.  So the ball is back in their court for a while.

I find it rather surprising that MF would file suit against Dr. Wetherman considering he can prove "innocent infringement" based on his purchase from TM.  What are they thinking here? Default judgement?  Pressuring him into paying because they filed a lawsuit?  It seems to me that this case could blow up in MF's face if Dr. Wetherman decides to see this through or am I missing something here?
