Hello. We are considering the letter program but still not clear what outcome the letter will ultimatley accomplish even after reading the forums and watching the videos. I had some contact with Oscar but don't want to keep badgering him. I understand it redirects contact from the accused firm to Oscars team. Beyond that, in a standard case of innocent infringement for one photo, what is the ultimate goal of the letter program? To:

1. Get the case dropped completley?
2. Negotiation of a fair settlement?
3. Other?

I would like to hear anyone's experience of how thier case ended after using the letter program.


As a side note, I searched the forums and didn't see discussion about the 6 strikes proposal. http://www.businessweek.com/articles/2013-02-27/should-you-fear-the-six-strikes-anti-piracy-rule

I know this mostly applies to P2P file sharing but does anyone see something like this applying to photo infringment? Some kind of fair warning practice that would get unwilling, accidential infringement cases dropped initially with a warning only?

We just got one last week. I'll hold back on providing details of who's after us... I've been over this site and forums and will respond based on the guidance and case data provided in these forums. I'm leaning toward the defense letter if things go south. What I haven't seen however is this:

1. If in the rare case they do take you all the way to court, can they get more than the original demand they are asking for? Legal fees, interest incurred over time, etc.....? Besides the inconvenience, what's the risk beyond having to pay something determined by the Judge?
2. This has to be filed in federal court, correct? What does this mean, do they have to come to my state, would I have to go there?
3. I know its worst case scenario but I want to be prepared. I have seen a case where it did go to court so its a remote possibility.
4. I don't understand the 3 year statute. Could I literally do nothing for 3 years before they will take action, if they take action?
5. My approach will likely be to respond asking for all the evidence of proof, offer a settlement in good faith, assume it will be rejected then ignore.

Lastly, thanks to everyone here, both contributors and site owners for standing up to this friggin' scourge. At a minimum I'll be making a donation to the site.
