I guess MF Keeps tabs on the posts of this website because not long after i posted last, i received an email from MF answering some of my previously asked questions to ELI.


hahha, not surprising...they watch us, I'd be willing to bet the answers you get from them are different from what we would say..personally I'd block their email as spam, let them stuff an envelope...trolls

sounds like it is a compilation, meaning many images in one registrations, I suggest you read the chaga international case specifics, which were also done this way and were recently held as invalid..our own  Oscar Michelen handled this case... couple of things..
1. just because MF states the image is registered down't make it so
2. even if MF supplies you a reg. # doesn't mean it is a valid registration
3. you also have no way of knowing if this artist / photographer is even affiliated with MF at this time.

"registered Email"?? never heard of such a thing, but I would suggest not emailing them or calling them any further..

You won't find an attorney to do this for anything near 295.00...Too bad you researched after emailing them back and forth...yes you could be liable for 10's of thousands, but it's highly unlikely a judge would award that much and also pretty unlikely they would file suit over 1 image...

He could have gotten the phone number off my website where he found the image in question...Thank for your reply Robert.

My apologies if I came across rude, it wasn't meant to be...yes he could have gotten from your website, chances are good he never went to it or saw it, picscout is completely automated and creates the screen captures that they send along to the trolls...more importanly my point was to not make it easy for them, don't accept their emails or phone calls insist everything be done through the mail...this also serves a second purpose...you'll have complete records of everything, and there is less room for them to slip up this way..

Robert, I tend to agree this sound more like a site owner trying to warn people.  But even at that people still don't get it all too often.  Remember the guy that put the picture of a car, I think it was a Nissan on his website that DID contain the copyright information in the photo and was shocked when he got a letter?


Take note that it is "under" the image not a part of the image...I've not seen this before, but it's best practice to have it in/on the image...someone will share these images, and getty will simply say "you were warned", when in actuality the warning is only good if you're at the source... Actually now that I think about it, the site owner most likely posted this under the image and not getty themselves..

Yes I remember, I also remember we never heard back from him, after we politely told him he wasn't to bright...and the trolls think we do not respect copyright, nothing could be further from the truth.

I just got off the phone with Mr. Hilsheimer. I did offer him $150.00 at first and then $200.00 but he refused. "My hands are tied and I have to pay my artist" he said. He then said that he could put me on a payment plan for 6 months ($160.00 per month). I told him I could not afford it, and politely left it to that.
He called me back a few minutes later to tell me that I should look into my business insurance which may cover the fee. I don't have a business insurance...So, should I just wait it out at this point?

waiting it out will be a long threes years, since he now has you're phone number...I think calling was a mistake, and making it much to easy for them..If you "found" all of your images via a google search don't be surprised if you don't get more letters from Getty Images, and maybe others as well..at least you were proactive in removing anything questionable..

Oscar to date has handled well over 800 letters, very few if any of those paid anything above the cost of the letter, there may have been a few in the beginning that opted to "settle"..I might be the best 200.00 you ever spend if you don't have the desire to deal with them.

at the end of the first, this user staes that Getty refunded her money from purchasing the image, and STILL demanded the amount in the letter...

what the hel kind of BS is that??

I also have a concern with ALL of the other images that are used as well..he best hope he has licenses or express written permission to use those...Les is a sitting duck
