This is GREAT!  Being a Canadian and dealing with these "fine folks" can be intimidating (Canadians are too nice, or so I've read).  Thank you - thank you - thank you.

Though I'm still "scared" about all this (it's so new for me) I realize I can't hide and it will go away... well, only if I wait three years it will go away.  I will of course sit tight, even though they've offered to reduce the amount by 25% - I still don't have $1,000.00 laying around.

if in Canada brief summary of copyright law

limitation period is 3 years from date alleged infringement discovered or owner should have discovered
owner can elect statutory or actual damages
must  prove actual damages - ie what a customer would pay to license the image usually what the website pricing shows and I question whether available promotions and discounts that are always shown should be considered
if statutory damages unless infringement is wilful, statutory damages were significantly reduced in 2011 amendments to the copyright act so that a court may award a minimum of I believe of $200 per image where non commercial use made of the image and infringement not  wilful
there is no need to register copyright in Canada to take advantage of statutory remedies like in the US
however, an owner can more easily prove ownership if the image has been registered with the  proper government office here
real issue is firstly if owner can prove ownership and that is done by stock companies usually taking written assignments
this is where some of the stock companies got into trouble as their  assignment agreements were declared invalid by the courts
in order to have standing in a Canadian court to sue the  stock company must have exclusive ownership and their problems arise  where they pick and choose from the bundle of rights of ownership ie stock company says we have copyright and IF we need to sue you the original owner agree to give us the  right to sue on your behalf
the courts had a problem with that here in Canada
see Master File 2002 decision of the Federal Court that declared assignment invalid
Master File in response changed the language of its assignments as I understand

I like most feel that the  current system is broken in that the threat of litigation in this  area causes stress and often payment without ensuring the owner is actually entitled as it is confusing and the law is very relevant in that  it requires verification of ownership whether actual or by way of proper assignment and there are damages to be considered and whether  an alleged inf ringer has legal defenses such as fair use which is not  dissimilar to  the US experience.

HI - I'm in the same boat as you, I'm Canadian and in the same predicament.  I also rec'd the e-mail as you have below, however I am surprised that they would use e-mail and not registered mail or mail period.  E-mail is not dependable, it can be deleted accidentally, it can go into your SPAM/JUNK folder and there are thousands of emails there and nobody can be expected to go through thousands of e-mails to find the false positives and move them around.

I'm also not sure of what to do.  In my case they offered to reduce the amount by 25%

However do I reply to them via e-mail or by registered mail?

What do I say?

I'm getting sick to my stomach also and just want this all behind me.  I've taken down several for hobby websites and don't use images in any blog posts and avoid using images for any FB/TWITTER posts that I make.

Ok guys, I promised to keep updating this thread with any progress.  Today I received this email from the NCS Solutions and it made me really sick.  Here is the content of the email:

Our office has already attempted to contact you on numerous occasions to resolve our client’s claim of the unauthorized use of their protected imagery.  Please be aware that copyright legislation provides for strict liability, regardless of your level of knowledge or intent.  You have been previously forwarded the website and URL where our client’s image appeared.  As the end user, your company is ultimately responsible to ensure that the appropriate licenses or rights to the image(s) have been obtained.  Please be aware that if you hired a third party web developer to design your website, your company is still responsible to ensure that the images that appears on your website have been licensed.  Additionally, if you have purchased or acquired images from a subscription service or a website that provides templates you are still liable to ensure that the imagery appearing on your website has been purchased.

Kindly advise of your intention within 10 days.  If we do not hear back from you within that time we will have no other choice than to assume that you do not wish to amicably resolve this matter with our office and we will return the file to our client’s legal department for further evaluation and escalation.

I was advised by an attorney not to get into any arguments or conversations with them or with Getty and he told me they will keep harassing and he advised to ignore it all until they actually sue me in court.

Any advises or suggestions or feed back.  I would love to hear from you and if anyone in Canada have been sued before, how did it go?

Why does the ELI Community even exist and why do ELI Community members hang arouned?  Why do the ELI "regulars" stay regulars?  Are you here because you want the latest news and information?  Are you addicted/do you enjoy the drama that comes up now and again?  Are you here because you are among friends?  Are you here because you feel passionately about the cause that ELI represents? Are you here because you feel you make a difference?

What is it about ELI that keeps many of you coming back?  By rights, most of you no longer need ELI's help or services and yet many of you do come back.

A lot of GREAT information; peace of mind when you get the letter and subsequent letters and/or e-mails and some place to vent frustrations where you don't get pounced on since everyone has been or is in the same boat.  Oh yah - A LOT of hand holding by those more knowledgable who are willing to share and guide you.

Honestly the only time I've ever found a community like this is waaaaay back in the old BBS days when I'd spend hours on Citadels (if you know the terms - you're an oldie like me [I'm not a computer geek]) and with other SYSOPS trying to figure stuff out.  We were all learning and it was all pretty new and everyone helped everyone whether they were in the same city, country or anywhere else in the world.

Lucia - very interesting; I have a background in software development so what you're doing does make some sense but alas never kept up with it (I'm in a different career path now).

UPDATE: So I sent my letter to them, registered mail this time and no reply via mail -- but get this, e-mail.  Why would ANYONE send something important via e-mail?  How often to e-mail accounts get hacked?  How often do you get SPAM?  How often do you get e-mails from "Nigeria" asking for payment for something?

They keep insisting that an image was found on "your company’s commercial website" - ummm... not a company website, but personal site, and not commercial but hobby.

So do I assume the e-mail is real since there really is no way for me to tell.

It is interesting that the letter is coming from the US and not from Canada -- not sure if Getty Images has a Canadian office or not...

So what is my next step?  Do I reply to the e-mail eventhough I'm not certain it's really them or do I wait for them to send me a letter?

Back to reading... was hoping that I had not heard anything they would roll-over and die, but apparently not.

Just to update everyone on this - I've really been dragging my heels.  Everytime I look at the letter, or come to the site for advice - panic sets in and I don't sleep for days - which is what they are looking for so that I (and others) settle.

I actually managed to print the letter out, and sign it today and am going to send it out.  Will keep everyone updated as to what happens.

Thank you for that clarification - I'm in the latter situation, the letter is addressed to me (I am in Canada) but it is coming from the US but their letter does reference the Canadian Copyright Act , Title 17 U.S.C.A., the COpyright Act of 1976 and "equivalent laws in other jurisdictions" - as such I suspect most of the Canadians getting letters will be in the same boat.

Very interesting.  Perhaps I'm just a dolt, but I never would have thought of printing a gun on a 3D printer... my mind immediately went to printing stuff like organs for transplant, medical purposes, and things that would help humanity.  It is a scary thought that 3D printers could very well be used to build weapons - bypass the mfg'er entirely, no more gun smugglers - just buy a 3D printer, grab a schematic and print your own.  Scary.  Who needs a post-apocalyptic world?

That's a great article, I read it and the comments to it.  It is unbelievable that lawyers -- who should be upholding the law, and protecting free speech are the ones that want to shutter it!  I hope that no judge would grant them their request.  If it wasn't for websites like this and many others, many of us (myself included) probably would have agreed to pay whatever was asked of us and chalked it up to a learning experience.

I really got a chuckle out of the highlighted points!

Uh-oh a Canadian musician is in trouble with the Canadian Mint.  Apparently he used an image of the Canadian penny without permission and now the Canadian Mint wants money - $1,200.00 worth (I'd pay it in pennies).

Read the story on Yahoo Canada - Uh-oh, I said "penny" wonder who owns that copyright... apparently the Canadian Mint as they're demanding royalties from an artist.  Talk about a switcheroo!  It's usually the artist demanding money from "us".

Hello All - here is my draft letter (sitting there for a few weeks).  I would appreciate your feedback... I think I've said a few things twice or thrice, that's me being nervous:

===== START OF LETTER =====

I received your letter dated August 9, 2012 with respect to the use of an image that is alleged to be copyright by GettyImages.

The image in question has been removed from the site immediately upon receiving the letter even though it was not clear in the letter that you are the actual copyright holder of the image.

The site was created as a hobby site, with the knowledge that it would not generate any revenue.  The image was not being used for commercial purposes and it was not being distributed.  Please also note that I am not a company, but an individual.

With respect to your invoice in the amount of $1,275.00 CAD I would request the following details to determine ownership and registration of the image:

1.   Please provide copyright registration of the image in question
2.   Signed paperwork from the photographer that transfers copyright to GettyImages.
3.   The method in which the amount for settlement demand was determined.
4.   Sales records, including all fees, of the image.
5.   The exact day that the alleged infringement started.

I would also request that GettyImages, their employees or any other party that GettyImages retains cease all communications with me if they are not able to provide me with the information indicated above.

Currently nothing in your letter proves that you hold the copyright to the image in question, so before any settlement can be considered I am requesting proof that you hold the copyright.

In researching similar images for licensing, I have found that images can be licensed for free (with proper attribution) to $49.00 when purchasing multiple images or credit which can be used towards the purchase of images.

Without admitting any guilt, I would settle this matter for $49.00 to put this matter to rest.

I read CowgirlCaz post and will do more research to see if I can find that same image elsewhere.  The research I had done was on similar photo sites to see if they had similar images not the identical image and to obtain pricing from other such outlets.

Hi Greg - that makes a lot of sense.  I'll continue with my letter.

I also did e-mail Mr. Fewer and here is his reply (helpful for any Canadians that visit the site dealing with GettyImages):

Getty has made a misrepresentation (ie, they don't own title, etc.).
 
Unfortunately, this is a legal matter. If you do not feel comfortable
dealing with Getty on your own and you don't want to pay them to go away,

As the FAQ we sent you should have indicated, ignoring Getty is a strategy
that has worked in the past, although there is no guarantee that Getty
will continue with its policy of not suing in Canada. This strategy will
result in 2 years of continuing harassment. There is a 3 year statute of
limitations on copyright infringement - after that, you are safe.
 
I cannot advise you what to do - it is a matter of your personal capacity
for risk and tolerance for harassment
. It should also be clear, I hope,
that you are not obliged to pay what Getty demands, even if you are in

generally are in excess of those damages.

Bolded & italicized text is my edit to the message - while my tolerance for risk and harassment is low; I'll have to "suck it up" for the next few years and pray they never decide to make an example out of me.  But from what I've read they won't be able to get much anyways...

Also would appear that contacting the US OAG would not be helpful - at most it may alert them to their tactics of harrasment of individuals/companies accross the border but they may not be able to do much to assist.
