Getty Images Letter Forum / A Message From KeepFighting

I have decided to reveal my identity here in the forums and online community.  I am doing this not because I am special in any way, I am not.  I feel that the more we can put a face to our stories and situations the more we can show Getty that we are not afraid to fight their extortionist practices.  I am not out of my three year statute of limitations waiting period before I can breathe easy, in fact it has only been a few months since I received my letter but I am here to say that I am not afraid of Getty and I will be fighting them with every means at my disposal and am prepared to do whatever it takes.  I also had a conversation with Mathew today and let him know that it is my intention to continue to support ELI financially, as it would be a terrible loss if it were no longer here, as well as with my time here in the forums helping out any way I am able until ELI is no longer necessary.

I am not advising anyone to do what I am doing, there are risks involved but I feel as with any bully you stand up look them in the eye, pop them in the nose and they will go look for easier prey. 

So in the immortal words of Inigo Montoya I say to Getty:

That is very true and would be akin to the recent case over the IP addresses where they could not prove who was actually connected to the router, I hadn’t thought about it that way. Surely the attorneys know that there is next to no chance at all of winning this.  Unless they are just hoping they will just settle rather than fight because it would be cheaper.   I wish we could get a law like they have over in the U.K. where if you file a suit like this and lose you have to pay the other parties legal fees.  It will be interesting to watch.

I just came across this article and thought I would share it.  Here is an excerpt from the article.

Liberty Media Holdings (LMH) is suing two roommates in New York, alleging the illegal downloading of a pornographic film, even though LMH argues that only one made the infringing copy. Remarkably, LMH claims that the non-downloading roommate is also responsible for copyright infringement, simply because the Internet subscription is in his name and he might have known his roommate sometimes made illegal downloads.

I don’t think that this has much of a chance as it will be very had to prove that he knew what his roommate was doing.  Is it me or do the trolls seem to be getting more desperate and really starting to grab at straws lately?  You would think after all the recent smack downs from the judicial system the trolls would be a little more leery about filing this kind of suit.  I will keep an eye on this and see what happens.

Unbelievable, if it’s in the public how can you sue someone for taking and using a picture of it?  So I take a picture of someone standing in front of a statue or some other public work of art and post it to FB or some other social site the artist can turn around and sue me?  Grow up people, if you’re an artist and you don’t want people taking pictures of your art then don’t make public artwork.

I guess it’s because it’s in a video that will drive sales of the song so it’s making money but you Maya Hayuk must think as highly of herself and art as Linda Ellis does of herself and her poem.   Learn to support yourself or find other work!

I agree with MCFilms and S.G. as well, Getty has crossed the line with this.  It's just a matter of time and they'll cross the line with the wrong person and they will file a counter suit like Aloha did to HAN.

Welcome doggycase, I have been away for about a week with work and was just checking in to see what I have missed and give an update. I just received my response back from Getty on Friday, they still have not provided the information I have requested proving they have rights to the image, this message was short and sweet and said pay us or we will escalate this to our legal department. I will now escalate my case by sending complaint letters to the Washington State Attorney Generals office and my state Attorney Generals office.

I will fight Getty and the Trolls with everything at my disposal, I am not the easy prey they were hoping for and I will continue to fight them and all the copyright trolls.

Read the forums, most of what you need to know will be in there, educate yourself and ask questions.

Any updates on your case KeepFighting for today? I would be very interested in following this and I'm so glad to be here in this forum.

There certainly a lot of them out there, here are a few more I found just doing a quick search.  They all appear to be the same program by the actual file name and they all say they are free and it is from Glen Carner. 

Mr. Carner, taking you at your word that you did not upload this why are you not concentrating your efforts on stopping this instead of going after people who are innocently downloading it when everything on every page here says it’s free?  You say you are sending out C&D letters to these places, can you post some of them for us to see, so we can see that you are trying to stop the spread rather than cash in on people who have obviously been misled into thinking they were getting a free screen saver?

I’ve said it before and I’ll say it again, I love reading your posts buddhapi!  Not only to you present much needed timely information you make me laugh, snort and chuckle.  When you talk about the eye twitch I can picture the old pink panther movies and Chief Inspector Dreyfus with his eye twitching everything he here’s the name Clouseau.  I’m going to have to stop by and just yell Troll! Troll! Troll! and see what happens.

Glen, I think you are still missing the point.  While kinder and gentler demand letters designed to soften the blow may be nice, if someone puts a gun to your head (metaphorically speaking) and says give me your money, oh wait, I meant to say please give me your money, it’s still the same thing.  The main issue, at least for me is the amounts being asked for.  While a kinder letter would have not immediately put me on the defensive, until I got to the amount part, it is still wrong and smells no matter how much perfume you try and put on it. While my letter came from Getty Images rather than HAN I would have reacted totally differently if it had said something more to the effect of:

 We saw an image that belongs to us on your website and we cannot find your licensing of the image, if you have a license please provide it to us.  Here is what the law states about copyright infringement and recourse available to us to protect our IP.  We ask you remove the image or register it immediately, enclosed is a proof of registration and contract giving us right to protect this artist and this image.  If you have not removed or registered within X number of days, or provided proof of your valid license we will pursue our rights provided to us under the current copyright laws.

If I had received that, I would not be here now and I would not be committed to being here and supporting ELI any way I can until we are no longer needed.  If it had been one of the nicer letters you are talking about and the amount still the same, I would still be here, no difference.

Until you stop using the courts as a means of profit rather than as justice to go after willful infringers I see no change in the attitudes and actions against you and the other stock photo companies.  You will continue to see more resistance, when you do bring cases to court you will see more counter suits against you and you will see your companies and the artists you represent image and public standing continue to fall.

These are just my opinions and you may take them or leave them and I really don’t care.  Your comments so far have seemed to be more about how can you still get outrageous sums of money from people and make them feel better about it.  I will again say I give you credit for coming to the forums, and I know you have only been here a few days now but it looks to me like you are just trying to find a way to keep doing business as usual while trying to improve your public image/relations.  Please prove me wrong and I hope continue to talk on the forums.  Things will change whether you do it or are made to do it, they will change.
