Getty Images Letter Forum / Re: Online Petition Against Getty
« on: August 26, 2015, 07:38:22 PM »

Is there anything we can do vis a vis Masterfile and some of the others out there? I'm glad to see that Getty has dozens of complaints listed on the BBB website but I see next to nothing on Masterfile and it would be very satisfying to see some there.

This shit has started to turn into a major plague and someone needs to start the work to change the law.  I think all of us agree that a "Cease and Desist" would be the logical and ethically correct way to deal with image infringement.  Failing that, then sue all you want.

This is getting close to the breaking point and there's got to be something out there we can work on together to try and end this nonsense.  Surely, right?

The route to take is attorney general complaints,  the BBB can not bring action against the company and the AG can.  Also BBB will kick out most complaints since there is not a product or service that has been sold.  Infringement is not something they deal with.

ELI would like to welcome Julie Hanranhan to our ongoing list.  Ms. Hanrahan is a Getty License Compliance Specialist  based out of the Chicago office and has been with Getty since 2008.  She just showed up in my latest batch of WSAG complaints.

This complaint and all the new complaints will be made available once I have received them all and compiled the data in my on going statistics.

The letters/email were addressed to you, unless you signed a confidentiality agreement restricting the sharing of the correspondence then it is yours and you can do what you want with it.  I published all of mine.

nevermind, I thought that name rang a bell...she's been around the block a few times..

http://www.extortionletterinfo.com/forum/mccormack-letter-forum/my-experience-(so-far)/

I didn't remember the name and didn't see her on the list so I added her.

On another note maybe we should add Scott Wilsdon to the list.  I have a complaint where he was going after a guy on behave of Getty telling him it was his last chance to pay before he filed a lawsuit on behave of Getty.  The company in question was a pest control company.  The problem is both the pest control company and their lawyer both told Getty and Wilsdon that the image in question was on a mock up page from a web design company salesmans pitch. They didn't onw the site, the picture or have anything to do with it but because it had the company name on it Getty then Wilsdon kept going after them even though they had nothing to do with the page or image.  In my opinion it sounds like Wilsdon is trolling to me and should be added to the list.

What do you think Robert?

I will have many letters :) , I am receiving my annual complaint letters from the WSAG, once I have them all, remove the fluff and integrate them into my ongoing statistics they will all be made available.

Once they do not provide the requested proof you may wish to file complaints with the Washington State Attorney General for the lack of good faith negotiations

Getty Images Letter Forum / Re: Getty Images is now also August Image
« on: August 04, 2015, 08:24:08 AM »
Nice blog post, however I tend to agree with Robert.  August Images are a different animal entirely from Getty. August offers celebrity photos which are high quality and professionally taken.  Artist's tend to make sure these images have all their i's dotted and t's crossed when it comes to the paper work end.  This does not means they will come after you but you may want to take their letters more seriously than you would a Getty or McCormack letter.

I have to head out to work so I cant reply in detail but here are some links that may answer some of your questions:

What strikes me as odd is there are predatory pay-to-publish companies that behave this way with having a parent company and secondary and satellite companies that rip off independent authors as well as readers for overpricing books but they try to keep the heat off the parent company. Which isn't illegal either, but it's wrong. So that makes me wonder about the way Getty et al treats their photographers, and do they rip them off too?

I've only received one notice so far. If they send a second (which they probably will) I will take more action. I won't tell the details as I know Getty and their minions reads these forums.

This worked well for me.

I know it's all BS and I have a plan of action, but it still pisses me off. I plan on writing a blog series soon on a different blog about all this copyright racket to do my part in spreading the word and tell other people about ELI.

Publish everything, the trolling complanies don't want people to know what they are doing, the more info out there the better.

They want $610 for a free picture in the public domain which they probably snatched and stuck it on their RM (which it is now) section so they could go on their jihad. Something stinks.

If this is the case you can tell them to pound sand and forget about it.  Make sure it is a PD image first.

I would agree that you don't need to do anything yet as this letter is still from Getty/Science Photo.
