Awesome videos guys! Thanks so much for all the great information and taking the time to produce the vids.
I agree with Oscar's comment about having a "fair resolution" on these photo infringements. Where is the honor for an attorney generating such fear and preying on the public with these letters. Most people are completely oblivious. I had no idea what this was all about until I found this forum. A simple "cease and desist" is more than understandable in these situations. I hope one day this whole "infringement" and "extortion" photo game will be resolved.

I have dealt with Hawaiian art on one or two cases and I think they are looking to expand this as a business model.  Certainly if you can show that hey did not protect their "work" by allowing it to proliferate on various free wallpaper sites etc. or even better if you can prove that they purposely allowed these images to appear on their to promote their website or whatever reason then a judge will de-value the damages that they would be entitled to or maybe even deem that they are not allowed to complain about the infringement.

This definitely fits the profile regarding our infringement letter. Considering the single image in question is on over 50 websites for free download and also have free 'snippet of code' that you can use to place the image on your website. It was as if they were encouraging us to use the photo in question no doubt.

I notice that within iStock there is a download history section that keeps track of the downloads you've had. This seems to obviously validate your purchase/usage.

This is great information.
I also can not find this photo for sale anywhere online. I've looked everywhere and just can't seem to find it for sale on any website nor even the artist's website himself.

To add to this, the photo in question is 170x150 pixels (thumbnail) on a deep seeded page on a website that has been live for about 4 months.

you can request removal from archive.org as opposed to submitting it and waiting longer..

Make sure to include the disallow tag for the domaintools user agent, as they abide by robots.txt

can you share the exact coding you recommend in the robots.txt file?
I currently have this:

User-agent: ia_archiver
Disallow: /

yup pretty much useless, the plug-in is just creating a regular robots.txt file, and giving you the option to change/edit via the wordpress admin dashboard... You'd have much more control by creating your own.

Thanks. I created my own robot.txt file and have it uploaded to all my websites. I'll be submitting them to wayback.

I've had 2 separate designers say using images from: http://www.sxc.hu/  is OK.
I'm reading that they are owned by Getty...'RED FLAG' !?
Says these images are all royalty free and allowed to be used on websites in digital format.
I'm safe to assume these are OK to use then?

@budhappi - Do you have any contract which you have your clients sign releasing you from any of these infringements? Do you have any recommendations? Thanks.

Is there a list of recommended sources for photos to use on websites? And instructions on how to properly post photos onto your websites. My wife and I run a website design biz and would obviously wish to continue to provide for our little ones :)

So all the websites that are offering this FREE photo, are they in the clear? Are they violating the copyright of this photo also? I mean, they are offering a high resolution wallpaper. I'm being hastled over a 173 x 130 pixel picture that's on some random deep page of the website that's been live for about 4 months.

SO I guess that this plugin http://wordpress.org/extend/plugins/pc-robotstxt/ for Wordpress designer is useless then? It claims you can control images and other indexing from your website.

Can't help but notice all of the results on the first page are all wallpaper sites...I think downloading a wall paper image, would be a bit different than using the same image on a site, as thats not it's inteneded purpose. I would also guess that most of these "FREE" wall paper sites are loaded with swiped images, not of the 20 or so i glacned at only 1 looked legit, until I looked at the terms, then not so much. legimate sites will clearly outline the privacy policy, terms of use, and they should also have a visiable DCMA takedown link, which will give them safe harbor ids someone were to upload someones elses images. do a search for coca cola logo and it will yield over 4 million results, this doesn't mean I can use the logo as I see fit...just say'in..

you'll need to educated not only in terms of the letter, but also copyright in general if you want to stay in business for any lenght of time..

Yes, some of these sites are wallpaper sites. But you will also notice that several of the sites clearly have HTML for cut/paste of the image to your website. In fact, it clearly states on the website that it is for use on your own personal website.

One thing, my wife and I have removed and altered any photo which may be questionable on all the websites we host/control. Is there a post or list of websites on this forum that list websites that have photos that are OK and free to use for personal usage on websites?

Is there a way to find out who has the copyright of this photo in question?
