also Bill Frymire's images were bulk registered in the US in a CD format.  This format has been called into question and will likely not hold up in court again.

Great point there!! after Masterfile took that ass beating with Chaga International, it makes it even more unlikely they would file suit over this.. did I mention what I thought of Geoffrey Beal?

Geoffrey beal is an asshole in my humble opinion... As we've told you before, they won't sue you, and if they did and they won, you have no money, they have nothing to gain either way... You've acknowledged them once and got the expected response...I generally don't advice to ignore it, but in this case i' am going to advice just that..you have nothing, apparently they only have an email address for you, so you can't be "served"....If i were in your shoes, I'd delete the email block the email address from my email progrom, and go on with life..

You have inspired me to write and fight! Thanks to all contributors but especially to Greg, BuddhaPi and Mulligan along of course with Oscar and Matt . In addition to the Bar associations I'm also thinking about separate letters to Michael Berens and Ken Armstrong 2012 Pulitzer winners at the Seattle Times for investigative reporting. The paper has a long history of good journalism and truth seeking and could in fact tell a larger story of just how the issue of photo copyright infringement really works and who the real winners and losers are. Shedding light on just how the McCormack/Getty relationship really works! Stay tuned.....

Certainly a good idea with the newspaper, and a novel one, however I'd be willing to bet that that papers uses Getty images, and they won't go near it...just my 2 cents, but hell give it a shot!

Yeah the "fee" doubles so Seattle copyright troll Timothy B. McCormack can take his share which in turn helps pay the salary of the "Mistress of Misrepresentation" Ashanti Taylor, who claims be a paralegal..As Oscar has pointed out you notice from Timothy McCormacks bio, he doesn't have many clients except for Getty, it's his bread and butter, much like Linda Ellis only has one poem to her name, hence she sends out many letters, and sells cheesy Chinese made garden gnomes.

It's interesting that McCormack didn't sign the initial form letter. I wonder if that was an oversight or it he's distancing himself even further from the paralegals who do all the work so they can take the potential hits when somebody finally stands up to these people and files a countersuit against them.

Well even if he is distancing himself, if a suit were ever filed along with a counter-suit, he would still be involved, the paralegals work for him, he is ultimately in charge of overseeing them and their behavior..at least thats how I see it..

There are second chances in life, though; and Righthaven got one yesterday. The company's new lawyer, Erik Syverson, argued that the US Court of Appeals for the 9th Circuit should overturn Righthaven's losses in two cases: the DiBiase case, defended by the Electronic Frontier Foundation, and the Hoehn case, defended by Las Vegas attorney Marc Randazza. Yesterday's case is the first Righthaven case to be argued at the appellate level.

Sorry, Jimmy. Your charming homework tale of holiday hi-jinx is no longer your property. This is the strange scenario concerning folks after Prince George's County Board of Education in Maryland proposed a copyright policy that would result in the board owning the work created by both staff and students at schools in the region. The Board Chair Verjeana M. Jacobs has said it's not the board's "intention to declare ownership" of work done by students. But some are wondering why a policy ostensibly meant to guard against teachers selling on lesson plans created for Prince George's County schools also covers what the students create.

I'm surprised by the common acceptance that Getty's position is legal. They're accusing you of infringing their copyright without offering proof that they possess any such right. Who knows whether they do or not? I'm not in the US and I don't know US law, but I'd guess that if they don't have the appropriate license, the accusation and payment demand must be very illegal indeed.

It's a given that they operate unethically, and that lack of ethics could easily extend to not checking their facts before firing off a demand. It's happened before (35 times in a single case, if I remember rightly). At best, surely, their position may be legal, but without proof you can't possibly know.

valid point BeanPole...however doesn't much matter if it's legal or not, cause none of these cases ever get to court anyway...and if it did, and it was shown they ( Getty) did not own the image(s), yeah they'd be in hot water...which is a big part of the WHY they don't sue..
