folks should also know that they have the right if they feel they are being wronged to filed a complaint with the states attorney general, this could be done in every state he is "licensed" in.

Have they filed suit against you? or do you mean filing suit first? a case worth watching is the mywebgrocer v adlife, where mywebgrocer filed suit against adlife and is attempting to get a default judgement, been going on a while now and it does not look like either side is going to cave ( yet) a win for mywebgrocer would not bode well for adlife / higbee going forward.

"class actions" have been discussed many time here...not going to happen, one does not simply file a class action...one files the suit with many "does" or defendants and a judge decides if it is worthy of being a "class", which is not likely... what would be more "stinging" is if a bunch would band together and each file their own suit..imagine 50 people filing seperately, what a time suck that would be, Higbee would need to spend time/resources to answer and respond to each complaint.

as jerry says, this is a bad idea.. either create your own images, or properly purchase licenses...it's the cost of doing business.

I believe in addition to the "matches" that the Picscout software finds, it also identifies and extracts contact information from the site and then adds it to a database as well.

Then after a certain amount of data is collected the site probably then goes thru a manual review to verify the info (possibly by an actual person / minion / troll assistant) who then assembles an "infringement packet" and... away it goes.. (either via email, snail mail or both)

Once the accused responds ~ the games begin...   ;)

I strongly dis-agree with anything "manually" happening..right down to the unsigned form letters they send. Look how many people get letters, where the image in question was linked from an outside source, or brought into a site via feed scripts..

I received one of the ArtistDefense demand packages on behalf of Masterfile in the amount of $5,000+ for 1 image that was used on a popular user generated content website that I own. This was now back about 7 or 8 months ago. It came urgent via Fedex.

I did not make a payment to them, and I did not negotiate with them. I did however get back to them via e-mail to inform them that this was a user generated content website as I felt that they did not have a case against me. From my point of view, if Masterfile were successful with these claims, this would effectively be the end of the Internet as we know it.

This is clearly an abuse of the law. If there is anything that I can provide to Matthew or Robert from my experience, please let me know.

If you "own" a site that depends on user generated content, it would be in your best interest to to spend the money and file for a "registered agent". This would afford you safe harbor provisions under the DMCA, providing you do it correctly and adhere to the rules contained within.. Unfortunately it would not help you much with the current MF situation.

Being it's an email I would not respond, they have no way of knowing they got a "live one" unless you do so.. Secondly if they were to contact you by phone or registered mail. I would document such and advice NCS this is a "claim" not a "debt" and that NCS cease and desist any contact immediately, lest they get reported to the federal government for harassing you.. NCS is a collection agency and does not have rights to enforce a claim of copyright infringement.. I like how they no longer use names in their "signatures"....

The street address ArtistDefense uses matches the street address of Masterfile. See the Bloomberg info below on Masterfile.

I believe Masterfile "owns" ArtistDefense in much the same way Getty Images "owns" the LCS operation.

I'm not sold that Masterfile owns this entity, or shell company..only because they also send letters on behalf of 500px and others...could it be that well known MF troll Geoffrey Beal has left Masterfile and started his own gig??

I'm sold..shame on me, I must be getting old, as I didn't check this myself..the very basic of research.

As a side note the OP stated the images in question were "given" to us by a travel agent...This is a huge problem that I see often. Couple of things here.
1. when images are "given" or supplied, there in no way to now if the "giver" owns the images or the rights to said images.
2. many times license agreements and not "transferable"...meaning  IF the "giver" did indeed purchase a license, the terms in most cases state the images can only be used by the licensee and not
'handed down to someone else.

I had a client that owned a shoe store, he was supplied images/logos from the shoe manufacturer..the manufacturer used Getty images for their imagery..My client gets letter from Getty..Shoe manufacturer had to get involved and Getty went away, but it was a pain in the ass for my client.
