Plain and simple if they are not found in a copyright search, they are not registered, most trolls do not supply a registration number, because there is none. This is usually the first request made, if you decide to engage them, they are demanding money sdo you need to demand proof of valid registration, if they fail to supply this, the image is probably not registered. Getty never supplies this. I have offered to help you search via private email, but you need to help me, help you, give us the photographers name and link us to the image from one of the other sites you have seen it on.. You have no obligation to protect the photographer or the image..continuing to do so leaves us without a means to help you.

a screen shot of the image on your site and a simple URL means nothing...it does not prove infringement..

Unfortunatley, this will have zero effect on stock images, and deals exclusively with P2P file sharing and bit torrent sites, and the main problem it will run into is still the fact that it all revolves around IP addresses.. I see that if a person gets a notice they can pay a $35.00 to have the case reviewed..this will make for a lot of unhappy people. Right this minute I can access 3 unsecured networks on my street alone, if I were to use their unsecured network to download music from a p2p site, do you think they would want to pay the 35 bucks, knowing full well they didn't do anything wrong?? I doubt it..Perhaps a step in the right direction, but a long way to go IMHO..

The stock image house will continue to send out their extortion letters, and I foresee them sending even more, as the world of traditional publishing slowly goes down the drain.. Just yesterday it was announced Newsweek will cease all print publications in 2013, there are loads of images in this publication that are from Getty and rights managed, and don't forget with RM images the cost is dictated by the usage, Getty will be taking a large hit in this regard...hence more letters, they have to make money somehow...

I guess you all figured I might have something to add here...While Glen Carner does earn a little respect from me, for at the very least making a move in the right direction in terms of the monies "requested", I still have an issue with his "employees" ie "clerks", ie "phishers" trying to collect using email and PayPal??

Both totally unprofesional...But I know what Glen would say to this... "This helps keep our cost down so we can offer a "reduced" amount for the"retroactive license" or something along those lies...

The other issue I have with this retroactive license is, how is Copyright Services International determining the lenght of the supposed "unauthorized use"..Just because a clerk with a keyboard type something doesn't always make it fact..

BuzzFeed lawsuit over celeb snaps raises copyright questions.

A photo agency is demanding $1.3 million from BuzzFeed after the viral news site published photos of singer Katy Perry and actress Kathy Griffin. The case comes at a time when online media is increasingly image-based, and raises questions about whether current copyright law is still working.

First, the facts. Florida-based Mavrix Photo filed a complaint in LA this week that claims BuzzFeed deliberately scraped the celebrity images as part of an effort to drive traffic to the site. It cited nine photos, including Perry on a rooftop (see right) and Griffin dancing topless (NSFW, obviously).

Mavrix appears to be in the business of copyright trolling

Hi Everybody,

Scott, you are not the only one. I have also been sued in Canada for one image only and naturally a mistake like so many of us. What I was wondering:   Who decides what penalty we have to pay? Their charges out outrageous to say the least.

Silvia, have you actually been sued??? Have you been properly served official court documents stating such?? Or did you just receive a demand letter? There is a huge difference, it's important that when we post we try to be as accurate as possible. To answer your question greatly depends on my questions..are you in fact being sued??

I think you are right on the money with this theory... I just pulled up both cases.

HAN filed suit against The Scott on 4/19/12 and Aloha hit HAN with a counter suit on 5/19/12

My theory is that Glen Carner filed this with the intention of following through or using it to extract payment but very shortly after filing Aloha hit Glenn with their countersuit which caused him to divert his time, attention and resources to that. It would be interesting to see the date when filed the suit and compare that to the date when Aloha filed their countersuit. I am sure that the countersuit rattled him pretty good and as I said before no one wants to fight a battle on two fronts if you can avoid it.

as Vegas copyright company Righthaven LLC appears eager to comply with the latest court order entered against it Tuesday, as noncompliance could cost its CEO a fine of $500 per day.

U.S. Magistrate Judge Peggy Leen in Las Vegas, ruling during a hearing, ordered Righthaven to turn over to a creditor hard drives from its computers so the creditor could determine if Righthaven has any assets that can be liquidated for the benefit of Righthaven’s creditors.

She gave Righthaven two weeks to surrender the drives or mirror images of them and said noncompliance would result in a daily sanction of $500 against the company and its CEO.

After the hearing, Righthaven CEO and Las Vegas attorney Steven Gibson fired off a letter to Righthaven’s attorney, Shawn Mangano, ordering him to comply with the directive.

“You are hereby instructed to follow without any departure whatsoever every aspect of the order made today in the case, just as you have been instructed to follow every previous order of every court,” Gibson wrote in the letter.

It appeared that Gibson sent the letter, with a copy to the judge, as an insurance policy, as Mangano had earlier told Leen he’d be happy to arrange the turnover of the drives to the creditor.

Apparently Hawaiian Art Network filed the suit, paid the 350.00 filing fee, but never served the other party, hence the other party never knew they were going to  get sued (except for the fact that I spoke with them and alerted them.) Idon't think a counter-suit would be an option...basically Glen Carner donated 350.00 to the court system and paid his attorneys to file the papers.

This action commenced on April 19, 2012. No proof of service has been filed with the Court, and no Defendants have appeared in this case. Not entirely new to ELI, but this is I think the second time we have heard of this "group", they also have ties to Glen Carner and hawaiian Art network in a round-about way. I am still awaiting more info from the newest letter recipient so I can do a more thorough job, but heres a few nuggets to feed on in the meantime.

Perfect10 v. Google states differently...linking to an image is NOT considered an infringement.

apparently they don't understand that the "copy" in copyright has a meaning...a link is not a "COPY"..

They just sent me three more for some files that were deleted and for some reason popped back up again.  I validated multiple times that all the files had been removed including the html page itself.
