I don't think anyone is advocating dead silence or outright ignoring the letters.  There is a middle ground somewhere.  Mine stopped at the 2nd letter and that was that. It was never escalated.

But there are some people who want to keep the dialog going with the rationale that talking about this will make riding out 3 years easier. Whatever, to me it becomes a waste of time at some point.

IN the end, everyone gets to choose what is best for them.

For the media, I am not a fan of "copyright troll" term.  In fact, I may change that in ELI's positioning statement.

"ELI reports on and fights copyright extortionists, copyright blackmailers, extortion letters, and shakedown letters."

Copyright trolls is a term very few people outside the Internet will understand.  I would use "copyright extortionist" or "copyright blackmail" for general media. Everyone understands what extortionists and blackmailers are.

For some reason, there are people who feel compelled to answer the phone everytime it rings. And likewise, cannot hang up the phone without the approval of the other party.

It is true that all this talk about recording phone calls seems to be a waste of time. However, this all started with my comments to Glen Carner and his "new" phone program.

I tend to agree, just hanging up is the way to go.

I also agree with Jerry that at some point, you have to draw a line in the sand.

By admitting this, even the whole $200 for innocent infringement is off the table. Now, this is about actual provable damages which is going to be very difficult in most small cases.

She's gonna get fired for that. lol.
I'm serious.

You guys know that she just let somebody completely off the hook, right?

I would say that Nancy wasn't too smart in writing that message. This only confirms what we already suspected and know to be true about Getty's habits.

Oscar and I are media-friendly and interested in this.

Postal mail carries more psychological, symbolic, and legal "weight" because it takes more effort to send.  Additionally, It is officially recognized as legal communication. This is why lawyers and courts use them in matters of serious communication.

The "package" of your message and words often matters to great effect. But the user has to know how to use it.

I've seen this written a few times that postal mail is preferred over email.  Not sure why this is - is it because emails may sometimes get spammed or are emails still admissible when it comes to court?  Thus far I've used a combination of email and letter when corresponding to Getty as they have also done the same.

I made a mistake in saying only Oscar got a copy of McCormack's letter. I received mine today from Attorney Timothy B. McCormack. However, I will be starting an all-new thread once I post my copy of the letter.

Matthew Inman's response to the Carreon lawsuit.

WTF. This just gets better and better.

Carreon has filed suit against Inman, IndioGogo, National Wildlife Federation, and American Cancer Society.

The Internet is catching fire again with this guy. Charles Carreon has got to be one of the most hated lawyers on the Internet.

Lots of news stories jumping around.

We will see a live case study of how well a hated lawyer can stand up on a losing case and live to tell about it much less have any sort of meaningful  professional reputation after this is all over.

If after 30-60 days, there is no refund check, then this is worthwhile to report on. It might show a sign of some behavior change in that they will take the money "something is better than nothing".

I just received another Getty extortion letter with a sales tax amount tacked on. This time it is from Colorado with a tax rate of 4% being added.

We now have a Texas letter with 8.25% sale tax and a Colorado letter with 4% sales tax.

I have a working theory of this new sales tax thing but I want to see if this is going out to most of the 50 states or not. I am not revealing my theory at this time until I have some confirmation.

Funny, I thought about asking you where he was at. He was given until June 30, 2012 to keep posting. I figured that would be more than enough time. However, he might be put off by the fact he was given a time limit.

Whatever his reasons, if he disappears on his own, that is fine by me. However, he still has plenty of time to say what he needs to say.

Where is Glen Carner? He promised to participate on these forums DAILY and address questions such as this. I know there was talk about banning him (or charging him to post). But my understanding was that there was a stay of execution offered. I expected he would take advantage of this time to answer questions such as those asked by Activated.

No to splash cold water on anyone but let's wait 14 days and see what happens. IN the past, someone sent in a check and it was later refunded or returned.

I find it unlikely they will give you anything in writing. At best, I am guessing they will quietly go away.
