Lettered you missed 6: I received a letter for hotlinking which the courts have decreed is not infringing at all.

and number 7: I have in my possession a valid license, but Getty images still want to extort me for money.

I'm not wasting any more time with this poster, it is very clear to me that he is completely ignorant of the issues at hand.

ha!!! an ex getty "intern" who obviously doesn't get it! I generally refrain from being upfront and honest with most new users, but you my friend are an asshat!

Do you have any proof the OP "stole" this image? (I think not)
Do you have any proof that this image even belongs to Getty? (I think not)
Do you have any idea how the actual "legal system" works? (I think not)

You my friend have absolutely no right to determine who here has integrity, as a matter of fact you'd be better served to keep your pie hole shut, until you see and understand what ELI is about. Every single one of us are content creators of some sort, and every single one of us respects copyright. What we don't respect are companies like Getty images that try to twist the law, and use fear as a means of making money.. As far as I'm concerned you automatically fall into this category, just because of your own ignorance.


You stole an image, got caught, removed the image and moved on?  Good job I guess.  Maybe next time you shouldn't steal the image to begin with?

I interned at Getty Images when I was in college, many years ago.  The company pays thousands of professional photographers worldwide to snap pictures, nonstop.  Out of every 100 professional-taken photos the company pays photographers to snap, only 1 makes it to their archive for resale.

When individuals like you steal their images without paying their requested royalties, you cause the price of images for all other paying customers to go up.

If you have an oz. of integrity, you'd pay them for the image you stole and then proudly display it on your Website, since you know it's a very worthy image to display.

so I guess now if you own a bar /restaurant, cafe or whatever, and you want to have a live band, you are not permitted to allow that band to play any cover songs from other artists?? WTF?

Copyright lawsuit filed against 202 Market
The suit claims there were live performances of music without a license or permission.

A downtown Roanoke restaurant is facing a copyright infringement lawsuit for hosting live music acts that performed the songs of various popular artists, from Johnny Cash to The White Stripes.

202 Market was named in a lawsuit filed Wednesday in U.S. District Court in Roanoke.

Matthew has been stating this for a long time..content creators, artists, publishers need to grow and expand with the times, this is such an example:

Award Winning Manga to be Freely Used by Anyone for Anything Anytime, Author Will Not Request Royalties

This means that after 15 September anyone in the world will be free to novelize, televise, create merchandise, or in any way adapt the original work for either commercial or non-commercial purposes without having to pay royalties.  This is the latest move in the writer’s quest to find alternatives to the “outdated” model of intellectual property rights.


Earlier this year Sato had severed ties with the original publisher of the Say Hello to Black Jack series and put the works on his own web publishing site MangaonWeb.  Details are yet to be confirmed but Sato is saying that he will not relinquish his copyright, but that he will not enforce it for an indefinite time.

“The traditional model of making profit by holding onto a copyright is gradually going stale” he said.  “I want to explore the possible benefits to authors beyond this system.” Around the same time from 20 September to 2 October, Sato will put his work on display at the pixiv Zingaro in Tokyo.  A copy machine will be on hand for the exhibit for visitors to replicate whatever they want.

Well thats certainly an option, and it may very well be the right choice...then again, there are reasons why we suggest what we do.. Yes getty has'nt pulled the lawsuit trigger over 1 image, but it is always their option to do so. At the very least by writing to them and either making an offer, or requesting proof, you have something in paper, should it ever go to court, which is much better than standing in front of a judge saying. "no your honor, when they contacted me I did not try to resolve the issue, I just threw everything in the garbage" That would not look to good to a judge I'm afraid...whereas, IF you had to go that far and were able to state the opposite..the judge would probably look down at Getty..

Not sure, but couldn't hurt to try, and I'm sure there is a canadian office of some sort you can complain to..perhaps SG will chime in here..he's our "canadian expert" in all things...well maybe not all things..

They'll send the check back, and send another letter..they want your money..as long as you are aware that any letter you send them will not make them go away, and you're prepared to go back and forth for 3 years..go ahead and send it..you could also considering adding if they return the check and do not supply proof of ownership, you will file a complaint with the AG..if nothing else it will be a time suck for them.

Robert - question for you, as I'm in Canada will a letter to the AG help?  Will they respond to a Canadian?

Not only does this site steal my content, it also steals my bandwidth, with it's nasty content scrapers... etc..you get the idea...shame him in his own house!

If I were in Lucia's shoes, I would go about it differently, I'd go oatmeal on his ass!! If he's copying, framing or whatever my content, I would commit to making a daily post, not only linking back to my site, but in that post I'd be ripping into him, and letting it be known that he is infringing on my content and also infringing on everybody elses content.. I'm sure he would not want his "premium" subscribers to see that he is a blantant copyright infringer...he's most likely stopp pulling your content, after enough post are written throwing his lousy ass under the bus...but thats just me

What an amazing story.  Progressive Insurance got very motivated very quickly.

This is what stuns me about all the extortion letter victims who continue to be silent.

I think it's safe to say that the ELI Community subscribes to speaking out very loudly against "wrongfulness".
