As some of you already know, there was a bit of legal drama for me today.

On Feb. 13, 2013, Linda Ellis (Author of The Dash Poem) drove 2 hours to Columbus GA and personally filed a stalking complaint against me.

The papers were served to me today by a Deputy Sheriff.  There was no drama between myself or the Deputy. It was entirely cordial. He did a mandatory reading of the order which was fairly clear and understandable. Quite frankly, most of it was easy to follow given the fact that Linda and I have never met, spoken, faxed, or exchanged emails. I have also never come close to driving to her house or neighborhood.

A "Stalking Ex Parte Temporary Protective Order" was delivered to me.  A hearing has been set for Feb. 28, 2013. I am required to appear before the judge.

Her central complaints revolve around so-called "death threats", the posting of her and her family's personal information (all publicly accessible and Google indexed), April Brown's forum topic title "we are coming after you", and the open discussion of driving by her subdivision to take a photo of her house.  Keep in mind these are HER complaints and HER interpretation. Clearly, I disagree with these complaints.

Linda Ellis exaggerates, takes sentences out of context, and basically twisting the truth.  Linda is trying to hold me accountable for the disagreeable content on this discussion forum.

My team has been contacted and received a scanned copy of the court papers. So there will be a lot of brainpower at work.

However, in the days to come, I will be asking my supporters and the ELI Community for financial contributions, testimonial letters, recommendation letters, extra eyes and ears, and help to reach bloggers and the press to cover this case.

Thanks to SG's referral, I found the Glassdoor employee reviews of Getty Images, Corbis, and Masterfile quite enlightening.

Clearly, there is a lot of internal strife, turnover, turmoil, and morale issues at Corbis. You will never read about this in any of the trade rags but thanks to Glassdoor, we get clues as to how badly Corbis seems to be doing from the inside.

Regarding Getty Images, morale is a little better. Some comments about the recent buy-out and being managed by a private equity firm.

I found one comment particularly enlightening.

I get quite a few requests for an ELI Support Call each month. Some months are busier than others. While most are focused on Getty extortion letters, there are several that deal with non-Getty letters.

Regardless, most ELI Support Calls go fairly well from the Paypal payment process, the initial contact, the extortion letter & other document submissions, the scheduling of the actual call, and, of course, the support call itself.

The ELI Support Calls as initially designed (and still implemented) all occur within 30-minutes. Once in a great while, the calls exceed 30-minutes but I don't make a big deal out of it.  As long as the caller has a clear plan of action that is best suited for their personality, and their situation, I am happy with giving someone a few extra minutes.

While there is certainly time for some customized free-style questions, callers don't run the Support Calls.  I do.  The reason for that is that most callers don't know what they don't know and I don't let them waste valuable time with excessive story-telling, justifications, or random/pointless questions.

I drill down quickly to understand their story, situation, their risk tolerance, their expectations, and their desired outcome. Essentially, I interview them.  Callers don't interview me.

Additionally, the calls are fast-paced and we move through the various issues very quickly.  This is not a "shoot-the-breeze" session.  I have a job to do and I get down to it, I don't let their irrational or misguided concerns, whining, or emotions, slow things down. I give as much latitude as possible but if it is too much or goes too long, I give them a quick wake-up call to stop the irrationality.

Part of what makes me so efficient at these ELI Support Calls is my prerequisite of making people scan in ALL their documents (extortion letter, attorney letter, emails, mailed correspondence, etc.)  I want to see the entire document and communication trail BEFORE I even pick up the phone to call.

I do so because I don't like surprises and I don't like gaps in my assessment.  I notice very small details and nuances that most people would never notice. I also look for minor updates and revisions of prior established documents.  This is one reason why ELI can report so accurately even on the smallest changes in the various extortion letter programs. When I personally receive a copy and review it myself, I know when I report it, it will carry a lot of weight and credibility.

Essentially, the prequisite document submissions prior to an ELI Support Call with me ensures that I have ALL the relevant information, prior negotiations, and communication stream. It ensures that they are immediately ready to deal with Oscar Michelen should that next step be recommended (Oscar requires all documents and communications be submitted to him also.) There is also a small amount of "pay it forward" to others because I always take any new information, updates, and insights and roll it forward to others.

To date, it has been a great system. It is generally the best 30-minutes letter victims have received because I cut through all the bull and get to the heart of their fears and concerns and acknowledge them very quickly.

Unless you happen to be a pushy and clueless bimbo I had the misfortune to encounter and subsequently refused service, turned her away, and refunded the money.

I even told her it was an intimidation tactic regarding the deadline issues. But since she paid her whopping $59, she thinks I am going to call her immediately despite my flu-stricken state?  Translation: Too bad you have the flu but call me anyway and I don't believe you when you say they are using intimidation tactics.

We've had an attorney correspond with the McCormick law firm and they have now asked if the attorney can accept service on our behalf.  Are you familiar with them asking this?  Seems like they are or want to appear to be taking It pretty far.

What you need to do is stop listening to people who THINK they know more than we do at ELI.  You also need to  CALM DOWN. You clearly have no idea who or what you are dealing with based on your comments.

I told you I would try to call you back tomorrow afternoon and that is my intention. If that is insufficient, then I will refund your money and you can then go spend $200-$400/hour to a lawyer who MIGHT have a small clue on what is going on and who WON'T save you money.

I was under the impression that we could simply discuss the situation and that not all of the documents were needed.  There is a year's worth of correspondence that can be summed up in 5 minutes.   If you really need them, I can get them.  However, our attorney will be very hesitant to send this documentation without some sort of vetting process. 

If at all possible, can we just discuss without digging through all of the info?  Is there something you're looking for in particular?

Since it is too inconvenient and you need to get permission from your attorney over YOUR letters, I don't think I can do a good job for you.  The fact you have used a year full of letters shows me how little you and your attorney really know.

ELI followers know this is not the first time ELI has had to deal with bogus DMCA takedown notices. We have successfully restored nearly every document that was taken down. I expect this will be no different.

Presumably, the folks at Copyright Defense League (Dan B. Levine and Randy G. Taylor) thinks they have actually accomplished something with their DMCA complaint to Scribd. They will soon see this will backfire on them.

Copyright extortionists cannot cover their tracks this easily. I have made a formal request to Scribd to disclose the identity of the original complainer and will post those results once I receive them.

I would say that Glen has been more honest in this article than I have ever seen before.  The one thing I can respect about Glen in the article is that he acknowledges the "reality" of the situation, conflict, dispute, debate.

Dealing in "reality" very much agrees and resonates with my personal and professional sensibilities.  If you can't win the philosophical debate or the opponent refuses to accept your arguments, bringing it to "reality" can be an ice-cold splash of water to the face.  Glen has mostly certainly learned "reality" the hard way, and I think his peers in the business best start listening to some of his advice and pay attention to his first-hand observations.

I would like to say that I think more was gained than lost by David Walker's article in PDN. Having communicated with David before agreeing to the interview, I believe David was doing his best to give a balanced view.  If there are any perceived imbalances, they were well within my tolerance sensibilities.

When you engage the press, however small, you have to assess whether their will be a net gain or net loss from participating. You also have to assess whether the reporter/writer is trying to do a fair job with your position. It is unreasonable to expect for any reporter/writer to entirely support your position.  I knew this going in.

Certainly, there was far more interview material I gave than made it into the article. But I am satisfied that my position was balanced enough to offset the propaganda offered by the opposing side.

If David were to contact me again to do another PDN article on any follow-up issues regarding ELI or ELI involvement, I would certainly participate again.
