There is absolutely no insult intended to Fred Rogers, I grew up watching him. What I am referring to is a video made by Timmy where he basically reenacts the Mr. Rogers opening scene. He comes into his office talking about his services and intellectual property goes to his closet takes off his shoes and jacket, puts them in the closet then takes out a cardigan from the closet and puts it on as he finishes his talk. From what I remember the video was even called Mr. Rogers.

Not only what does this say about him but also about Getty for using him as their "preferred legal provider". Seriously… Just saying.

I've never been a big fan of Mr. Rogers, but it seems rude to insult the guy when he's no longer around to defend himself!

I think that he has the same mentality as the government where they think that a $700 hammer and $500 toilet seat is all right so $850-$1250 is just about right for a cactus. Also Robert remember that this is coming from a man who likes to dress up and play Mr. Rogers.

Ryan, I thought your article was very well written and explained your points concisely. As for the negative comments from photographers what they don't seem to realize or understand is that no one is advocating copyright infringement nor does anyone here on ELI support anyone that knowingly takes a person's intellectual property and uses it without permission or paying for it. What we are against his Getty's business model of legalized extortion and using it as a business model to make money rather than truly protect their artist intellectual property rights.

I concur with Robert but there is no way I would pay them the full amount they are asking for, I understand you are caught in the middle and I think in your situation Oscar's program might be a very good fit for you. I hope this video helps and please keep us posted as to your situation.

Agreed, to my knowlege at this time no one has ever been sued over the use of a single image.  The burden of proof is on them not you to prove you do not have rights to the image.  I would send them a letter stating you had purchased the image and you consider the matter closed.

I found this article over on fightcopyrighttrolls.com. This looks to be big news and has the potential of either greatly helping or hurting our fight with copyright trolls. Recognizing the copyright trolls tactics a Pennsylvania judge has decided to take the trial one of the copyright trolls to test is evidence using five does who had filed motions. Unfortunately it is punishing the does for filing motions but in my opinion the results of this trial could be a setback is big for the P2P trolls as the child the case was for the stock photo companies. By definition Bellwether is an indicator of future trends. Courts utilize a bellwether approach when large numbers of plaintiffs are proceeding on the same theory or claim and there is no other feasible way for the courts to handle the enormous caseload. This approach has been used in many cases including asbestos litigation. A group of plaintiffs are chosen to represent all the plaintiffs. The issues for trial should concern common claims or theories among all the plaintiffs. These representative cases go for trial and the results act as the bellwether for the other plaintiffs’ trials. The verdict from this grouping is extrapolated to the remaining plaintiffs’ cases. The actual results may be utilized for valuing groups of claims in settlements. The plaintiffs can also choose to continue with their own individual trial

Agreed, I am currently following up on the story I mentioned above and should hopefully have some new information to post very shortly. It appears as result of this companies business model even when they were a public company it resulted in stockholder suing them and photographers suing them. It will be interesting to see where this research leads.

Just reading this stuff makes my skin crawl.  Good work finding it Greg! 

I have now come to the conclusion that all the mean and nasty things Robert has said about Getty over the years were the work of a gentlemen being way, way too kind.

These guys are scum.

Here is an article which is another win for our side found over at fightcopyrighttrolls.com. Of course as all the cases seem to be lately this is another P2P/bit torrent porn case and once again the judge has spanked the copyright troll bringing the case and even go so far as to say in his statement that this seems to be a developing pattern of extortionate settlement demands. I love it when the court tells the trolls what they are doing is extortionate .

The Court acknowledges without reservation Third Degree’s right to assert copyright protection of the Film and to sue individuals who infringe on its intellectual property. But after a careful weighing of the balance of potential injustices in this case and like cases, the Court determines that any efficiency gains and cost benefits to Third Degree from joining the Doe defendants in a single action are substantially outweighed by the fairness concerns and inefficiencies at trial, the potential prejudice from what seems to be a developing pattern of extortionate settlement demands, and the evasion of thousands of dollars of filing fees.
