Well it was an email from Getty asking about photos and they wanted me to take a survey about my use of photos.com which I used a long time ago. But I never signed up to get email from either. So I sent the following email to two levels of hosting providers and the FTC:
Frankly guys I am tired of having to opt out of emails sent to me unsolicited. Spam can get created if some unsubscribes are clicked so even that method can be dangerous. The CAN-SPAM Act of 2003 does not allow unsolicited email sent even if an unsubscribe link is provided unless permission is asked and then granted. I never sent Getty Images an email asking to be on their list and they never requested it. Why do your networks allow this? I'm reporting this to the FTC as a direct violation to the spirit of the act in hopes of stopping some of this. Getty, you should govern yourself as this has caused me stress and taken time away from my business to deal with this. I suggest you tread carefully.
I am now placing a call to the FTC to file an official complaint against all of the providers of Getty Images networks and instructing my staff attorney to file a formal suit against Getty Images. They just hit me at a bad time. I'm tired of getting spam this way where no one asks first before sending and thinks they are protected by a little opt-out link at the bottom (which they aren't). And whats good for the goose is good for the gander, eh?
Wish me luck.
