I will post later in regards to what they deem "information" and "content", as it is spelled out. Much like a lawsuit anybody can submit a DMCA takedown request, however in doing so, by signing it you are stating that you are the owner of the content, and open yourself up to perjury. I have a working theory of all of the players and how it all operates, hopefully I'll find time today to post it.

Getty probably wants to downplay the fact they own PicScout.
Everytime Masterfail uses PicScout for example, they're enriching their direct competitor Getty.

totally agree with that, however the video was shot in 2011, not sure if it was before Getty purchased picscout.

Righthaven Lawsuits Forum / Righthaven foe says cases are key to free speech

Las Vegas attorney Marc John Randazza likes a good fight — particularly if it involves free speech and the First Amendment.

Randazza recently discussed with VEGAS INC his role in the Righthaven lawsuit crusade and his love of the First Amendment.

Las Vegas attorney Marc John Randazza sues copyright infringers one day and defends them the next.

“There’s nothing wrong with doing both sides of copyright cases,” Randazza said.

He represents alleged copyright infringers in cases filed by Righthaven, for instance, and sues them on behalf of another client, Liberty Media Holdings LLC, a gay porn company.

A federal judge is refusing to let Righthaven LLC off the hook, reviving action in one of its cases Tuesday after saying it "fell through the cracks."

The revival of the suit poses a problem for Righthaven and its CEO, Las Vegas attorney Steven Gibson, because when Leen last addressed the case she had hit Righthaven with an order to show cause why it should not be held in contempt of court for failing to produce financial information to attorneys for DiBiase.

Bottom line, if the files are uploaded to a web server, and not password protected, they would be considered "published", if you don't want the public to see them or spiders/bots to find them don't upload them or protect them.....it's not rocket science we're talking about. I've been in business 12 years and have ALWAYS password protected projects under development, of just kept them on my local workstation..

If the domain "registrant" is your client and you are listed as the admin and tech contact, then they will pursue your client, as they are the "owner" of said domain.....
