Most people in our world

Greg,

It takes great courage to come out publicly. I commend you for it. I think it is safe to say you are the 5th person in the ELI community (after me, Robert, Jerry, and April) that has decided to make a stand. We stand by our business reputations and stand by our positions against copyright extortionists.

Because you have revealed your identity, it is safe to say ELI will support you if there is any retribution by Getty. I already have an action plan of who and where to target should that day ever come.  Not everything gets posted to these forums.  I do keep some things in my back-pocket just in case.

I cannot imagine they would do anything stupid against you as you are involved with ELI and you now have a direct phone line to me.

I am hoping I can get Greg to do a video interview with me within the next week or two. It should be fun.

Oops, I didn't meant to leave you out here. But I figured with the huge pay and benefits you get from ELI, what more could a guy want?   ;)

I think people should also know that I sometimes bust my ass doing research and graphics, but I get paid much more in satisfaction than money could ever provide!

This is my guilty conscience talking here since I started the whole ruckus about recording phone calls. Obviously, Glen Carner got a bit ruffled up about the idea and now Timmy McCormack.

You might be referring to me but I am not sure. My guilty conscience thinks you are referring to me and you are trying to keep me out of trouble.   ;)

I have no particular reason to record anyone at this time BECAUSE I AM NOT A VICTIM and no one appears to be gunning for me directly. I have not even dug into Timmy on a personal level like I did with Linda M. Ellis of the Dash Poem extortion fame.

But if Timmy (or anyone else) ever decided to come after me for frivolous reasons, I am going to call and follow in the footsteps of Matthew Inman of TheOatmeal.com and see if I could make Timmy the next Charles Carreon. (Go Google this, it is big news and Inman is from Seattle!) 

My very first dollars I spend on defense will be to Matthew Inman or some cartoonist, NOT a defense lawyer. I would then spend money and issue a ton of press releases to invite the media to cover the story. The defense lawyer thing comes later but I would probably defend myself. If I haven't alienated or run Oscar off by that point, I might even ask him for a favor for some tips and guidance.

Because I am such a fame-whore and media-whore, it might be worth going to jail a couple of days. It might look good on my bio and resume.  (BTW, Linda Ellis accuses me of wanting fame and notoriety and that is why I talk about her and her poem extortion. It couldn't possibly be because I think that $2500 or $7500 extortions for sharing a poem feels outrageous to me.)

Here's the thing. You already know that "the copyright cow" probably doesn't like some people. And he might not mind "getting" some people. If you taped him in violation of laws of the State of Washington, and he found out, it would not be surprising if he tried to use the information of that illegal behavior to "get" the person who did the taping.

I already said I, myself, wouldn't tape without asking.  But certainly, I wouldn't tape in violation of the law if I thought it would give an enemy who wants to "get" me an axe to chop my head off. Why give them a weapon?

Let me set the proper context here. My original post had little to do with McCormack's office although they were casually mentioned in my post.  They were more directed to Glen Carner and his new program.

So, we now have an attorney who can't read and interpret properly.  Good thing that post is out in the public for everyone to read.  Sounds likes Timmy has a guilty conscience or something.

You will see that it is MY position on it with the proper context of what I would do. I did not tell anyone to unilaterally record phone conversations on a whim. Nevertheless, I believe there are times in life you do what you need to do in self-defense (or aggressive reporting as I do) to collect the information (evidence) you need.

How many hidden cameras do you see on TV on these news expose's?  These expose's were not done with the subject's permission. The second you reveal you are recording, it changes the behavior of the subject you are trying to "catch in the act". Plain and simple.

Anyone can quote stuff like it's illegal and all that.  Well, so is speeding 5-mph over the speed limit, talking or texting on cell phones in some states, radar detectors in some states, some sex acts in some states, etc. Whether anyone wants to admit it or not people do these things on a "calculated risk" basis.

I interpret the "eavesdropping" law for to deter people from abusing it, not when you are doing investigative reporting or defending yourself.  And how about all the abusive collection agencies calls that have been recorded over the years? I don't think one person ever got prosecuted for recording an abusive call.  It is all about CONTEXT and PURPOSE.

Just like the criminal section of the copyright law, it was intended for other infringements, not the small scale stuff we see everyday.

I am not going to try to convince everyone to record phone conversations because different people have different concerns about this. I state my position and everyone else can state their position. But for those of you who don't want to be bullied or being walked on, this is a legitimate tactic. Besides, what prosecutor wants to be known for going after a little guy over a self-defense recording? Anyone hear of the "Streisand Effect"?

Quite frankly, the fact that McCormack felt the need to issue the letter to Oscar (although I wrote the post) shows that he is worried some people may record phone calls to protect themselves. If his office is conducting themselves appropriately, what is the worry here?

So, in many ways the fact that I wrote my post gives the copyright extortion industry fair notice that the possibility exists to record a copyright extortion phone call.

Remember people, I am pretty good at getting most bullies (not all) off of me. I do whatever it takes.

Oscar did proper lawyerly thing and posted the obligatory warnings and it hasn't changed my opinion one bit.

It's interesting how this topic was buried but thanks to McCormack, it's back on top again!

Hey Timmy, how has legally threatening (clubbing baby seals is the image that comes to my mind) people worked for you on the copyright extortion front? Not so good eh?  I heard you had to cry to mommy Getty about your State Bar complaints. How does your file with the Attorney General look? I haven't checked lately. Don't worry, I am confident you will not be disbarred by any of this. It is only a "frivolous complaint" against your record. Nothing your stellar "copyright cow" reputation can't handle.

You can keep on going with your "Collections Business".  How does it feel running a collection agency? Fun business.

BTW, why are your new settlement letters suddenly so short nowadays? I guess it is because your toner cartridge expenses were getting too high and you were concerned about killing too many trees.

Hey, if one of your bitchy paralegals steps out of line and I get a recording of that, you want to prosecute the person recording it?  Ever heard of the "Streisand Effect"?  You may want to read up on the "Funnyjunk Lawyer Charles Carreon". Which lawyer wants to be next Charles Carreon?  Which lawyer is going to be used for target practice by the Internet community?

Don't you just hate it when all these annoying people keep emailing me their "confidential" information and paperwork? So many people want revenge and payback. Do you know even know how many people despise you and your staff? But hey, keep up the good work. I hear you have some fat cows to feed (I meant the "copyright cow").

Thanks for putting the phone recording topic back on top again! It had already been dismissed and buried. But with Oscar and your attention on it?  It's a hot topic again for debate.

Sales tax is highly regulated with very specific rules in reporting and payment.  In the case I saw, the letter was being sent to a recipient in Texas. But why Texas?  Generally sales tax is only collected by businesses that have a physical presence. There appears to be no Getty presence we can find in Texas at this time. Unless it is one of the Getty Images subsidiaries that have a presence.

In any case, all the Getty letters have specified that this is a "settlement", not a retroactive license or another product-based item subject to sales tax.

As aggressive as Getty might be, it is difficult for me to imagine them doing something so blatantly underhanded.  There is a piece of information we do not have.

We absolutely need to find out which states are getting letters where sales tax is being added to the amount.  Something is definitely off here.

This could be very interesting.  To my knowledge, you cannot collect sales tax on an infringement; that's a settlement not a sale. More importantly, the forum is correct that if you collect sales tax, you better forward it to the proper authorities as opposed to keeping it yourself. It would be interesting to track when and where they ad sales tax to their letters. We are seeing it once in a blue moon in my office as well recently. I would like to hear from any Getty victim who settled with Getty and included sales tax in their settlement. There may be the elements of a class action there if Getty is wrongfully charging sales tax.

People do need to know that you "volunteer" your time as time permits to make forum posts, replies, and the videos. But Oscar absolutely does not get any of the ELI Contributions. ELI Contributions comes to the bank account that is dedicated tracking online projects of which ELI is a part of.

Under normal circumstances, I would not post this thread on the Getty Forum since this forums is primarily focused on stock image extortion letters. However, I have made an exception to "promote" this topic out of the Dash Poem Extortion Forum originally found here.

Essentially, this started out as website FunkyJunk.com hired Charles Carreon (whom I will call Chuck going forward) to send cartoonist/humorist Matthew Inman of TheOatmeal.com an extortion letter asking for $20,000 out of the gates for posting defamatory comments.

Inman was rightfully surprised and outraged by this $20K extortion letter. He did something that even ELI has never done to fight back an extortionate lawyer.  He posted this extortion letter, dissected his letter in openly in graphical format, and set up a$20,000 charity fund.

Since then, the charity fund has blasted way past $100K within 3 days and has lit part of the Internet on fire because of Chuck.  And as if that wasn't enough, Chuck tried to get the charity fund taken down!  This was NOT a legal defense fund. It was a charity fund intended to get some publicity to his case. And it worked!

Last but not least, even after all this coverage, Chuck still vows to find some law to come after Inman!  He wants payback despite the fact that his client FunkyJunk seems to have backed off.

Chuck is a real tool and obviously an extortion lawyer. He says this has never happened before. That means he is used to extorting others and getting away with it. There are so many articles on Chuck.

Just do a search on "funkyjunk lawyer" or "Charles Carreon".

I "promoted" this thread to the Getty Forum up here for a few reasons:

1. It will be great fun following this story and making fun of Charles Carreon.
2. Help spread coverage of this story further on the Internet through our own SEO.
3. Tapping into the ELI Community's talents of beating back extortion lawyers.
4. Publicly support Matthew Inman, a person who truly deserves ELI support, unlike a certain reality entertainment blogger who I wasted my time on.

I am loosening up the reigns on the humor that I typically ask people to restrain themselves on. It is still NOT a free-for-all but Chuck really deserves what's coming to him.

Let me fire off some opening shots.

1. Charles Herman Carreon is not a model lawyer. He has a history of state bar infractions and suspensions. Check this out.

The one thing I want everyone to be mindful of is that ELI Credibility is important. Always has been and always will. Oscar and I believe it is one of our strengths and cornerstones.  Humor, parody, satire, humor, mockery, etc. are all appropriate in moderation. I want to ensure ELI Credibility always remains high.

As much as I would like to post funny sexual cartoon pictures of some people in weird positions, I think it would be much. I would also stay away from sex organs, feces, gore, and other overt stuff.  It maybe fun but as the "head stinky cheese" I think we should use some discretion and some self-control

Remember, we may have opportunities for press, media, and other influential types that could peek in. I would hate for them to hit the "wrong" thread if and when they do.

With great respect to Oscar, I keep my own counsel on the "cringe factor" and I think he knows that. If I have to make people cringe occasionally, then so be it.  Whatever it takes. I think it's safe to say we don't go into cringe-worthy territory unless someone motivates it. The one thing that is important to myself is that whatever I say or claim to do, I am able and willing to follow through.

So Oscar will continue to cringe occasionally as long as he "insanely" works with me.  ;) But I will try to restrain myself.  I am all for rational, calm discussion but I think we can all agree, it doesn't work many times in this business.

I think Oscar is forced to agree, our tactics may be edgy or causes people to cringe, but they darn well work!

It's sort of like the Glen Carner thing.  Going round and round is a waste of time at some point. Calling out collection lawyers, posting documents, making attorney general complaints and state bar complaints are not things we will give up anytime soon.

I also liked Oscar's mention of the "cringe factor." Being aware of this will help me be more mindful of what I write on the days when a full head of steam has worked up to blow off level.

Maybe "someone" (RK?) could call Texas Comptroller's office and find out if Getty Images actually pays in sales tax. Or see if Getty Images has a Certificate of Good Standing in regards to state tax collections.  Is Getty Images, in fact, truly collecting sales tax or not?

As if getting a Getty Images Extortion Letter isn't bad enough, we have just come across an extortion letter amount that adds an additional 8.25% sales tax in Texas!

The problem I have with this is that this is supposed to be a legal "settlement", not a "sale". Only legitimate sales are supposed to be taxed.  How can legal settlements be taxed?  I wonder how many extortion letters have sales taxes tacked on to the extortion amount. Which states are getting sales tax added to the extortion letter amount?  Is it selective states or all 50 states? How does this correlate to the actual physical presences Getty Images has in each state? We need to keep our ear to the ground.

This very fishy to me. It's not a sale but they still want to take on a extra percentage of sales tax. But it does further support the notion that Getty Images regard this as "sales revenue", not loss recovery as is typical with most collection efforts.
