I agree.  Just assume GI Ireland has the exclusive rights. (I know it is not very likely  ;)

What I wanted to point out is that if GI US claims (and try to extort money from US Citizen by threatening to sue  ) they have the exclusive rights but the rights are with their affiliates in Ireland would that be fraud  ?

I talked to Scraggy on the phone a couple of weeks ago. We talked about the topic who owns the exclusive rights.
I have a copy of a letter where Getty Image International ( Ireland)  confirms (signed by their Director) that they own the international exclusive rights of certain photos of a US Photographer (who lives in the US until today). (Getty International  Ireland is a subsidiary (daughter company) of Getty Image US INC.)

If you look at the standard Getty Image license agreement : Getty Image (US) should hold the exclusive rights (because of the Location of the photographer). But Getty Image International claims to own the exclusive rights.

Just in case a US Person uses one of the photos of the mentioned US photographer without permission.  Who is allowed to go after this person (according US Law)?

Getty Image  US or Getty Image International in Ireland?  Who is allowed to sue in the US?

If Getty Image (US) claims in their demand letter that they own the exclusive rights, would that be legally correct, since their daughter company GI International (Ireland) owns the rights?

Would the IRS be interested in the fact that a US company claims that they own the copyright of a photo which is owned by their daughter company which is established in a tax shelter country (Ireland) in terms of their license revenue?

P.S. : Personally I think that Getty Images writes in their letter (regarding ownership) whatever would help to get their money.  If the person lives in the US it belongs to Getty Image US if the person lives in Europe it belongs to Getty Image International and so on.

If I read correctly:

Everybody would be able to  sign a contract with GI, delivering a photo which does not belong to him/her and nobody on GI side is double checking it as long as the person warrants it is his own.

Perfect world :)

If you would do this with cars as a car dealership you will be out of business within minutes

It looks like ELI is hurting them more as we may think. The big problem for GI is that they use low paid  clueless clerks and low level attorneys :). So they have to protect themself against themself:)

Regarding Ownership of the rights :

I have got a conformation of rightholdership signed by Marek Wystepek in which he states:
Hereby I confirm that the exclusive, worldwide right to license and distribute the aforementioned image (s) has / have been conferred on Getty Image (International, Dublin) by respective photographer. ....

The photo is one of the famous Stone Collection. Since there are many photos of the Stone Collection  involved in a lot of cases in the US here comes  my question:

Just in case the photo rights belongs to GI Int. Ireland: Would GI USA be able to sue one person in the USA? Should that not be GI Int.  Ireland?
If it should be GI Ireland we could have a similar case in the US regarding the right to sue?

I have got  a suggestion :

Glen should stay under one condition: As long as he is discussing with us here he has to stop his demand letters for this period of time. If he decides to stick to his program he should leave and stay away.

Sorry, but I did not see any " new year resolution" regarding the website which offers the photos for free. Is it because it would be suicidal for your business ?

It is like fighting the drug users but on the other hand protecting the drug dealers.

My thoughts:

I think that his (Mr. C.) court case is not going the anticipated path. He is showing goodwill and is joining this forum.  So he can tell the judge: Look I really want to understand both sides and this is not a business model. I have to protect Mr. Tylor bla bla bla.

No accusation just thoughts !

I think that hiring young lawyers is a part of their plan. I looked at the website of the European attorneys who do the work  for GI. I came across the Swiss lawyer: They hired young lawyers too:
