It looks like both images might have been photoshopped from an original. Perhaps they have permission from the original artists but I doubt it. This is a #gettyflubs issue in my opinion. The due dates are irrelevant. But expect a Tim McCormack letter in a month or so. If he writes you I would raise the two images issue directly with him and see if he responds to it.

They like to bother the client because the client likely knows less about tech issues and will freak out more readily. We have invalidated MF's methods of copyright registration in a case called Masterfile v. Chaga,(discussed extensively elsewhere on this forum).

Hey guys, I have definitely been swamped with litigation this summer -more so than usual for this season- and have even had to delay or postponed planned vacations. That is why we are delayed in getting back to everyone from the digitalimagelitigation email. As Greg suggests please remember that you can always call our office at 516 741 3222 If I am not in speak with Jeff or Susan who help on the Getty Images issue and can usually address your concerns. Also remember that the deadlines set in the letters are fictitious and don't actually effect the claim whatsoever. Finally, please also recall that I am a NY litigator with a very active practice and that while this is a very important issue to me, it sometimes has to take a back burner to other concerns I am dealing with in my practice. That being said we always try to response as promptly and efficiently as possible to your emails and inquiries.

Hey RoseBud: Sorry for the delay in responding to your question. MF has not changed its program at all in light of Chaga. They just say the case is on appeal and we are confident that it will be overturned. I spoke with the court recently and they expect a decision on the Alaska Stock case (which is essentially identical to the Chaga case) by the end of the year.

The problem is that digital images have been swapped, copied and placed into so many galleries that even the Big Boys often cannot be 100% certain that they have the exclusive right and use of the imagery.
