Mathew Higbee is not very smart, and he's probably better served to continue expunging speeding and red light tickets, he apparently doesn't know all that much about copyright..What a moron..

It's worth noting that Higbee knows I'm not hosting the image because, in their letter, they mention "infringing webpages" and give the URL to the page on my blog displaying the image and, right beneath it, they mention "infringing file locations" and that URL is http://images.barnesandnoble.com/images/XXXXXXXXX.JPG.

Is it worth filing a complaint with the CA Attorney General's office?

I would file a com plaint with the  CA attorney general, your states AG as well the Califoriai Bar Association and if he is licensed to practice in your state that Bar Association as well...just remember he will know who complained.

Links are NOT considered to be an inffringement! If you did indeed link to the image, and did not upload it to your servers, you are free and clear.. With this being said If I were you I would quickly respond to Higbee, and cite Perfect10 v google and tell him to to pound salt! I actually would not say it that way, because that's way to kind. I would love to see a copy of this letter as well as the offending site (to look at the code )..

You are correct as far as the safe harbor issue. I'm sure the Russian equation probably comes into play as well. Getty and the many pther trolls looks for low hanging fruit, that will scare easily and cough up cash.

Getty probably hasn't filed any suits in 2017, it's been a losing proposition for them for the most part.. another thing to consider, is that if the site in question has a registered agent, and they have registered properly, they would have safe harbor from infringement letters providing they follow the guidelines when presented with a dmca takedown notice.

Getty does not vet anything, we have seen instances of people getting a getty letter, when in fact they had purchased the license from Getty. We have also seen getty send letters for public domain images. Without not knowing more about the company you reference, it's hard to say why they haven't heard a peep from getting, my assumption is that if it is a new site, most of the images used would most likely fall under fair use.

Thanks, but a district court decision where I couldn't reasonably be sued in is of no value to me.


If you were sued ( which is unlikely) that case could certainly be quoted by the plaintiff for consideration. IMHO whats more important is the value the artist sets for the image. Provided you did not make huge profits and had little traffic to your site, this would speak volumes to judges.

The timing is important, as it shows you did infringe, since you purchased a license afterwards. The good thing here is that by you purchasing the license afterward, it shows that the image is only worth $10.00 in the eyes of the artist himself.. Any judge that sees this ( which they won't) would probably snicker at Youngson and Higbee, then send a clear message to them to not file these BS lawsuits..

personally i would not respond, leave them hanging, they most likely won't file suit for this image, it would cost them nearly 500.00 just to file the papers, and their letter pretty much states the image in not worth much more than that.. ( actually the image is probably worth much less than they are demanding.. Most themes from themeforest state in the fine print that the "dummy content" including images is for preview use only, and many themes don't even include imagery when purchased, because licenses are non transferrable.

How is it your problem?? well because you used the image, ignorance or "not knowing" won't cut it, so if you respond, don't go down that road, they will quickly shoot it down.

a suit can be filed, regardless if the image in question is registered. Registering the copyright with the copyright office affords the creator with more options in regards to any monetary rewards.

statute of limitations is 3 yrs from when they ( Getty) first contacts you... if the are trying to collect 300.00, it's highly doubtful they will file suit, as it would cost them more than that to simply file.. and since they are demanding so little, they have basically set the price of the image..they would probably lose in court, while pissing off a judge.

Can't really see anything without registering for an account. However, the information you have to give to register for an account is too invasive for my taste.

I found this which lists all the changes his operation goes through since it is almost impossible to keep track of the turnover. Looks like he started out doing bankruptcies. If you want to track people that leave their jobs check out the multiple twitter accounts they have, they list jobs there. One copyright case manager only lasted a few months before they were hiring the same job again.

Youngson would have to give Higbee the okay to file, which i doubt he will do, based on the fact that he's in the UK and won't show up, and based on the fact that his honeypot experiment has been exposed. I think the odds of him winning a lawsuit would be very slim at this point. Higbee will continue to attempt to extract monies with the veiled threat of an impending suit to get whatever he can from those uneducated. Such a slimeball Higbee & Associates

I wonder how Higbee feels, becoming the new Tim McCormack of the copyright-trolling world? Maybe he should contact Timmy to see about partnering in the drug business.
