I'm sure most of you are familiar with the "Innocence of Muslims" 14 minute film that has caused a stir in the Muslim world. I came across this article today:

It seems Google actually sent attorneys to argue that the actress who was duped into being in the movie had no rights to even have a HEARING if the movie should be taken off YouTube.

Now, I'm for free speech as much as anyone. However I find it ironic that Google will yank anyone's video off YouTube with a simple DMCA claim and yet showed up in court to argue that this video didn't violate her right to privacy. If I were representing her I'd be looking into filing a DMCA complaint against it right now.

The problem here is that if she files the takedown, she doesn't own it, which opens hers up to perjury issues, and as we all know from experience, the owner can simply file a counterclaim and have it restored.. If the makers of the film had any sense at all ( which I'm doubting) they would voluntarily remove it..I'm sure at this point the video is happily making it's way thru the 1000's of bit-torrent sites out there anyway..

How does that tie in with the Dan Levine in the email of the CDL? Check the phone number given in that first link against the phone number given in the CDL email. Identical. That's actually how I found this information. I googled the phone number. Amazing what you can find just from a phone number.

There is a Donna and Dan Levine registered at 16 Evans Drive, Brookville NY 11545. It's listed on page 35 (thats page 35 of the page numbers on the document, not sure it's the same page number as the pdf). Further information given list it in the Jericho school district. Also shows the market value of their house to be $2,750,000. Nice

That first link I posted shows the tax lien fund to be registered in Jericho.

The textbook in question is a required purchase for a course entitled "Global Visual and Material Culture, Prehistory to 1800." Any art that would appear in that book would be public domain — it's all over 212 years old at this point, after all. Still, since the book's publisher could not get clearance to use the pictures from Stokstad and Drucker Images, a decision was made to print the incredibly expensive art book without pictures of any kind. Students who purchase the book are instead given access to a web resource for viewing the art that should have appeared on the book's pages.

Just a quick update for everyone, today I received a letter from the Ohio State Atty. Gen.'s office stating that they are still awaiting a response from Getty to my complaint with their office.

I wonder if Getty is going to send the same form letter response as they sent to all the other agencies I've complain to them about or if they are revamping it since they know I send a follow-up letter ripping them apart for not addressing the issues I brought up, a couple of out right lies and the major typos where they have my company name wrong as well as the amount they are claiming. I will let everyone know how Getty responds to this complaint.

I had incredibly busy weekend and was not able to get my packet together to send off to the Library of Congress's legislative Council that Stinger was able to provide but should have that finished up and off in the mail in just a few days and as always will make the letter as well as any responses available on my  Scribd account.

I have a feeling you will hear nothing but crickets from them from this point on..they have to many other soft targets and low hanging fruit to take advantage of...

Where is the proof? just because they say they represent someone does not make it fact
"Our client has confirmed that they represent the photographer and have supplied full image details which should be more than sufficient evidence."
Roughly based?? WTF is that about, DEMAND they tell you EXACTLY how they come to this number.

They have not proven you did not purchase the image correctly or otherwise, it is on them to prove this claim.
"As you didn’t purchase the item correctly and legally in the first place"
You should demand a complete breakdown of the "losses incurred", in other words a complete sales history of this image..and they still have not proven "unauthorized use.
"The settlement amount also accounts for the losses incurred as a result of the unauthorised use."
Getty thenmselves elected to purchase PICSCOUT, and again don't let them "accuse" you or your company of anything, they have not proven their case.

A link to leaked Playboy pictures published by the Dutch blog GeenStijl infringed on Playboy's copyrights, the Court of Amsterdam ruled this week. It is the first time a Dutch court has deemed a hyperlink not only illegal but also copyright infringing.

GeenStijl must remove all links to a leaked Playboy photo shoot of Dutch reality TV personality Britt Dekker, the court ruled. GeenStijl infringed on the copyright of local Playboy publisher Sanoma by linking to the photo shoot, which was posted on filesharing site FileFactory.com and later on ImageShack.

While linking to content in itself does not infringe on copyrights per se, the court said that a combination of factors was crucial in this case. The broader public was not aware of the existence of the leaked photos before GeenStijl published the link, the court said. The public wouldn't have had access to the photos without GeenStijl's intervention, according to the verdict.

Also, in my experience YouTube videos seem to rank well for search engine results. Although the ELI Oovoo videos have been ranking for many demand letter phrases, it seems to me the Google/YouTube videos that Robert has been creating have been knocking it out of the park, especially for certain "Demand Letter" phrases combined with the troll's lawyer's name.

Thanx for the compliment Jerry! I agree youtube videos get more search engine exposure ( after-all Youtube is owned by google!) a quick youtube search for "copyright demand letters" without quotes will show we get great exposure here, as ELI expands into other areas, we will certainly take advantage of a wider array of search terms. Currently we're focused on getting a nice amount of episodes "in the can", and will then focus on the next level

I'll jump in real quick, but let Matthew reply to this if he has the time.. The videos we are doing will eventually be more search engine friendly, we've discussed this at lenght, we also plan on syndicating the video, thru various outlets to expand out reach..
