if a request is made to getty , mcormack, ncs, to  "cease  all communications"  about the settlement, should they legally stop communicating ?
 
If you tell a person or business, in writing, that their business or anyone they retain to represent them need  to “cease communication” regarding their claim,  and they continue to contact you, harasse you, you have the right to contact  the police department where that person or business are located, speak to a detective, and file a police report.
The detectives will contact that business and inform them not to contact you anymore. You do not need to suffer for 3 years. This is the date when getty become legally liable to you.
NCS and McCormack are retained by GETTY, so Getty is still the entity responsible for ALL communications. You need to contact the police department where Getty is located.

Interesting post.  This was addressed recently in the forum.

My understanding is that the police normally deal with things that would be considered criminal-level issues.
If Getty sends business communications, but doesn't threaten you with physical harm, or break other laws, I don't think that there's much that the police could do.
It wouldn't be "criminal harassment", or "uttering threats", etc.

I don't think that anyone could even get the police to do anything about Riddick/Imageline, who was the most threatening of all.

Just my opinion.

But, if somebody "phones the cops", and that works... post it here for the "lulz"...

You are considered innocent until proven guilty in a court of law. For the last 5-6 years, getty made thousands of claims. These are claims only. Being accused , and making claims of something you did not do, for 3 years, is considered harassmenrt.
File a report with the police even if they do nothing in the beginning, you at least have a report on file.
Later, the Police must act, when the number of reports pile up from you and others.

In your response, tell them that the images were removed, and without admitting any guilt, send them a fair offer that you can afford. Always tell them, they or anyone they retain in the future need to cease "all types of communication with you"   if they do not provide you with what you are asking for.
Have you made a checklist of things you are going to ask for? These should include at least:
Proof of copyright registration.
Proof whoever is contacting you has an exclusive license.
And so on?
Tell them if they do not cease all types of communications, you will file a police report , and file one if they do not respect your request, it takes just a phone call. Everytime they do not respect your request, and If they keep sending you letters / emails, or someone they retained send you letters / emails, keep filing police reports one after the other .

When they don't provide you any proof, and you tell them to "cease all communications", this is the date when getty become legally liable to you. You do not have to wait 3 years.


Also ,  getty, ncs, mccormack, are using emails for communication.
These are unwanted emails, and they are regulated by the FCC

Yeah my first reaction was, "Oh come on, Sticks and stones... getting some emails or calls doesn't really impact you." Then my second reaction was, "Don't the police have enough to do without putting this on their plate? Lets not waste their time."

But then ultimately I thought you might be on to something. Saying essentially, "I have removed the images you questioned. Without admitting guilt in this and in the interest of moving on I made you a fair offer. I have no contract or business with you. I want you to cease all communication with me unless it is to notify me that yo accept my offer."

Obviously this won't prevent them from serving you and seeing you in court. And you have to be prepared to go the distance if you take this stance. But if they simply turn it over to a collection agency, you could try and call the police and report harassment. (Although honestly I think the desk sergeant will ask why you didn't simply hang up the phone or toss the letter.)

Maybe if 100 people were suddenly reporting Getty for harassment, our politicians would get motivated to look into this.

This is quite interesting, and I'd like to hear more about it.
The only caveat that I can think of is that such an action might "force their hand" and cause a infringement dispute to be escalated.
That is, it could go from letters via regular mail to certified letters from a lawyer rather quickly.

Hello all, new member here...

Based on my own experience (not related to Getty in any manner, by the way) you will have no results with the local police.

IMO, Getty Images, the attorneys they retain, and this cluster of stock photo services who use them have a symbiotic relationship that borders on mail and wire fraud. This would fall within the jurisdiction of the FBI or the USPS Inspector under 18 U.S.C. § 1341, 18 U.S.C. § 1343, and possibly 18 U.S.C. § 1346.

So a growing number of written complaints to the Feds might result in an investigation. Who knows?

If they still communicate with you, file a police report in seattle and file a complaint with the FBI to make your complaint part of the "Public Records" ;  you and many other  government agencies will have access and able to use these public records.

There's something that might help in this regard in terms of Getty Images.
When they're asked for proof of their claims, they won't forward anything.
That really shows what a scam that they're pulling.
