more importantly you need to STOP getting images from google or bing..or anywhere else for that matter. (unless you create them or purchase them)

I certainly wasn't trying to dissuade anyone, i was just stating my opinion. No matter how one looks at it, or how we fight it, it will be an uphill battle for the long term..the more idea the better.. Again I apologize if i came off in a a negative way..

welcome Jot!! your mission is a noble one for sure, but you're thinking "may be" flawed in several areas..

a. Picscout operates out of Israel, and does not follow the laws of the US. Getty may own it, but it's a separate entity...
b. in order to access a computer without authorization, the machine in question would need to be password protected.. I don't buy into or surmise that "any computer connected to the internet is protected"

It's also worth noting that Getty Images spends  a big chunk of change lobbying the asshats in DC..please do keep us posted in any event..

I did thank them for the fascinating read of the Thoroughbred Software case and in short told them that it had in no way anything to do with their claim. It was all I could do just to hold back from asking them if they had even read it... It was good for a few chuckles though...  :o

well if nothing else it appears "you get it" and you seem to understand what you're dealing with here, which is much better than being crippled by fear and intimidation..which most people are. Just this alone gives you great power to fight back..

The mass-copyright lawsuits brought against anonymous BitTorrent users by porn companies in the past few years have run into legal hurdles. One of the lawyers representing Third Degree Films, which makes movies like Illegal Ass 2, was found not to be licensed. In another case, a New York federal judge blasted  Malibu Media (maker of Veronica Wet Orgasm and Gangbanged) for an "astonishing" failure to follow discovery rules.

At the end of the day, though, it's all about getting the names. Once the lawyers prosecuting these cases can get names of people who they can level their accusations against, they know at least a percentage are going to pay up. It's telling that the sweet spot for mass-copyright suits is pornography; it strongly suggests a strategy of deterring defendants from fighting cases by embarrassing them.

Thank you! That is exactly what I was thinking. I just wanted to hear back form someone fimilliar with these claims. No they didn't mention Chaga and I have not mentioned it to them either. I was saving some ammo to see where they were going with all of this.  As a note they have referenced:

hilarious!! THOROUGHBRED SOFTWARE INTERNATIONAL case has NOTHING to do with stock images and Masterfile isn't even mentioned in the case! and Martin Gale case may no longer be relevant since the Chaga case outcome ( which may be appealed).

I concur it's always good to hold a few items back and not blow the whole wad at once..

my question is why go continue to go back and forth? If you're willing to pay them 300.00, why not hire Oscar, and save 100.00??.. you can just tell them your attorney will be in touch, end of story... I'd be willing to bet they didn't  mention the chaga international case they just lost to Oscar.

I don't think there is really a good way to plan for something to go viral, it just happens, and one has to be in the right place at the right time..i'm not a huge twitter user, but that where I would focus my efforts and i would target users that have large numbers of followers, in the hopes they would retweet it.. I also think Matt Inman would be a good source to help us get the word out, but he might be a bit busy again..

Hi Robert, no offense taken. MF did send me the documents: with the name of the artist in header, the image is right-managed.

Now, ive read in a previous post (Ref.: How many got sued for just one image) that the Oscar Letter Program can also handle Masterfile case from Canada. Is that true?

if the domain in question is the one associated with your email address, then you do not own the domain from a legal standpoint, regardless if it is in your account..the whois record indicates a completely different owner. Which could also be considered to be inaccurate whois, which could cause other issues as well with ICANN. If you don't want this other person involved, you might want to update the whois to show the proper info..then go from there.

he is probably the "legal" owner of the domain name if his name appears as the registrant on the who is..chances are good getty may not want to even deal with you, as we have seen this in the past..

::EDIT:: Ultimately the domain owner is responsible, is what Getty will claim, thus taking you out of the picture and dragging another party into, in the hopes that they will roll over and pay..

It doesn't have your name on it??!!
little hard for them to collect from you then...return to sender comes to mind.. Clearly you have an "out" here. The site was owned by someone else who may have been responsible for using the image. You purchase the site...completely innocent infrinement, IMHO you re in a good position here.
