Wow, that brings back a lot of memories! I was the SysOp of a two node BBS called The Wonder Board BBS as I was a tile setter at the time and wonder board is a cement board put down that tile is installed on.

Just curious what BBS software you ran? Was it PCBoard?  I ran GTBBS software on a single computer running DesqView (multitasking software). Next time we talk on the phone will have to talk about our SysOp days

Don't know if i'm an oldie but I was a sysop for a 6 node BBS back in the day...I can hear those old 14.4 modems screeching right now!!..I still see references of it online now and then via fidonet..."The Dirty Diaper BBS"..thanx for the flashback!

I ran syncronet and VBS, there was another on I can't remember at the moment...I also remember this was the start of my programming / coding career, started with learning turbo pascal and soaked it up like a sponge...can't remember any of it now..

correct, thats why we always ask for proof of registration..we know getty doesn't register their images, and therefore would not be able to collect these big sums..maybe 200.00 if they were lucky...this is all well documented in the forums..

Why does the ELI Community even exist and why do ELI Community members hang arouned?  Why do the ELI "regulars" stay regulars?  Are you here because you want the latest news and information?  Are you addicted/do you enjoy the drama that comes up now and again?  Are you here because you are among friends?  Are you here because you feel passionately about the cause that ELI represents? Are you here because you feel you make a difference?

What is it about ELI that keeps many of you coming back?  By rights, most of you no longer need ELI's help or services and yet many of you do come back.

A lot of GREAT information; peace of mind when you get the letter and subsequent letters and/or e-mails and some place to vent frustrations where you don't get pounced on since everyone has been or is in the same boat.  Oh yah - A LOT of hand holding by those more knowledgable who are willing to share and guide you.

Honestly the only time I've ever found a community like this is waaaaay back in the old BBS days when I'd spend hours on Citadels (if you know the terms - you're an oldie like me [I'm not a computer geek]) and with other SYSOPS trying to figure stuff out.  We were all learning and it was all pretty new and everyone helped everyone whether they were in the same city, country or anywhere else in the world.

if you replied to them via registered mail would not reply via email, let them put some effort in...you could easily change your email address, or simply reject anything from getty and return it to them using a filter...

That's a great point about attaching conditions to our offer for anyone in the future.  I also wanted people to know that Getty does also, as it appears, accept offers lower that what has been typically posted.

desperate times call for desperate measures...

Look at it this way, Getty sends out x number of letters...xx amount just cave and pay, xx amount completely ignore..xx amount negotiate down...something is always better than nothing..i still prefer giving them nothing or at the very least making them "work & earn" anything..

you might want to draft a compaint to the washington state attorney general as well, and mention not only Getty images, but Dougy Beiker as well..Naturally he sent you a form letter, clerk are just that clerks, they read from a screen of answers, follow the corporate BS as set forth by Lisa Wilmer to a tee and hang around the kool-aid fountain during breaks..

"escalation to their Legal Dept" is almost laughable at this point in time. I can only assume they are referring to Timothy McCormack Seattle Attorney and Getty outside council...he is continually the butt of jokes around here, and has very little respect from any of us..

Steve, shit happens to all of us, and we do what we need to do, so don't be embarrassed..I tell people there is ALWAYS something positive in everything that happens.. In this case you can use it to your advantage..which is a positive..someday you'll look back at the Getty letter and see some positives as well!

You're probably correct in your assumption, they'll take anything at this point as opposed to nothing. this basically says that getty will really accept as little as 112.50, as collection agency's generally take half.. ( I think )..

If it were me they would not have gotten a dime without providing proof of ownership, and I certainly would have send NCS packing. But if you are satisfied that is all that really matters.. Glad it worked out to your liking.

Many web developers enlist the Letter Defense program because it means your client would not be contacted any further as Getty would have to write my firm instead of the end user. As you can learn from perusing the thousands of posts on this topic, Getty will transition to letters from a company called NCS to eventually its preferred lawyer Tim McCormack for a total of about 6-10 letters and emails and occasionally McCormack's office will also call.

I'd personally love for the copyright cow to call me, but I don't think he likes me very much..much like Glen Carner didn't like me very much...which is too bad, cause I'm a nice enough person.. ;D

I have never heard of Masterfile going down to $500 so quickly, so I suspect they know they have a weak case against you.

Or they are hoping that by lowering it to 500.00 Oscar won't get involved...I'm sure they are still a bit sore from the last whipping!  8)

Welcome to the family Steve!

This will be real easy...they won't file suit over 1 image, besides you already stated you've filed or will be filing chapter 13...once they know this they will move on, they go for the low hanging fruit and those that just roll over.. If it were me I would send them a letter ( US mail) not admitting any guilt, that you removed the image, and are currently in bankruptcy proceedings, show proof of this if possible...at that point they should realize they won't get anything and leave you alone..hell I wouldn't even go any further than this, generally we recommend you ask for proof etc..but I see no need in this case...

I do have some questions about this cd you purchased, do you still have the CD, and more importantly does the cd contain any information about the use of the images contained on the cd?? not only cold this seal your case, but it could have reprecussions elsewhere..
