Getty Images Letter Forum / Re: An Experiment Against Getty
« on: February 01, 2013, 03:38:44 PM »
Not that it matters, but even if you did "find" this person who gave you the flyer and even if this person licensed the image, Getty wouldn't care, the license is non-transferable...meaning you still are in the wrong to use it..just another example of how people get caught up in the whole mess..

I have noticed that Getty Images over the last few days has been using proxies.  Though I have a thorough listing of thier IP addresses, the other day I noticed I could still access there site though it is blocked by my firewall and using nslookup, I saw that they were using different IP addresses.  5 minutes later, it was back on the usual IP addresses.  Now using domain name to block, but they will figure a way around that too.  :(

Did you mean picscout or Getty Images??  Getty doesn't crawl sites as far as I know, picscout is the culprit there,  but Getty does own picscout..

This isn't about copyright. These scumbags don’t care about copyright infringement. They're just interested in extorting cash under the guise of copyright infringement.

We stopped buying from them (as I'm sure most others like us have) due to their recent ridiculous cost increases. With this behaviour of theirs, they are not even worth the risk of buying and using their stock photos for any purpose. I don't even feel very safe buying and using pictures from bigstockphoto because of them. I'm encouraging customers to avoid bulk outlets like this as traps, and use custom art from local freelancers.

Artists trying to make a living should take notice.

I digress... would blocking these IPs in .htaccess prevent them from impacting server resources?  I assume they would completely ignore robots.txt.

you assume correctly, robots.txt is a waste of time in terms of picscout and other scrapers/bots..it will be a never ending process..blocking the IP range picscout uses via htaccess will work, until they switch up the ip's they use, and this also won't do anygood if they use proxies..

You can retain Oscar on your clients behalf but neither of you will get updates every couple of weeks. You will get a letter sent to Getty, and a second response if needed...at which time you might here from Oscar's office is there is a change...no news is good news.. If you want updates ( which there aren't any)you can probably plan on paying full price.

I can just about guarantee people will answer his questionnaire and send it to him...most will do it out of shear ignorance, others will do it believing they are "doing the right thing", and some will be "in the know" and respond with sarcastic,  meaningless, and wise ass answers...

Where is the "LIKE" button? Sometimes, I feel such a strong emotional need to "LIKE", and there's no button there!

there is a like button...2 in fact....directly under every post!!

IF they were to serve you, it has to be done in person, not certified mail...they actually have to pay someone to do this, usually an off-duty cop or deputy...keep in mind Getty has NEVER filed for 1 or 2 images...you case is no different from the thousands of others, so it's unlikely they would select you to be an example...

Robert...this is priceless!!!!....at the present time my copywrite attorney (family member)....is chewing Mustoe up and spitting him out and feeding the vile spew to the resident Kansas pigs.  Stay tuned...when the hogs finally ingest this and become sick themselves, I'll share.

Please do keep us posted, I'd love to see a play by play if at possible when all is done and over with...

Many companies that provide templates use freelancers or contractors to make their product.
Sometimes, these third parties use images that they haven't paid for.

S.G.

Very good point made by SG. I've also seen in the "fine print" of some template site an escape clause of sorts, releasing them, should an issue arise..Also Template Monster settled with Getty a few years back, and there have been reports of the TM ignoring customer complaints, as well as reports of them standing up for their customers.. I also used images from a purchased template, but Getty didn't care, they just wanted my money....they got exactly ZERO dollars from me.

Sorry but i'm not buying into this "theory".. There may be some sort of rhyme or reason why picscouts visits servers when then do, but I highly doubt it has anything to do with CNN or when someone licenses an image..My guess is picscout scans IP blocks, but I can't confirm this. I've been watching for a pattern to emerge, but nothing has come to light thus far..Then again if the people running picscout are as disorganized as Getty, that would be very telling.

That was a pretty catchy, sing-songy version of Sir Mix-A-Lot's rap hit "Baby Got Back" in Thursday night's episode of "Glee." It was also very familiar to fans of indie singer-songwriter Jonathan Coulton.

Because Coulton's cover is derivative of the original work by Sir Mix-A-Lot, Coulton does not have a copyright claim against "Glee" for using the Coulton version, Parks said.
Covers don't get their own copyright protection as far as the underlying musical composition, Parks said. But Coulton might have legal footing if the show used Coulton's audio track.
