tell them this is a claim not a debt, they are required to send it back to Getty, tell them if they contact you again you will report them for misbehaving and not following the laws regarding the fair debt collection act ( or whatever it is called), they have no standing...then prepare to get a letter from ass hat seattle attorney Timothy B. McCormack....easy peasy..

If I'm reading this correctly, Atradius Collections Limited is misrepresenting itself as being legally sanctioned to collect debts when in fact it is NOT licensed to do so.

Thats how i read it as well...shocking!!

this would probably be a worthwhile addition to our library of documents, I'll be sending you a PM with my email address, if you would be so kind as to scan and send me the entire document.. Perhaps you would also consider sharing your letter to the OFT as well, so it will be one neat little package..I will certainly redact any of your infomation ..

we understand the stress associated with veiled threats of litigation, make no mistake we take this very seriously, while at the same time interjecting some humor whenever possible, especially at Getty's expense!, Once you get passed the stress part, you'll become pissed, and you'll get thru that as well..we've all been there at some point...as much as I seem to joke and poke fun at these a-holes, truth of the matter is  that it still pisses me off to no end..hence i'm still here fighting the good fight....plus peeved is here too  ;)

there are plenty past the 3 yrs...not much in the way of "play by play"...Getty sends letters, Getty recruits NCS to send leters...when they get shot down, Getty recruits Asshat Seattle attorney and his "mistress of misrepresentation Ashanti Taylor to send letters...eventually you reach 3 years.. same story different images and targets...

and just to be clear, Gregs' case has not yet reached the 3 year mark, so his case is not technically finished, although it's the general consensus that he won't be hearing from them again, but he did address the issue just a wee bit more aggressively than most...  ;D

"penalty"???? no it's not a penalty!! or a "fine"....it's a bullshit claim....they don't care if it came with a template, they don't care if your Hd crashed...they want your money PERIOD. They have NEVER sued over 1 image... My case from start to finish..

I have a license for the image, they threatened me as well, I hired Oscar to draft a letter, heard from them once with a "lowered settlement offer", I declined....the 3 years came and went...end of story..

generally speaking the other stories are basically the same, people either pay them to go away ( thus letting Getty win) or they don't pay ( some hire Oscars services) those that don't pay simply wait for the 3 years to pass and it's over with..

Yes, I concur that Stinger and Buddhapi.

However, I doubt that Getty/Google have set out to "seed" images in order to induce infringements.

I'm sure that the average person may assume that the images are akin to "free clipart", and use them for other purposes.
Getty trolls the Web 24/7 looking for "copyright infringements", so it's logical to assume that the images in question could become part of the problem.

According to Getty, these images are royalty-free.  Traditionally, Getty hasn't pursued infringements for its royalty-free collections.
But, let's keep an eye on it...

yes "royalty Free" containing models, and contributor family members without model releases.. Getty really screwed up with this little project... They pay Joe photog a whopping 12 bucks, I come along and use that image that just happens to have Joe photogs aunt Linda in it.... Aunt Linda now becomes my spokes model for a the latest and greatest anti troll butt cream... sorry photog getty paid you, Aunt Linda should be proud!

I've been running the same scenario around in my head that Stinger mentions.. I'm a google drive user, and also creates docs within google.... I could easily see the following happen..


I "create" a doc in google doc, and insert one of these images, which says I can do for "commercial purposes" I then save my google doc as a pdf and throw it up on my site.. I'd be willing to bet Getty or the artist will come knocking..As far as I'm concerend I'm in the clear, the pdf came from a document that was created using google docs and google drive..just a matter of time before this becomes an issue, unless Getty backtracks and removes these images and pulls out of this "contract" with Google...

@S.G. I fully support some sort of FAQ, but I don't support wasting ones time creating it, knowing that most newbies are just going to post the infamous question "got letter, now what?"... I think maybe a better approach would be a sticky post containing the "must read" threads, which would cover anything that would be in the FAQ, plus other general stuff, then when we get the newbie question we can simply reply with a link to the must read stuff..
