Hi,
I'm not sure how to see if the copyright is registered. I'll look into that in a minute. One thing that I have found is that this particular photographer has several images with Getty under a Rights Managed licence, that are also available on another stock site, also under a Rights Managed model. Unfortunately, the image I'm having problems with isn't one of them.
However, it does somewhat weaken this statement on one of the letters I got from Getty: "Rights Managed images, such as the ones at issue, are exclusive to Getty Images and available for license only through our website.”
Back on the subject of settling with the photographer directly. If I were to do that, does that cut Getty out or do they still have the right to come after me? (assuming the photographer hasn't signed his right away to deal with me directly)?
Oh, and whilst I'm editing this. I have looked at the US Copyright Office and can find that the photographer has registered a few images, but seemed to have stopped doing it in the late 90s. There are only a few and most don't have a description.
